In the time since that bipartisan achievement, the Trump administration has worked to systematically undermine the law and weaken chemical safety.<\/p>\n<p>But we\u2019re not sitting idly by, and we have the law on our side. This year, on the anniversary of the legislation\u2019s passage, we\u2019re highlighting some of the victories we\u2019ve had and ways we\u2019re fighting back to demand EPA protect the American people from harmful chemicals.<\/p>\n<p><strong>1. Winning important legal cases to hold EPA to the letter of the law <\/strong><\/p>\n<p>Last year, in response to a challenge from EDF, a federal court <a href=\"https:\/\/blogs.edf.org\/health\/2019\/04\/26\/d-c-circuit-affirms-publics-right-to-know-about-chemicals-in-use-under-reformed-law\/?autologin=true&amp;utm_source=EDF%20action%20network&amp;utm_campaign=edf-health_none_upd_mem&amp;utm_medium=email-55134&amp;utm_id=1556897671\">delivered a strong rebuke<\/a> to the Trump EPA\u2019s efforts to undermine the public\u2019s right to know about the chemicals in our homes, schools, and workplaces. The ruling on our lawsuit means that companies can\u2019t hide, and EPA must make public, more information about chemicals in use today.<\/p>\n<p>And a <a href=\"https:\/\/blogs.edf.org\/health\/2019\/11\/15\/the-courts-tsca-decision-is-a-much-bigger-win-for-public-health-than-first-meets-the-eye\/?autologin=true&amp;utm_source=EDF%20action%20network&amp;utm_campaign=edf_none_upd_mem&amp;utm_medium=email-55982&amp;utm_id=1575999498\">ruling last year in a different case<\/a> \u2013 brought by health, labor and environmental groups, including EDF \u2013 has already increased pressure on EPA to stop ignoring known sources of exposure to chemicals when assessing their risks. Conducting the comprehensive risk reviews that the law requires is critical to protecting health, especially for vulnerable populations, like children, pregnant women, and fenceline communities.<\/p>\n<p><!--more--><\/p>\n<p><strong>2. Revealing undue industry influence on approvals of new chemicals <\/strong><\/p>\n<p>EDF closely tracks EPA\u2019s flawed reviews of new chemicals entering the market. So it caught our attention when the agency gave a company the green light to use a chemical in ski wax only months after saying it would block it, based on the concern (among others) that the chemical could \u201cwaterproof the lungs.\u201d After digging into the case, <a href=\"https:\/\/blogs.edf.org\/health\/2020\/01\/27\/what-connects-cross-country-skiing-and-chemical-safety\/\">we found<\/a> that the company had essentially bullied EPA into approval, threatening to use \u201cmore environmentally harmful\u201d ingredients if the agency didn\u2019t give in. We provided documents and information to <em>Outside Magazine<\/em>, which published a <a href=\"https:\/\/www.outsideonline.com\/2408206\/nordic-skiing-fluorinated-wax-swix\">feature article<\/a> revealing this serious case of industry influence. Meanwhile the same company settled an enforcement lawsuit brought by EPA for illegally importing numerous ski wax chemicals.<\/p>\n<p><strong>3. Suing EPA to compel disclosure of health information on new chemicals<\/strong><\/p>\n<p>EPA regularly conceals health information about chemicals that companies are trying to bring to market \u2013 against clear requirements in the law that such information cannot be withheld. In <a href=\"https:\/\/earthjustice.org\/news\/press\/2020\/report-trumps-epa-sued-for-concealing-health-studies-violating-its-chemical-laws\">a recent investigation<\/a>, EDF and Earthjustice found the agency is slow to alert the public when a new chemical is up for approval, allows companies to hide health and safety information, and doesn\u2019t check companies\u2019 claims to determine if what they deem \u201cconfidential business information\u201d is even eligible for protection from disclosure. These actions not only go against the law\u2019s transparency requirements, they put public health at risk.<\/p>\n<p>So, EDF \u2014 along with other national and state allies, and represented by Earthjustice \u2014 is suing EPA to force the agency to stop violating the law in implementing its program to approve new chemicals.<\/p>\n<p><strong>4. Spotlighting the agency\u2019s abandonment of sound science on known hazardous chemicals <\/strong><\/p>\n<p>Trichloroethylene (or TCE) is a cancer-causing chemical used in adhesives, spot removers and other common household products. Even very low exposures to it are linked to fetal heart defects that can have life-long health consequences. Yet the Trump administration\u2019s latest risk evaluation of this chemical downplays these dangers, while also ignoring major known exposures, in the process violating the law. EDF is <a href=\"https:\/\/blogs.edf.org\/health\/2020\/03\/02\/reveal-news-exposes-trump-administrations-disregard-for-protecting-the-public-from-a-highly-dangerous-chemical-5-key-takeaways\/\">shining a light<\/a> on the agency\u2019s actions on this chemical \u2013 including by revealing the major flaws in its decision making and holding it accountable on the science.<\/p>\n<p style=\"padding-left: 40px;\"><em>Take action: <a href=\"https:\/\/act.edf.org\/bppjwda?utm_source=vanity-url&amp;utm_campaign=edf_public-health-threats---tsca_upd_dmt&amp;utm_medium=social-media&amp;utm_id=1586358079&amp;utm_content=tcetakeaction&amp;p2asource=1586358079\">Tell EPA<\/a> to listen to the science on TCE.<\/em><\/p>\n<p><strong>5. Exposing the impact of conflicts of interest<\/strong><\/p>\n<p>It\u2019s no secret that the Trump Administration has stacked various agencies with former industry executives and lobbyists who have deep conflicts of interest. One such political appointee is Nancy Beck \u2013 a <a href=\"https:\/\/blogs.edf.org\/health\/2017\/10\/23\/top-5-takeaways-from-this-weekends-ny-times-investigation-into-industry-influence-in-epas-toxics-program\/\">former chemical industry exec<\/a> who has used her time at EPA and the White House to reverse course on protections, adopt illegal practices and undermine science. Her impact has been <a href=\"https:\/\/blogs.edf.org\/health\/2020\/04\/20\/former-chemical-industry-official-beck-now-at-trump-white-house-again-interferes-to-weaken-epa-action-on-dangerous-chemicals-this-time-its-pfas\/\">far-reaching<\/a>: She\u2019s undercut our landmark chemical safety law and played a key role in blocking and weakening bans on toxic chemicals, among many other actions that benefit industry.<\/p>\n<p>And now, President Trump has nominated her to chair the Consumer Product Safety Commission, a position she would hold through 2025 if confirmed. CPSC is the agency responsible for ensuring the safety of everything from cleaning products to baby cribs and children\u2019s toys.
