{"id":8149,"date":"2018-09-14T08:16:11","date_gmt":"2018-09-14T13:16:11","guid":{"rendered":"http:\/\/blogs.edf.org\/health\/?p=8149"},"modified":"2018-09-14T08:16:11","modified_gmt":"2018-09-14T13:16:11","slug":"challenge-fdas-gras-rule-moves-forward","status":"publish","type":"post","link":"https:\/\/blogs.edf.org\/health\/2018\/09\/14\/challenge-fdas-gras-rule-moves-forward\/","title":{"rendered":"Challenge to FDA\u2019s GRAS rule moves forward after court rejects request for dismissal"},"content":{"rendered":"<p><a href=\"https:\/\/www.edf.org\/people\/tom-neltner\"><em>Tom Neltner, J.D.<\/em><\/a><em>,\u00a0<\/em><em>is Chemicals Policy Director<\/em><\/p>\n<p>In a critical ruling for food additive safety, a federal district court <a href=\"https:\/\/blogs.edf.org\/health\/wp-content\/blogs.dir\/11\/files\/2018\/09\/Challenge-to-FDA-GRAS-RULE-USDC-SDNY-Opinion-and-Order-9-12-18.pdf\">ruled<\/a> on Wednesday that EDF, represented by Earthjustice, has standing in its <a href=\"https:\/\/blogs.edf.org\/health\/2017\/05\/22\/toxic-secrets-in-our-food-edf-joins-in-lawsuit-aimed-at-protecting-food-safety\/\">legal challenge<\/a> to the Food and Drug Administration\u2019s (FDA) Generally Recognized as Safe (GRAS) rule. This 2016 final rule allows food manufacturers to make secret GRAS safety determinations for chemicals added to food, without notifying FDA or the public, and to use the chemical in food without anyone else\u2019s knowledge. The court was considering a motion to dismiss from FDA arguing that plaintiffs did not have standing to bring the case. The judge found EDF and the Center for Food Safety (CFS) \u201cplausibly allege harm to their members\u201d and therefore \u201csatisfy the injury-in-fact requirement for standing.\u201d Our legal challenge now moves to the substance of our concerns with the flaws in the <a href=\"https:\/\/www.fda.gov\/Food\/NewsEvents\/ConstituentUpdates\/ucm516332.htm\">agency\u2019s GRAS Rule<\/a>.<\/p>\n<p>The court found that members of EDF and CFS showed a risk of harm consistent with the requirements of the law in alleging that FDA\u2019s \u201cGRAS Rule poses a credible threat to their members.\u201d Specifically the court stated that:<\/p>\n<ul>\n<li>Their members \u201chave been and will be exposed to potentially dangerous substances that were introduced into the food supply without FDA oversight, public participation, or the opportunity for judicial review.\u201d<\/li>\n<li>They \u201cexplicitly identify multiple substances that manufacturers determined to be GRAS and used in food despite concerns raised by FDA about their safety, as well as additional undisputedly dangerous substances that Plaintiffs reasonably anticipate will be introduced into the food supply under the GRAS Rule.\u201d<\/li>\n<li>\u201c[T]hese injuries are ongoing and imminent.<\/li>\n<\/ul>\n<p><!--more--><\/p>\n<p>The court also rejected FDA\u2019s arguments that our members have the power to avoid any potential injury from unsafe chemicals added to food and said that EDF is not required to show harm was unavoidable.\u00a0 Even if this were required, the court saw merit in our arguments that exposure to potentially unsafe GRAS chemicals was indeed unavoidable because the safety determinations and often the chemical names were publicly unknown.<\/p>\n<p>The judge found FDA\u2019s argument that a stronger rule might not make a difference as \u201coverly simplistic,\u201d stating that \u201cI refuse to give credence to Defendants\u2019 arguments that assume a lack of enforcement or incompetence on the part of FDA.\u201d<\/p>\n<p>We are pleased that the court ruled in our favor in this crucial first step. In light of the <a href=\"https:\/\/blogs.edf.org\/health\/2018\/07\/23\/aap-needed-reforms-broken-food-additive-regulatory-system\/\">American Academy of Pediatrics&#8217; policy statement<\/a> published in July 2018 that called for FDA to greatly strengthen or replace the GRAS determination process, we hope that the agency will update its final rule.
