Late yesterday, EDF filed our Opening Brief <\/a>in our case <\/a>challenging EPA\u2019s Inventory Notification Rule<\/a>.\u00a0 The Brief was filed with the U.S. Court of Appeals for the District of Columbia Circuit.<\/p>\n

Our Brief argues in favor of the public\u2019s right to know.\u00a0 Among other arguments, it explains that EPA erred by allowing companies to assert \u201cConfidential Business Information\u201d (CBI) claims that do not meet the law\u2019s requirements. \u00a0As a result, EPA will be concealing information about chemicals, particularly information about specific chemical identities, in violation of the public\u2019s right to know.\u00a0 EDF also filed our two-volume Addendum<\/a> supporting EDF\u2019s standing to pursue this lawsuit.\u00a0 The Addendum proves that EDF uses this kind of information to study and communicate to the public about chemicals and to advocate for measures to protect public health.<\/p>\n

EPA\u2019s response brief in the case is due to the Court on May 21, 2018.<\/p>\n
