In his <a href=\"http:\/\/www.markey.senate.gov\/imo\/media\/doc\/GRAS_04%2026%202016.pdf\">April 26 letter<\/a>, he asked the agency to respond by May 17.<\/p>\n<p><a href=\"https:\/\/www.edf.org\/people\/tom-neltner\"><em>[\/pullquote]Tom Neltner, J.D.<\/em><\/a><em>,\u00a0<\/em>is Chemicals Policy Director<em>.<\/em><\/p>\n<p>In May 2015, <a href=\"http:\/\/business.edf.org\/projects\/featured\/sustainable-supply-chains\/behindthelabel\/a-blueprint-for-safer-food-additives\/\">36% of consumers<\/a> said that chemicals in food was their most important food safety issue and 23% of consumer said they changed their purchase habits out of concern with chemicals in their food. Leading food manufacturers responded by <a href=\"http:\/\/business.edf.org\/projects\/featured\/sustainable-supply-chains\/behindthelabel\/a-blueprint-for-safer-food-additives\/who-is-promising-what-on-food-additives\/\">reformulating their products<\/a> to remove artificial flavors and colors.<\/p>\n<p>What if these same consumers knew that chemicals added to their food had not been reviewed for safety by the Food and Drug Administration (FDA)? As the Natural Resources Defense Council made clear two years ago, <a href=\"https:\/\/www.nrdc.org\/resources\/generally-recognized-secret-chemicals-added-food-united-states\">56 food additive makers chose to avoid FDA\u2019s scrutiny<\/a> by taking advantage of a loophole in the law for \u201cGenerally Recognized as Safe\u201d (GRAS) substances. They purposely chose not to be transparent by keeping secret the safety evaluation conducted by their employees or consultants. These companies appear to make only a few of the estimated <a href=\"http:\/\/www.pewtrusts.org\/en\/research-and-analysis\/reports\/2013\/11\/07\/fixing-the-oversight-of-chemicals-added-to-our-food\">1000 chemicals that FDA has not checked for safety<\/a> or is aware they exist.<\/p>\n<p>In February, we learned that 51% of consumers think that <a href=\"http:\/\/business.edf.org\/blog\/2016\/02\/24\/consumers-changing-views-on-food-safety\/\">safety means not only that a product is free of harmful ingredients but that its labeling is clear and accurate<\/a>. Forty-seven percent want clear information on ingredients and sourcing. With this in mind, it\u2019s fair to assume that consumers also expect that all food chemicals are safe and known to the FDA. Many consumers would likely not buy products where the labeling failed to disclose that the food they serve their families contained ingredients the FDA has admitted it <a href=\"https:\/\/www.washingtonpost.com\/national\/food-additives-on-the-rise-as-fda-scrutiny-wanes\/2014\/08\/17\/828e9bf8-1cb2-11e4-ab7b-696c295ddfd1_story.html\">\u201ccannot vouch for their safety&#8221;<\/a>.<\/p>\n<p>On <a href=\"http:\/\/www.markey.senate.gov\/imo\/media\/doc\/GRAS_04%2026%202016.pdf\">April 26<\/a>, Senator Edward Markey (D-MA) put the issue front and center when he <a href=\"http:\/\/www.markey.senate.gov\/imo\/media\/doc\/GRAS_04%2026%202016.pdf\">asked FDA<\/a> whether it has \u201csufficient authority to require a special label on any foods or beverages containing ingredients that have been self-determined to be GRAS without an FDA review?\u201d If FDA had sufficient authority, then \u201cwhat would the label look like?\u201d<!--more--><\/p>\n<p>Recognizing that safety goes beyond transparency, Senator Markey also addressed the risk of <a href=\"http:\/\/archinte.jamanetwork.com\/article.aspx?articleid=1725123\">conflicts of interest<\/a> that are inherent and pervasive in secret safety decisions made without FDA oversight. He asked FDA if it has authority to promulgate rules to minimize conflicts of interest for experts making the safety decision. Based on FDA\u2019s comments at a recent Grocery Manufacturers Association meeting, <a href=\"http:\/\/www.foodnavigator-usa.com\/Suppliers2\/FDA-s-2016-food-agenda-prioritizes-FSMA-product-labeling-GRAS-GMOs\">the agency confirmed<\/a> it was only planning to issue a non-binding guidance on such conflicts instead of an enforceable rule. Finally, the Senator asked whether FDA needs additional authority to ensure the safety of GRAS substances, and requested a response on all his questions by May 17.<\/p>\n<p>Senator Markey\u2019s questions get at a fundamental question: as long as the agency cannot ensure the safety of GRAS substances, can it then enable consumers to make a better informed choice whether or not to buy food with ingredients that the agency has never evaluated for safety? There is precedent for such actions with dietary supplement ingredients.
