{"id":3838,"date":"2014-06-25T12:57:35","date_gmt":"2014-06-25T17:57:35","guid":{"rendered":"http:\/\/blogs.edf.org\/health\/?p=3838"},"modified":"2024-02-12T11:01:36","modified_gmt":"2024-02-12T16:01:36","slug":"epa-releases-final-risk-assessment-for-tce-one-down-84999-to-go","status":"publish","type":"post","link":"https:\/\/blogs.edf.org\/health\/2014\/06\/25\/epa-releases-final-risk-assessment-for-tce-one-down-84999-to-go\/","title":{"rendered":"EPA releases final risk assessment for TCE: One down, 84,999 to go*"},"content":{"rendered":"<p><em><em>Richard Denison, Ph.D.<\/em><em>,<\/em> is a Lead Senior Scientist.\u00a0 <a href=\"http:\/\/environmentaldefense.org\/page.cfm?tagID=62101\"><em>Jennifer McPartland, Ph.D.<\/em><\/a><em>,<\/em> is a Health Scientist.<\/em><\/p>\n<p><span style=\"color: #000000;font-family: Calibri;font-size: medium\">EPA achieved a rather significant milestone today in releasing a <\/span><a href=\"https:\/\/www.epa.gov\/assessing-and-managing-chemicals-under-tsca\/tsca-work-plan-chemical-risk-assessment\"><span style=\"color: #0000ff;font-family: Calibri;font-size: medium\">final risk assessment for the solvent trichloroethylene (TCE)<\/span><\/a><span style=\"color: #000000;font-family: Calibri;font-size: medium\">.\u00a0 This document is for the first of a group of 83 \u201c<\/span><a href=\"http:\/\/www.epa.gov\/oppt\/existingchemicals\/pubs\/workplans.html\"><span style=\"color: #0000ff;font-family: Calibri;font-size: medium\">work plan chemicals<\/span><\/a><span style=\"font-family: Calibri\"><span style=\"font-size: medium\"><span style=\"color: #000000\">\u201d EPA identified in 2012 as needing risk assessments and, where warranted, risk management.<\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Calibri\"><span style=\"font-size: medium\"><span style=\"color: #000000\">Why do we call it a milestone?\u00a0 It is the first <i>final<\/i> risk assessment issued by EPA using its authority under the Toxic Substances Control Act (TSCA) <a href=\"http:\/\/blog.epa.gov\/epaconnect\/2014\/06\/a-journey-begins\/\">in \u2013 wait for it \u2013 <b><i>28 years<\/i><\/b><\/a>.<\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Calibri\"><span style=\"font-size: medium\"><span style=\"color: #000000\">The last time EPA issued a final risk assessment for a chemical under TSCA was in 1986, for asbestos.\u00a0 (EPA has developed a few draft assessments under TSCA over the years, but today marks the first time since 1986 that one of them has been finalized.)<\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Calibri\"><span style=\"font-size: medium\"><span style=\"color: #000000\">So, kudos to EPA for finally getting this risk assessment to the finish line.\u00a0 Now what\u2019s next?\u00a0 <!--more--><\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Calibri\"><span style=\"font-size: medium\"><span style=\"color: #000000\">The 200+ page risk assessment examined only a subset of uses of TCE, those thought most significant by EPA.\u00a0 Among its key findings are that certain uses of TCE \u2013 for degreasing and spot cleaning and in spray coating used arts &amp; crafts \u2013 pose unacceptably high risks to workers and consumers.\u00a0 These risks entail both cancer and non-cancer health impacts, and both acute and chronic effects.<\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Calibri\"><span style=\"color: #000000\"><span style=\"font-size: medium\">These clear findings of unacceptably high risks mean that EPA must promptly initiate actions under TSCA to address those risks.\u00a0 Section 6 of TSCA provides EPA with broad potential authority to restrict the use of chemicals if it can meet its burden of demonstrating the risks are \u201cunreasonable.\u201d\u00a0 That has proven to be no easy task.\u00a0 The infamous 1991 <i>Corrosion Proof Fittings<\/i> decision by the 5<\/span><sup><span style=\"font-size: small\">th<\/span><\/sup><span style=\"font-size: medium\"> Circuit Court of Appeals vacated nearly the entirety of EPA\u2019s TSCA regulation to ban most uses of asbestos, with the court arguing EPA had not met its burden.\u00a0 Since then, EPA has never again tried to use that Section 6 authority.<\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Calibri\"><span style=\"font-size: medium\"><span style=\"color: #000000\">The findings of today\u2019s risk assessment of TCE make clear that it is high time EPA takes another run at using that authority.\u00a0 EDF urges the agency to promptly initiate a rulemaking under TSCA to restrict the identified uses of TCE.<\/span><\/span><\/span><\/p>\n<p><span style=\"font-size: medium\"><span style=\"color: #000000\"><span style=\"font-family: Calibri\">The fact that today\u2019s announcement is such a milestone also amply demonstrates the critical need for reform of TSCA \u2013 as <a href=\"http:\/\/yosemite.epa.gov\/opa\/admpress.nsf\/596e17d7cac720848525781f0043629e\/63605bd594c4aacb85257d020068a28b!OpenDocument\">EPA prominently noted in its press release today<\/a>.\u00a0 The absence of any mandate or deadline under the current law for EPA to identify, assess and manage high-risk chemicals has stymied the Agency\u2019s efforts for decades.\u00a0 <\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Calibri\"><span style=\"font-size: medium\"><span style=\"color: #000000\">Another equally large obstacle that demands reform of TSCA is EPA\u2019s highly constrained authority to require testing and collect the information needed to support risk assessment. \u00a0TCE is a relatively data-rich chemical, which facilitated EPA\u2019s ability to develop and finalize its risk assessment; for many or most of the tens of thousands of other chemical in commerce today, however, EPA simply must be provided the authority it needs to obtain data on uses, hazards and exposures to be able to identify, prioritize, assess and manage chemical risks.<\/span><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Calibri\"><span style=\"font-size: medium\"><span style=\"color: #000000\">* The 85,000 referred to in the title of this post is the number of chemicals on the TSCA Inventory;
