In the third year of this historic $15 billion investment through the Bipartisan Infrastructure Law to replace harmful lead pipes across the U.S., there is an effort to shift where the money is going to better reflect states\u2019 needs. While many saw no or minimal change, others \u2013 like Texas, and Minnesota \u2013 saw major changes to their funding allotments.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h2 aria-level=\"2\"><span data-contrast=\"auto\">Why It Matters<\/span><span data-ccp-props=\"{&quot;134245418&quot;:true,&quot;134245529&quot;:true,&quot;335559738&quot;:40}\">\u00a0<\/span><\/h2>\n<p><span data-contrast=\"auto\">An estimated 9 million homes and businesses in the U.S. still receive their drinking water through harmful lead pipes. To make the best use of the federal funds aimed at protecting public health, it is critical that the money flows to the states with the greatest need, based on their estimated number of lead service lines without delay.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">EPA\u2019s <\/span><a href=\"https:\/\/www.epa.gov\/dwsrf\/epas-7th-drinking-water-infrastructure-needs-survey-and-assessment\"><span data-contrast=\"none\">7<\/span><span data-contrast=\"none\">th<\/span><span data-contrast=\"none\"> Drinking Water Infrastructure Needs Survey and Assessment<\/span><\/a><span data-contrast=\"auto\"> (DWINSA), which is the best current estimate of lead service lines across the nation, is the driver for FY23 and FY24 funding allotments. To best reflect the latest information, EPA allowed states and water utilities to submit a \u201cone-time update\u201d to service line information in the fall 2023, thus taking advantage of utilities\u2019 ongoing efforts to inventory their service lines. The goal, which was partially achieved, was to more accurately allocate the funding based on need.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h2 aria-level=\"2\"><span data-contrast=\"auto\">What Changed<\/span><span data-ccp-props=\"{&quot;134245418&quot;:true,&quot;134245529&quot;:true,&quot;335559738&quot;:40}\">\u00a0<\/span><\/h2>\n<p><span data-contrast=\"auto\">EPA <\/span><a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2024-05\/fact-sheet_one-time-update_2024.04.30_508_compliant_1.pdf\"><span data-contrast=\"none\">reported<\/span><\/a><span data-contrast=\"auto\"> that 67% of water systems provided a response to the DWINSA update. While we do not know the magnitude of the changes to the state-level lead service line projections as EPA has not yet made this information public <a href=\"#UniqueName\">*<\/a>, we do know how it has impacted the funding allotments.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">This year, Illinois received the most funding ($241 million), followed by Florida ($229 million), and Ohio ($184 million). EPA\u2019s fall 2023 one-time update to the DWINSA seems to have corrected two of the three issues we highlighted:<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<ul>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"1\" data-list-defn-props=\"{&quot;335552541&quot;:1,&quot;335559685&quot;:720,&quot;335559991&quot;:360,&quot;469769226&quot;:&quot;Symbol&quot;,&quot;469769242&quot;:[8226],&quot;469777803&quot;:&quot;left&quot;,&quot;469777804&quot;:&quot;\uf0b7&quot;,&quot;469777815&quot;:&quot;hybridMultilevel&quot;}\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><span data-contrast=\"auto\">Texas: Due to an apparent major data entry error in the original survey that inflated the state&#8217;s number of lead service lines, Texas received $146 million, the fifth largest allotment, in 2023. This year, the allotment decreased by 80% to $28.7 million. New York City, <\/span><a href=\"https:\/\/www.edf.org\/top-10-cities-most-lead-pipes?tab=newyorkcity\"><span data-contrast=\"auto\">home <\/span><span data-contrast=\"none\">to over 100,000 lead service lines,<\/span><\/a><span data-contrast=\"auto\"> did not participate in the original DWINSA, which we suspect dampened the state\u2019s FY23 allotment by drastically underestimating the state\u2019s total lead service lines. New York City\u2019s lead service line estimate is reflected in the fall 2023 one-time update. We continue to question whether the state\u2019s allotment matches the true need and are eager to understand how Florida has retained such a large share of the funding without clear evidence of the presence of lead service lines in the state. Large utilities, such as <\/span><a href=\"https:\/\/www.jea.com\/About\/Media_Relations\/2024_04_23_JEA_Launches_Project_to_Expand_Existing_Lead_Pipe_Safeguards\/\"><span data-contrast=\"none\">JEA<\/span><\/a><span data-contrast=\"auto\"> (serving Jacksonville), are just beginning to inventory their lead service lines for the October 2024 Lead and Copper Rule deadline. We\u2019ll keep an eye on the state\u2019s <\/span><a href=\"https:\/\/floridadep.gov\/wra\/srf\/content\/state-revolving-fund-resources-and-documents\"><span data-contrast=\"none\">Project Priority List<\/span><\/a><span data-contrast=\"auto\"> to see how the money is being used.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li>\n<\/ul>\n<h2 aria-level=\"2\"><span data-contrast=\"auto\">Next Steps<\/span><span data-ccp-props=\"{&quot;134245418&quot;:true,&quot;134245529&quot;:true,&quot;335559738&quot;:40}\">\u00a0<\/span><\/h2>\n<p><span data-contrast=\"auto\">When EPA released the initial DWINSA results in April 2023, we <\/span><a href=\"https:\/\/blogs.edf.org\/health\/2023\/04\/21\/epa-changes-who-gets-the-biggest-share-of-the-funding-pie-for-lead-pipe-replacement\/\"><span data-contrast=\"none\">described<\/span><\/a><span data-contrast=\"auto\"> how the new formula would positively impact funding allotments for lead service line replacement needs by state. It is now critical that EPA make the formula available for replication, as <\/span><a href=\"https:\/\/www.cifanet.org\/_files\/ugd\/ce9ad4_64dbac6f7c0845afaad9ef9ba7128ae5.pdf\"><span data-contrast=\"none\">requested<\/span><\/a><span data-contrast=\"auto\"> by State Revolving Fund administrators. This step would enable state policymakers and the public to better understand how funding decisions are made. EPA should also promptly release the state-level LSL projections from the one-time update, which drove the recent changes in funding amounts.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">EDF will continue to monitor how these resources are allocated to ensure these hard-fought funds go towards ensuring everyone has access to safer drinking water.
