It predates the recent reorganization efforts at FDA.<\/em><\/p>\n<h3>What Happened?<\/h3>\n<p>FDA <a href=\"https:\/\/www.regulations.gov\/document\/FDA-2017-D-0085-0042\">estimates<\/a> that, each year, food companies designate 82 new food chemicals as \u201cGRAS\u201d (Generally Recognized as Safe) for use in food. On average, FDA reviews only 64 of those new chemicals for safety. For the remaining 18 chemicals in FDA\u2019s estimate, the companies making and marketing them for use in food or in the food-production process choose not to seek a voluntary review by FDA.<\/p>\n<p>In <a href=\"https:\/\/www.regulations.gov\/comment\/FDA-2017-D-0085-0043\">comments<\/a> to the agency, we said we think FDA\u2019s estimate may be too low \u2013 and the number of new chemicals added to food that bypass FDA review may be as high as 130 new food chemicals a year (significantly higher than 18). This is based on searches of company marketing claims. In an 8-week period, we identified 10 chemicals claimed as GRAS without a submitted notice to FDA seeking voluntary review. (Please see our <a href=\"https:\/\/www.regulations.gov\/comment\/FDA-2017-D-0085-0043\">comments<\/a> for a full explanation of our estimate.)<!--more--><\/p>\n<h3><strong>Why It Matters<\/strong><\/h3>\n<p>FDA\u2019s review of GRAS safety determinations is critical to ensure food chemicals are safe. When agency scientists receive GRAS notices, they closely review them and ask notifiers tough questions about the safety of the chemical alone\u2014and the potential consequences when that chemical is combined with other chemicals on the market.<\/p>\n<p>But FDA allows companies to withdraw their notices \u2013 which they do in about 17% of cases. Sometimes companies fix the problems and resubmit the notice. FDA does not <em>require<\/em> companies to do this, however. Too many simply continue to market the chemical for food uses as GRAS without seeking further FDA review.<\/p>\n<p>This is in addition to the GRAS safety determinations companies choose never to file, which leads to chemicals entering our food system without any FDA notice or review at all.<\/p>\n<h3><strong>Our Take<\/strong><\/h3>\n<p>While the GRAS system is clearly broken (something we\u2019ve <a href=\"https:\/\/blogs.edf.org\/health\/?s=Broken+GRAS&amp;searchsubmit=Search\">blogged about at length<\/a> and the <a href=\"https:\/\/www.washingtonpost.com\/national\/food-additives-on-the-rise-as-fda-scrutiny-wanes\/2014\/08\/17\/828e9bf8-1cb2-11e4-ab7b-696c295ddfd1_story.html?hpid=z4\"><em>Washington Post<\/em><\/a> covered in-depth back in 2014), FDA does retain the ability and the duty to monitor the marketplace to ensure unsafe chemicals that food companies claim as GRAS are kept off the market.<\/p>\n<p>Unfortunately, the agency appears to lack any system to ensure that monitoring takes place. The only examples of agency action to pull industry-certified GRAS products off the market have been <a href=\"https:\/\/www.fda.gov\/food\/food-additives-petitions\/caffeinated-alcoholic-beverages\">caffeinated alcoholic beverages<\/a> and <a href=\"https:\/\/www.fda.gov\/food\/food-additives-petitions\/final-determination-regarding-partially-hydrogenated-oils-removing-trans-fat\">partially hydrogenated oils<\/a> (aka artificial <em>trans <\/em>fat). Both were prompted, in part, by state and media calls for action.<\/p>\n<p>Examples of inaction, however, are numerous and include: <a href=\"https:\/\/blogs.edf.org\/health\/2022\/08\/10\/tara-flour-a-reminder-of-the-real-life-consequences-of-broken-gras\/\">tara flour<\/a>, <a href=\"https:\/\/blogs.edf.org\/health\/2022\/03\/25\/broken-gras-a-scary-maze-of-questions-a-corn-oil-producer-couldnt-answer\/\">COZ corn oil<\/a>, <a href=\"https:\/\/blogs.edf.org\/health\/2022\/01\/05\/broken-gras-its-time-for-fda-to-wake-up-and-protect-consumers-from-dubious-ingredients\/\"><em>Apocynun ve<\/em>ntron<\/a>, <a href=\"https:\/\/blogs.edf.org\/health\/2021\/12\/21\/broken-gras-scientists-safety-concerns-are-hampered-by-fdas-inactions-on-food-chemicals\/\">gamma aminobutyric acid (GABA)<\/a>, <a href=\"https:\/\/blogs.edf.org\/health\/2021\/09\/27\/broken-gras-undermining-the-safety-of-dietary-supplements-and-food\/\">aquaequorin\/Prevagen<\/a>, and <a href=\"https:\/\/www.nrdc.org\/resources\/generally-recognized-secret-chemicals-added-food-united-states\">many more<\/a>.<\/p>\n<p>One of the key breakdowns that contributes to FDA\u2019s failure to monitor is the lack of coordination between the regulatory programs in the Center for Food Safety and Applied Nutrition (CFSAN) and the inspection\/enforcement programs in the Office of Regulatory Affairs (ORA).<\/p>\n<h3><strong>Next Steps<\/strong><\/h3>\n<p>In January 2023, FDA Commissioner <a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-proposes-redesign-human-foods-program-enhance-coordinated-prevention-and-response-activities\">Califf announced<\/a> a proposal to reorganize the food safety program in response to stakeholder calls for action after <a href=\"https:\/\/www.npr.org\/2022\/05\/19\/1099748064\/baby-infant-formula-shortages\">the infant formula debacle<\/a> and to a recent review of the agency by the <a href=\"https:\/\/reaganudall.org\/operational-evaluation-fdas-human-foods-programs\">Reagan-Udall Foundation<\/a>. This review noted that one key step is to appoint a new Deputy Commissioner for Human Food. This person would have greater responsibility to coordinate efforts between CFSAN and ORA. The Commissioner\u2019s proposal has been strongly criticized since there would be no clear line of authority between the new Deputy Commissioner and ORA.<\/p>\n<p>But Commissioner Califf <strong><em>has<\/em><\/strong> stated that chemical safety is a priority, telling a reporter that \u201cI want to throw in chemical safety as another really, really important area for the future \u2013 for humankind, really \u2013 and where science is evolving rapidly.\u201d<sup><a name=\"_ftnref1\"><\/a><a href=\"#_ftn1\" name=\"_ftnref1\">1<\/a><\/sup><\/p>\n<p>Fixing GRAS is an important step to rebuild consumer confidence and reduce the ongoing risk to public health. Until the broken GRAS system is fixed, FDA will continue to be hamstrung in preventing health risks posed by chemicals of unknown safety.
