<a href=\"http:\/\/yosemite.epa.gov\/opa\/admpress.nsf\/1e5ab1124055f3b28525781f0042ed40\/4a92c2cc38832e0b8525783700664650!OpenDocument\">a proposed 13% decrease<\/a>.\u00a0 <span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation=\"aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation-uid=\"415910824\">But one bright spot was a proposed $16.1 million boost in funding for EPA\u2019s chemicals management efforts using its current limited authorities under the Toxic Substances Control Act (<span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation=\"aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation-uid=\"965359236\">TSCA<\/span>).<\/span><\/p>\n<p><span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-passiveVoice\" data-mce-annotation=\"aioseo-tru-seo-highlighter-passiveVoice\" data-mce-annotation-uid=\"906227822\"><span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation=\"aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation-uid=\"993341085\">That additional funding, according to EPA, is to be directed at activities to further \u201creduce chemical risks, increase the pace of chemical hazard assessments, and provide the public with greater access to chemical information so they can make better informed decisions about their health.<\/span><\/span> \u00a0Learning more about these chemicals will help protect Americans from potential threats to their health.\u201d<\/p>\n<p><span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation=\"aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation-uid=\"146365809\">What is perhaps most refreshing is EPA\u2019s rationale for its proposal to maintain and enhance its renewed focus on chemical safety (see pages 55-56 of <a href=\"http:\/\/www.epa.gov\/planandbudget\/annualplan\/FY_2012_Budget_In_Brief.pdf\">this EPA budget summary<\/a>):<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-passiveVoice\" data-mce-annotation=\"aioseo-tru-seo-highlighter-passiveVoice\" data-mce-annotation-uid=\"885894089\">Chemicals are often released into the environment as a result of their manufacture, processing, use, and disposal.<\/span> <span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-passiveVoice\" data-mce-annotation=\"aioseo-tru-seo-highlighter-passiveVoice\" data-mce-annotation-uid=\"580430117\">Research shows that children are getting steady infusions of industrial chemicals before they even are given solid food.<\/span> <span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-passiveVoice\" data-mce-annotation=\"aioseo-tru-seo-highlighter-passiveVoice\" data-mce-annotation-uid=\"447341824\"><span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation=\"aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation-uid=\"653838870\">Other vulnerable groups, including low-income, minority, and indigenous populations, may also be disproportionately impacted by and thus particularly at risk from chemical exposure.<\/span><\/span><\/p>\n<p>So, what would the money go to, and how will the chemical industry respond?\u00a0 <!--more--><\/p>\n<p><span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation=\"aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation-uid=\"21027533\">As <a href=\"http:\/\/www.eenews.net\/Greenwire\/2011\/02\/15\/10\">Jeremy Jacobs of <span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation=\"aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation-uid=\"462848475\">Greenwire<\/span> reports<\/a> (subscription required) based on information provided by EPA\u2019s press office, the additional funding will go to several activities within the <a href=\"http:\/\/www.epa.gov\/oppt\/existingchemicals\/\">Office of Pollution Prevention and <span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation=\"aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation-uid=\"658275852\">Toxics<\/span><\/a>:<\/span><\/p>\n<ul>\n<li><span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation=\"aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation-uid=\"589625047\">pursuing specific risk management actions on chemicals identified as posing significant human health or environmental risks (presumably mainly under EPA\u2019s <a href=\"http:\/\/www.epa.gov\/oppt\/existingchemicals\/pubs\/ecactionpln.html\">Chemical Action Plans<\/a>);<\/span><\/li>\n<li>developing on the order of 15 detailed chemical risk assessments on priority chemicals; and<\/li>\n<li>increasing EPA\u2019s pace in obtaining and making public <span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation=\"aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation-uid=\"983431055\">TSCA<\/span> chemical health and safety and other information.<\/li>\n<\/ul>\n<p><span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-passiveVoice\" data-mce-annotation=\"aioseo-tru-seo-highlighter-passiveVoice\" data-mce-annotation-uid=\"22421465\"><span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation=\"aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation-uid=\"392533832\">The last of these presumably includes EPA\u2019s effort to enhance chemical data reporting scheduled to take place later this year under EPA\u2019s Inventory Update Rule (<span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation=\"aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation-uid=\"746041520\">IUR<\/span>); the <a href=\"http:\/\/www.reginfo.gov\/public\/do\/eAgendaViewRule?pubId=201010&amp;RIN=2070-AJ43\">draft final rule for <span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation=\"aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation-uid=\"908931535\">IUR<\/span> enhancements<\/a> was <a href=\"http:\/\/www.reginfo.gov\/public\/do\/eoDetails?rrid=119847\">sent to OMB\u2019s Office of Information and Regulatory Affairs (<span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation=\"aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation-uid=\"990441296\">OIRA<\/span>) on January 20<\/a>.<\/span><\/span><\/p>\n<p><span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation=\"aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation-uid=\"957596672\">It also includes extending the series of steps EPA has already taken to rein in excessive claims by the chemical industry that seek to block public access to information it submits by designating it as <a href=\"https:\/\/blogs.edf.org\/nanotechnology\/category\/confidential-business-information-cbi\/\">confidential business information<\/a>.<\/span>\u00a0 <span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-passiveVoice\" data-mce-annotation=\"aioseo-tru-seo-highlighter-passiveVoice\" data-mce-annotation-uid=\"732314845\">The first fruit of EPA\u2019s efforts was <a href=\"https:\/\/blogs.edf.org\/nanotechnology\/2011\/02\/10\/epa%e2%80%99s-tsca-cbi-policy-change-yields-first-increment-in-restoring-public%e2%80%99s-chemical-right-to-know\/\">announced last week<\/a>.<\/span><\/p>\n<p><span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-passiveVoice\" data-mce-annotation=\"aioseo-tru-seo-highlighter-passiveVoice\" data-mce-annotation-uid=\"372159169\"><span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation=\"aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation-uid=\"548618147\">EPA\u2019s press office indicates the budget increase would support <a href=\"https:\/\/blogs.edf.org\/nanotechnology\/2010\/05\/28\/a-thing-of-beauty-epa-restores-a-good-chunk-of-the-public%e2%80%99s-right-to-know-under-tsca\/\">EPA\u2019s intention to review all current and 1,100 prior health and safety studies<\/a> in which the identities of the chemicals in question have been masked due to <span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation=\"aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation-uid=\"39954549\">CBI<\/span> claims made by the companies that submitted the studies.<\/span><\/span><\/p>\n<p><strong>How will the chemical industry respond?<\/strong><\/p>\n<p><span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation=\"aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation-uid=\"4227228\">I\u2019ve made the point in <a href=\"https:\/\/blogs.edf.org\/nanotechnology\/2010\/12\/09\/a-bright-spot-in-industry-ngo-dialogue-on-tsca\/\">past blog posts<\/a> that how the chemical industry reacts to these modest efforts by EPA to exercise its limited <span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation=\"aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation-uid=\"543532022\">TSCA<\/span> authority provides a useful lens through which to view its commitment to genuine reform.<\/span>\u00a0 <span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation=\"aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation-uid=\"4816781\">After all, the American Chemistry Council\u2019s (<span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation=\"aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation-uid=\"564657607\">ACC<\/span>) much-touted <a href=\"http:\/\/www.americanchemistry.com\/s_acc\/sec_article_acc.asp?CID=2178&amp;DID=9939\">principles for modernizing <span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation=\"aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation-uid=\"59180051\">TSCA<\/span><\/a> also call for EPA to have ample authority to get the data it needs to determine chemical safety, for the industry to bear the responsibility of providing the data it possesses or can generate, and for EPA to be able to act to control chemicals found to be dangerous.<\/span><\/p>\n<p><span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation=\"aioseo-tru-seo-highlighter-textSentenceLength\" data-mce-annotation-uid=\"302348826\">So here\u2019s a hopeful proposition:\u00a0 I\u2019d like to see <span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation=\"aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation-uid=\"502237535\">ACC<\/span> and its member companies come out and promptly, publicly and forcefully work to support, promote and defend this modest proposed increase in EPA\u2019s budget that can help to protect public health while also to helping to restore at least a modicum of public and market confidence in the ability of our government to effectively address chemical safety.<\/span><\/p>\n<p>How about, it <span class=\"mce-annotation annotation-text annotation-text-aioseo-tru-seo-highlighter-spellingChecker\" data-mce-annotation=\"aioseo-tru-seo-highlighter-spellingChecker\"
