In order to secure funding, these states developed and submitted Intended Use Plans (IUPs), which included LSL replacement projects that met EPA\u2019s requirements.<\/p>\n<p><strong>Why It Matters:<\/strong> These 25 programs can now begin distributing their share of the first of five years of funding from the $15 billion Congress included in the 2021 Infrastructure Investment and Jobs Act (<a href=\"https:\/\/www.epa.gov\/infrastructure\/fact-sheet-epa-bipartisan-infrastructure-law\" target=\"_blank\" rel=\"noopener\">IIJA<\/a>) specifically for full LSL replacement projects. The remaining states are working to get their IUPs submitted to EPA.<\/p>\n<p><a href=\"https:\/\/blogs.edf.org\/health\/wp-content\/blogs.dir\/11\/files\/2022\/11\/map-of-statesv2.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-large wp-image-11367\" src=\"https:\/\/blogs.edf.org\/health\/wp-content\/blogs.dir\/11\/files\/2022\/11\/map-of-statesv2-1024x558.png\" alt=\"\" width=\"540\" height=\"294\" srcset=\"https:\/\/blogs.edf.org\/health\/wp-content\/blogs.dir\/11\/files\/2022\/11\/map-of-statesv2-1024x558.png 1024w, https:\/\/blogs.edf.org\/health\/wp-content\/blogs.dir\/11\/files\/2022\/11\/map-of-statesv2-300x163.png 300w, https:\/\/blogs.edf.org\/health\/wp-content\/blogs.dir\/11\/files\/2022\/11\/map-of-statesv2-768x418.png 768w, https:\/\/blogs.edf.org\/health\/wp-content\/blogs.dir\/11\/files\/2022\/11\/map-of-statesv2-1536x837.png 1536w, https:\/\/blogs.edf.org\/health\/wp-content\/blogs.dir\/11\/files\/2022\/11\/map-of-statesv2-2048x1115.png 2048w\" sizes=\"auto, (max-width: 540px) 100vw, 540px\" \/><\/a><\/p>\n<p><!--more--><\/p>\n<p><strong>What are IUPs? <\/strong>EPA uses IUPs to ensure that states spend drinking water SRF funds consistent with the <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2010-title42\/html\/USCODE-2010-title42-chap6A-subchapXII-partE-sec300j-12.htm\" target=\"_blank\" rel=\"noopener\">Safe Drinking Water Act<\/a> and the <a href=\"https:\/\/www.ecfr.gov\/current\/title-40\/chapter-I\/subchapter-B\/part-35\/subpart-L\/section-35.3555\" target=\"_blank\" rel=\"noopener\">agency\u2019s regulations<\/a>. The IUP includes a priority list of projects and a definition of the characteristics of a \u201cdisadvantaged community\u201d that may be entitled to a grant, rather than a subsidized loan.<\/p>\n<p>The plans must be revised annually. Each state\u2019s public process must \u201cseek meaningful public review and comment during the development of the IUP,\u201d<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> describe the public review process, and respond to major comments and concerns.<\/p>\n<p><strong>Our Takeaway:<\/strong> We applaud these programs for completing their IUP revisions, as well as EPA for reviewing and approving IUPs in a timely manner\u2014thus ensuring that the associated capitalization grants are administered consistent with the law and the agency\u2019s <a href=\"https:\/\/www.epa.gov\/dwsrf\/bipartisan-infrastructure-law-srf-memorandum\" target=\"_blank\" rel=\"noopener\">March 2022 guidance<\/a>. This year was particularly complicated as states adapted to the huge increase in funds from IIJA that were dedicated to specific purposes (such as LSL replacement).<\/p>\n<p><strong>Next Steps:<\/strong> The 25 programs that have received grants must now fund their priority projects to replace LSLs.
