Across the U.S., <\/span><a href=\"https:\/\/www.nrdc.org\/resources\/how-states-stack-flood-disclosure\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">32 states<\/span><\/a><span data-contrast=\"auto\"> have enacted flood disclosure laws, requiring a seller to share a property\u2019s flood risks or past flood damages during real estate transactions. Florida residents deserve transparency through flood disclosure, and realtors would benefit by keeping up with this growing industry standard.\u00a0\u00a0<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Knowing one\u2019s risk is essential in ensuring effective preparedness and response. The Federal Emergency Management Agency estimates just one inch of flooding in a typical 2,500 sq. ft., one-story home can cause more than <\/span><a href=\"https:\/\/www.floodsmart.gov\/cost-flooding\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">$25,000 in damages<\/span><span data-contrast=\"auto\">.<\/span><\/a><span data-contrast=\"auto\"> It is widely misunderstood by <\/span><a href=\"https:\/\/www.forbes.com\/advisor\/homeowners-insurance\/survey-homeowners-insurance-knowlege\/\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">more than one-third of homeowners<\/span><\/a><span data-contrast=\"auto\"> that flood damage is typically not included in standard homeowners or rental insurance policies.<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true,&quot;469777462&quot;:[720],&quot;469777927&quot;:[0],&quot;469777928&quot;:[8]}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Legislators and realtors are stepping up to address this gap in Florida\u2019s flood policies. In the 2024 Florida Legislative Session, there has been bipartisan support for a new policy on flood disclosure. Meeting consumer expectations and building trust<\/span><\/b><\/p>\n<p><span data-contrast=\"auto\">Homebuyers often lack awareness about flood hazards but still have a strong desire to be informed about different aspects of a property during the home-buying process. A <\/span><a href=\"https:\/\/www.fanniemae.com\/media\/49491\/display\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">2023 Fannie Mae study<\/span><\/a><span data-contrast=\"auto\"> found that 94% of Florida respondents stated that knowing about previous flood events and damages is \u201ccritical\u201d or \u201cimportant\u201d when choosing a new home.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Trust is the bedrock of a realtor-client relationship.\u00a0 Clear and concise information about the potential risks associated with a property helps realtors showcase that they are looking out for their clients and have the potential to increase referrals or repeat clients.\u00a0\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><b><span data-contrast=\"auto\">2. Lowering of National Flood Insurance Program premiums<\/span><\/b><\/p>\n<p><span data-contrast=\"auto\">Lower National Flood Insurance premiums can positively impact home affordability and increase sales. Incentives through the <\/span><a href=\"https:\/\/www.fema.gov\/fact-sheet\/community-rating-system-overview-and-participation\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">Community Rating System<\/span><\/a><span data-contrast=\"auto\"> provide a financial advantage for communities participating in flood risk reduction measures, including mandatory flood disclosure. In response to Miami-Dade County\u2019s efforts to reduce flood risk, the National Flood Insurance Program in January 2024 upgraded the community rating of Miami-Dade County, thereby providing residents with a <\/span><a href=\"https:\/\/www.miamidade.gov\/global\/release.page?Mduid_release=rel1705031633248626#:~:text=Homeowners%20and%20businessowners%20in%20the,or%20after%20April%201%2C%202024.\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">35% discount on flood insurance premiums.<\/span><\/a><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:259,&quot;469777462&quot;:[720],&quot;469777927&quot;:[0],&quot;469777928&quot;:[8]}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">FEMA\u2019s <\/span><a href=\"https:\/\/www.fema.gov\/flood-insurance\/risk-rating\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">new risk-based rates<\/span><\/a><span data-contrast=\"auto\"> for the National Flood Insurance Program (NFIP) are expected to increase premiums for Florida policyholders by an average of over <\/span><a href=\"https:\/\/report.firststreet.org\/9th-National-Risk-Assessment-The-Insurance-Issue.pdf\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">230%<\/span><\/a><span data-contrast=\"auto\">. For most policyholders, NFIP premiums will increase <\/span><a href=\"https:\/\/www.fema.gov\/flood-insurance\/work-with-nfip\/risk-rating\/single-family-home#:~:text=This%20increase%20is%20called%20a,to%20premium%20increases%20every%20year.\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">18% per year<\/span><\/a> <span data-contrast=\"none\">until premium costs reach the full new flood insurance rate. For instance, yearly NFIP premiums for Collier County homeowners are expected to rise <\/span><a href=\"https:\/\/report.firststreet.org\/9th-National-Risk-Assessment-The-Insurance-Issue.pdf\"><span data-contrast=\"none\">278%, from $1,053 to $3,536<\/span><\/a><span data-contrast=\"none\">. <\/span><span data-contrast=\"auto\">Discounts on flood insurance may offer a financial nudge that encourages buyers to purchase a home or continue living in Florida.\u00a0<\/span><span data-ccp-props=\"{&quot;469777462&quot;:[720],&quot;469777927&quot;:[0],&quot;469777928&quot;:[8]}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{}\">\u00a0<\/span><b><span data-contrast=\"auto\">3. Keeping pace with industry and national standards<\/span><\/b><\/p>\n<p><span data-contrast=\"auto\">Flood disclosure is gradually becoming standard practice in Florida and across the nation. For example, <\/span><a href=\"https:\/\/www.realtor.com\/flood-risk\/\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">Realtor.com<\/span><\/a><span data-contrast=\"auto\"> offers a flood risk information tool that allows potential buyers to see the flood risk rating of any property listed on the website. Florida is projected to continue welcoming over <\/span><a href=\"https:\/\/www.cbsnews.com\/miami\/news\/expert-its-the-highest-number-its-ever-been-as-florida-population-growth-continues\/#:~:text=%22In%20fact%2C%20our%20estimates%20suggest,every%20year%2C%22%20Passidomo%20wrote.\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">800 new residents daily through 2028<\/span><\/a><span data-contrast=\"auto\"> who may bring with them expectations of disclosure they had in another state.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Likewise, some realtors and local governments within Florida have taken action to ensure residents are aware of a property\u2019s flood risk by creating voluntary forms of flood disclosure such as the <\/span><a href=\"https:\/\/pinellas.gov\/real-estate-flood-disclosure-program\/\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">Pinellas County Real Estate Flood Disclosure Program.<\/span><\/a><span data-contrast=\"auto\"> Aligning with evolving norms enhances the credibility of the Florida real estate market, fostering trust among consumers and reinforcing the professionalism of real estate practitioners.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{}\">\u00a0<\/span><b><span data-contrast=\"auto\">4. Providing legal clarity<\/span><\/b><\/p>\n<p><span data-contrast=\"auto\">Florida home sellers are already required to disclose property-related conditions like radon or lead paint,<\/span> <span data-contrast=\"auto\">but<\/span> <span data-contrast=\"auto\">the law is <\/span><a href=\"https:\/\/www.floridabar.org\/the-florida-bar-journal\/there-will-be-floods-armoring-the-people-of-florida-to-make-informed-decisions-on-flood-risk\/#u6d87(https:\/\/www.census.gov\/library\/stories\/2023\/06\/state-to-state-\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">unclear on when or how flood risks<\/span><\/a><span data-contrast=\"auto\"> should be disclosed. This opens the potential for future and costly litigation. For example, in <\/span><a href=\"http:\/\/chrome-extension\/\/efaidnbmnnnibpcajpcglclefindmkaj\/https:\/supremecourt.flcourts.gov\/content\/download\/341810\/file\/00-1582_ans.pdf\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">Newbern v. Mansbach (2001)<\/span><\/a><span data-contrast=\"auto\">, buyers sued a seller who did not disclose that the property fell within the Coastal Barrier Resource Area (CBRA), making the house ineligible for flood insurance. The trial court dismissed the case, citing the public availability of CBRA information, but the appellate court overturned this decision, ruling in favor of the purchasers.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">When flood risks are mandated to be disclosed upfront, it reduces the likelihood of legal issues arising between realtors, buyers, and sellers.\u00a0\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{}\"><strong>\u00a05.<\/strong> <\/span><b><span data-contrast=\"auto\">Building community resilience<\/span><\/b><\/p>\n<p><span data-contrast=\"auto\">As global weather patterns change, realtors can play a powerful role in building community resilience by educating buyers about flood risks and encouraging the adoption of resilient practices.\u00a0<\/span><span data-ccp-props=\"{&quot;469777462&quot;:[720],&quot;469777927&quot;:[0],&quot;469777928&quot;:[8]}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Flood disclosure contributes to the overall awareness of flood-prone areas, fostering a community-wide understanding of the importance of preparedness and support for risk mitigation in the face of evolving challenges.
