{"id":5641,"date":"2014-01-03T20:09:54","date_gmt":"2014-01-03T20:09:54","guid":{"rendered":"http:\/\/blogs.edf.org\/energyexchange\/?p=5641"},"modified":"2026-03-16T15:20:29","modified_gmt":"2026-03-16T19:20:29","slug":"renewable-energy-to-thrive-in-2014-despite-alecs-aggressive-tactics","status":"publish","type":"post","link":"https:\/\/blogs.edf.org\/energyexchange\/2014\/01\/03\/renewable-energy-to-thrive-in-2014-despite-alecs-aggressive-tactics\/","title":{"rendered":"Renewable Energy to Thrive in 2014, Despite ALEC\u2019s Aggressive Tactics"},"content":{"rendered":"<p><a href=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2013\/03\/Marita-Mirzatuny1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft  wp-image-3783\" src=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2013\/03\/Marita-Mirzatuny1-199x300.jpg\" alt=\"Marita Mirzatuny\" width=\"139\" height=\"210\" \/><\/a>Now that 2013 is behind us, it\u2019s important to reflect on the progress of renewable energy last year and identify obstacles that may arise in 2014.<\/p>\n<p>Over the last year, we <a href=\"http:\/\/www.edf.org\/blog\/2013\/04\/26\/oil-and-gas-industry%E2%80%99s-assault-renewable-energy\">kept a close eye<\/a> on <a href=\"http:\/\/www.edf.org\/blog\/2013\/07\/26\/standing-lobbyists-who-want-derail-clean-energy\">multiple clean energy attacks<\/a> around the country, specifically on the Renewable Portfolio Standards (RPS) in the various states. \u00a0As we have <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2013\/03\/20\/alec-updates-action-alert-state-by-state-renewable-energy-attacks-are-underway-2\/\">highlighted<\/a> before, the \u201cman behind the curtain\u201d in these attacks is none other than the infamous American Legislative Exchange Council (ALEC), a front group and model bill factory for many corporate interests including oil, gas and coal.<\/p>\n<p>The good news is that from Ohio to Kansas, EDF and other organizations have been successful in preventing ALEC\u2019s aggressive tactics to hamper clean energy. \u00a0To date, ALEC has failed to repeal clean energy standards in any state, despite its \u201c<a href=\"http:\/\/www.alec.org\/model-legislation\/electricity-freedom-act\/\">Electricity Freedom Act<\/a>\u201d propaganda and <a href=\"http:\/\/www.bloomberg.com\/news\/2013-04-23\/u-s-states-turn-against-renewable-energy-as-gas-plunges.html\">promise that 2013 would be<\/a> &#8220;the most active year ever&#8221; for efforts to repeal renewable energy mandates. \u00a0Active? \u00a0Yes. \u00a0Effective? \u00a0No. \u00a0<!--more--><\/p>\n<p><b>A Critical Standoff in Ohio<br \/>\n<\/b><\/p>\n<p>One of the priority targets in ALEC\u2019s 2013 agenda was to repeal <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2013\/11\/21\/edf-steps-up-to-protect-ohios-clean-energy-standards\/#more-5442\">Ohio\u2019s clean energy standards<\/a> adopted in 2008. The group came close to defeating the state\u2019s widely-supported RPS standards with the introduction of Senate Bill 58, but was ultimately unsuccessful by the year\u2019s end. \u00a0This bill\u2019s litany of bad policy includes eliminating renewable power requirements for utilities and capping energy efficiency spending.<\/p>\n<p>Fortunately, EDF\u2019s own <a href=\"https:\/\/www.edf.org\/people\/cheryl-roberto\">Cheryl Roberto<\/a>, former Ohio PUC Commissioner and EDF\u2019s Associate Vice President of Clean Energy, testified against this bill and it was subsequently stalled in committee as the year drew to a close. However, it is expected to be up for a vote again sometime in January.<\/p>\n<p>It\u2019s hard to understand why ALEC would target their efforts against renewables in a state where <a href=\"http:\/\/cleantechnica.com\/2013\/02\/27\/majority-of-ohio-voters-support-renewable-energy\/#LyD8zjYQJbUBXFDO.99\">80 percent of Ohio voters<\/a> support legally requiring the use of <a href=\"http:\/\/cleantechnica.com\/2013\/02\/26\/renewable-energy-adoption-not-fast-enough\/\" target=\"_blank\" rel=\"noopener\">clean energy<\/a>. \u00a0And yet the organization has decided to continue its attacks in 2014, this time <a href=\"http:\/\/www.theguardian.com\/world\/2013\/dec\/04\/alec-freerider-homeowners-assault-clean-energy\">waging a war on homeowners<\/a>.<\/p>\n<p><b>ALEC Goes After Homeowners<br \/>\n<\/b><\/p>\n<figure id=\"attachment_5642\" aria-describedby=\"caption-attachment-5642\" style=\"width: 300px\" class=\"wp-caption alignright\"><a href=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2014\/01\/Source-Eco-Watch.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-5642\" src=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2014\/01\/Source-Eco-Watch-300x179.jpg\" alt=\"Source: Eco Watch\" width=\"300\" height=\"179\" id=\"caption-attachment-5642\" class=\"wp-caption-text\">Source: Eco Watch<\/figcaption><\/figure>\n<p>ALEC is now <a href=\"http:\/\/www.theguardian.com\/world\/2013\/dec\/04\/alec-freerider-homeowners-assault-clean-energy\">labeling<\/a> residential utility customers who produce and distribute their own energy from solar as \u201cfreeriders\u201d who should be \u201cpaying to distribute the surplus electricity\u201d back to the grid. \u00a0On most utility bills, customers do not see itemized costs associated with transmission and distribution, meaning that once electricity is on the wires, utilities are blind, so to speak, as to who is providing and consuming the power.\u00a0 However, new valuation methods to address these issues are still evolving, like <a href=\"http:\/\/aceee.org\/topics\/decoupling\">decoupling<\/a> (which encourages energy conservation by disassociating utility profits from the sale of energy), <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2013\/07\/24\/net-metering-and-rooftop-solar-for-the-utility-of-the-future\/\">net metering<\/a> (which makes small-scale renewable energy, like rooftop solar, more affordable by crediting these \u201cdistributed generation\u201d owners for the excess energy they produce) and the <a href=\"https:\/\/www.greentechmedia.com\/articles\/read\/can-a-value-of-solar-tariff-replace-net-energy-metering\">valuation of solar<\/a> (which recognizes solar energy\u2019s <a href=\"http:\/\/www.greentechmedia.com\/articles\/read\/Huge-Win-For-California-Solar-CPUC-Keeps-Net-Energy-Metering-Alive\/\">multiple added benefits<\/a>). \u00a0For ALEC to pin the costs of supplying excess power solely on the solar owner at this juncture is hasty.<\/p>\n<p>Homeowners who generate their own electricity provide a service to themselves, the grid and the utility. \u00a0These homeowners are reducing the demand for, and costs associated with, the delivery of that power by creating their own and acting as a backup source for power in the event the utility needs to draw on their excess supply. \u00a0Apparently, ALEC doesn\u2019t believe that these services provide value and that homeowners who invest in solar are merely \u201cmooching\u201d off the system.<\/p>\n<p>We saw this logic play out in 2013 when <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2013\/11\/26\/the-arizona-public-service-ruling-on-solar-heres-why-its-win-win\/\">Arizona Public Service<\/a>, the state\u2019s largest utility company, requested to raise its monthly charge for rooftop solar owners by an average of $50 per month. \u00a0Solar owners were able to get a reprieve (for now) with regulators approving an average charge of roughly $5 per month.<\/p>\n<p>In Texas, State Representative Linda Harper-Brown (R-Irving) requested a Texas Attorney General\u2019s opinion to nullify <a href=\"http:\/\/hoareformcoalition.org\/2011\/05\/31\/hb-362-passed-solar-energy-devices-and-roofing-materials\/\">House Bill (HB) 362<\/a>, which passed during the 82nd legislative session. \u00a0This bill prevents Homeowners Associations (HOA), with certain exceptions, from preventing individuals from installing rooftop solar panels on their homes. \u00a0Brown feels that HOAs should have the control to stop individuals from generating their own electricity and being self-reliant.<\/p>\n<figure id=\"attachment_5643\" aria-describedby=\"caption-attachment-5643\" style=\"width: 300px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2014\/01\/Source-Think-Progress.png\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-5643\" src=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2014\/01\/Source-Think-Progress.png\" alt=\"Source: Think Progress\" width=\"300\" height=\"218\" \/><\/a><figcaption id=\"caption-attachment-5643\" class=\"wp-caption-text\">Source: Think Progress<\/figcaption><\/figure>\n<p>This is another case where ALEC and the likes of Tea Partiers Ted Cruz and Paul Ryan (who both spoke at ALEC\u2019s policy summit a few weeks ago) show their true colors by acting in the best interests of corporations, rather than their constituents. \u00a0Passing laws that go after homeowners who produce their own power is in direct contradiction of the proclaimed ideologies in ALEC\u2019s Electricity Freedom Act \u2013 but in this instance, it\u2019s conveniently ignored.<\/p>\n<p><b>Renewables Expected to Prevail in 2014<br \/>\n<\/b><\/p>\n<p>Luckily, Americans see through these schemes. \u00a0As Texas A&amp;M <a href=\"http:\/\/engineering.tamu.edu\/news\/2012\/11\/09\/texas-am-poll-shows-americans-support-renewable-energy-%E2%80%94-but-dont-want-to-pay-for-it-at-the-pump\">reports<\/a>, 59 percent of Americans support increased funding for research and development of renewable energy sources and 60 percent support tax cuts for companies to develop renewable energy technologies.\u00a0 This is good news, especially considering renewable energy accounted for <a href=\"http:\/\/thinkprogress.org\/climate\/2013\/12\/23\/3099791\/renewable-energy-capacity-november\/\">100 percent<\/a> of new power added to the U.S. grid in\u00a0November 2013.<\/p>\n<p>Despite ALEC\u2019s misguided strategy, the wind is literally at the back of those pushing the U.S. energy revolution towards a cleaner and more sustainable future \u2013 one with <a href=\"http:\/\/blogs.edf.org\/texascleanairmatters\/2013\/12\/30\/2013-texas-air-quality-year-in-review\/\">cleaner air<\/a> and more jobs, like in Texas, <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2013\/12\/30\/texas-is-a-leader-in-clean-energy-jobs-lets-keep-it-that-way\/\">the leader in clean energy jobs<\/a>.\u00a0 EDF is geared up to defend clean energy again in 2014 with the support of many Americans from both parties. \u00a0ALEC is on the wrong side of history; maybe their New Year\u2019s resolution will be to realize
