Electric loads are increasing for the first time in a generation, driven by data centers, EVs, heat pumps and industrial electrification. Utilities and regulators must handle increased loads in a way that also delivers benefits \u2013 like lower energy costs and greater use of affordable, reliable clean energy \u2013 to consumers.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Yesterday, the New York Public Service Commission issued an Order that takes an important step toward solving this problem. The Order establishes a Proactive Planning Framework that attempts to modernize how utilities plan their systems in anticipation of changing customer needs. This is a big swing \u2013 and, in some important ways, it connects.\u00a0\u00a0\u00a0<\/span><\/p>\n<span class='bctt-click-to-tweet'><span class='bctt-ctt-text'><a href='https:\/\/x.com\/intent\/tweet?url=https%3A%2F%2Fblogs.edf.org%2Fenergyexchange%2F2025%2F09%2F19%2Fnew-yorks-new-grid-planning-framework-looks-to-meet-growing-energy-demand%2F&#038;text=New%20York%E2%80%99s%20new%20grid%20planning%20framework%20looks%20to%20meet%20growing%20energy%20demand%20&#038;via=EDFEnergyEx&#038;related=EDFEnergyEx' target='_blank'rel=\"noopener noreferrer\">New York\u2019s new grid planning framework looks to meet growing energy demand  <\/a><\/span><a href='https:\/\/x.com\/intent\/tweet?url=https%3A%2F%2Fblogs.edf.org%2Fenergyexchange%2F2025%2F09%2F19%2Fnew-yorks-new-grid-planning-framework-looks-to-meet-growing-energy-demand%2F&#038;text=New%20York%E2%80%99s%20new%20grid%20planning%20framework%20looks%20to%20meet%20growing%20energy%20demand%20&#038;via=EDFEnergyEx&#038;related=EDFEnergyEx' target='_blank' class='bctt-ctt-btn'rel=\"noopener noreferrer\">Share on X<\/a><\/span>\n<p><b>Technical Directives<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On the technical side, the Order requires utilities to explain, within 60 days, how they will adopt updated planning practices. These updated practices \u2013 several of which<\/span><a href=\"https:\/\/documents.dps.ny.gov\/public\/Common\/ViewDoc.aspx?DocRefId=%7b8087ED95-0000-CF1A-800A-A88E024E069A%7d\"> <span style=\"font-weight: 400;\">EDF recommended<\/span><\/a><span style=\"font-weight: 400;\"> \u2013 include:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Develop granular bottom-up load forecasts that identify electric load \u201chot spots\u201d where demand is likely to increase the most;\u00a0\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Employ long-term forecasting to help \u201cright-size\u201d investments and minimize inefficient, incremental projects;\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Adopt a transparent, uniform set of distribution planning assumptions to the maximum extent possible; and\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Consider<\/span><a href=\"https:\/\/blogs.edf.org\/markets\/2022\/04\/25\/mass-appeal-how-can-we-make-electrification-more-affordable-and-equitable\/?_gl=1*1ijq2wi*_gcl_au*Nzg5NDIxOTU3LjE3NTgxMjc4ODc.*_ga*MjYzMzk3Mzc1LjE2NTgzNDk2NTY.*_ga_2B3856Y9QW*czE3NTgyOTc2NjIkbzIwMCRnMSR0MTc1ODI5NzY3MiRqNTAkbDAkaDA.\"> <span style=\"font-weight: 400;\">distributed energy resources\u00a0 and grid-enhancing technologies <\/span><\/a><span style=\"font-weight: 400;\"> \u2013 which can often be cheaper than traditional utility infrastructure \u2013 as part of solution identification.\u00a0\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Each of these practices will help utilities target their investments more efficiently, while simultaneously making the grid more ready to accommodate electrifying end-uses and DERs. And by directing utilities to implement these forward-thinking practices as a group, the Order should yield a welcome degree of standardization to what is often a patchwork of idiosyncratic utility protocols.\u00a0\u00a0<\/span><\/p>\n<p><b>Procedural Directives<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p>No matter how you slice it, utilities will need to build a lot of grid infrastructure to handle growing electric loads. (No, this does <u>not<\/u> mean electric rates need to go up \u2013 for example, <a href=\"https:\/\/www.eia.gov\/totalenergy\/data\/monthly\/pdf\/sec7_6.pdf\">electric loads quadrupled from 1960 to 2000<\/a>, even as <a href=\"https:\/\/www.eia.gov\/totalenergy\/data\/annual\/showtext.php?t=ptb0810\">inflation-adjusted prices fell by more than 20 percent<\/a>.) Moreover, making investments proactively <a href=\"https:\/\/www.edf.org\/media\/new-study-suggests-preparing-grid-now-electric-trucks-buses-can-save-ratepayers-money\">will often save money<\/a> for ratepayers <a href=\"https:\/\/rmi.org\/insight\/ahead-of-the-curve\/\">compared to a wait-and-see approach. <\/a>The Commission is therefore tasked with enabling utilities to make necessary investments sooner, while still ensuring transparency and effective regulatory oversight.<\/p>\n<p><span style=\"font-weight: 400;\">Here, the Order is a mixed bag. On the upside, the Order reiterates utilities\u2019 obligation to engage with communities by adopting EDF\u2019s recommendation that utilities must clearly explain how they will solicit \u2013 and incorporate \u2013 community feedback as part of project design and implementation.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On the downside, the Order largely grants the utilities\u2019 request for a new process to get expedited PSC \u201cauthorization\u201d of urgent projects that meet certain criteria. EDF argued against this process as it lacks the procedural safeguards of existing PSC mechanisms and risks creating a backdoor for utilities to skirt public participation.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">EDF instead recommended that utilities incorporate proactive planning day-to-day work, so that the Commission and stakeholders can handle resulting projects alongside all other utility funding needs as part of routine rate cases.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Fortunately, the Commission appears to agree with this as a longer-term objective. The Order observes, \u201cThe Commission\u2019s expectation is that these separate efforts will ultimately merge into a single enhanced planning process that is consistent across all utilities and handled inside rate cases\u201d \u2013 though it does not set a timeline for when this should be accomplished.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Order leaves other questions unanswered as well. It does not address whether \u201cauthorized\u201d projects are subject to review in a later rate case. (They probably aren\u2019t.) It punts on how utilities should allocate and recover \u201cauthorized\u201d project costs, opting instead to address those issues on a case-by-case basis. It also misses the opportunity to clearly state that utilities should treat compliance with state requirements, such as the CLCPA, as their planning baseline. Utilities\u2019 future project proposals, and the Commission\u2019s response to them, will shed more light on whether utilities will be allowed to \u201cplan to fail\u201d these requirements.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The unsurprising upshot is that there\u2019s more work to do. The Order takes meaningful steps forward and promises more progress to come; it\u2019s now incumbent on advocates to ensure that utilities and the Commission follow through.
