However, it\u2019s also important to recognize that the ruling in no way changed EPA\u2019s longstanding authority and duty to address climate pollution under the Clean Air Act to address climate pollution itself \u2014 including from new cars and freight trucks, industrial sources, new and existing power plants, and oil and gas development.\u00a0 And with respect to oil and gas pollution, this decision in no way impedes the agency\u2019s ongoing and important efforts to reduce oil and gas methane pollution.<\/p>\n<p>It remains critical that the EPA exercise its clear authority and obligation to move forward with protective climate standards, including its proposed rules to curb methane pollution from the oil and gas sector, which emits roughly <a href=\"https:\/\/nam11.safelinks.protection.outlook.com\/?url=http%3A%2F%2Fblogs.edf.org%2Fenergyexchange%2Ffiles%2F2021%2F05%2F2019_EDF-CH4-Estimate.pdf%3F_gl%3D1*1w9nc1f*_ga*MTcyMTA3MTQ0NS4xNTEyNzU3Nzg1*_ga_2B3856Y9QW*MTY1NjM2MjUwMS4xMTUuMC4xNjU2MzYyNTA0LjU3*_ga_WE3BPRQKW0*MTY1NjM2MjUwMS4yNTguMC4xNjU2MzYyNTA0LjU3*_ga_Q5CTTQBJD8*MTY1NjM2MjUwMS4xMTUuMC4xNjU2MzYyNTA0LjU3&amp;data=05%7C01%7Cmmcgee%40edf.org%7Cb83a20349ff74583e05b08da65cab2d7%7Cfe4574edbcfd4bf0bde843713c3f434f%7C0%7C0%7C637934218494771008%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C3000%7C%7C%7C&amp;sdata=tHbFirO9sgNsqIfCLgWBuxPHuzpQmzCmAlywLzgZTio%3D&amp;reserved=0\">16 million tons of methane annually<\/a>. Indeed, the majority opinion recognizes EPA authority to address climate pollution under section 111 and explained that the agency must regulate existing sources once it set standards for new facilities.<\/p>\n<p>While the opinion does constrict EPA\u2019s ability to use some of the most cost-effective tools available to address climate pollution from existing power plants \u2014 even as it reaffirmed EPA\u2019s authority and responsibility to limit that pollution \u2014 and concerningly give prominence to the newly invented and ambiguous \u201cmajor questions doctrine,\u201d the issues in the case that the court found problematic aren\u2019t relevant to the EPA\u2019s proposed oil and gas methane rules.<\/p>\n<p>Indeed, the technology-based and source-focused pollution safeguards EPA has proposed for the oil and gas sector are the very types of standards the Court recognized as squarely within EPA\u2019s longstanding authority under the Clean Air Act.
