A critical step that charts a path to major emission cuts.<\/p>\n<p>As methane <a href=\"https:\/\/www.edf.org\/media\/methane-takes-center-stage-cop26-world-leaders-rally-around-pledge-powerful-pollutant\">takes the spotlight<\/a> on the world stage and countries raise their ambition for cutting this potent greenhouse gas, EPA\u2019s final rules will play a central role in U.S. <a href=\"https:\/\/www.whitehouse.gov\/wp-content\/uploads\/2021\/11\/US-Methane-Emissions-Reduction-Action-Plan-1.pdf\">commitments<\/a> to reducing methane and achieving climate goals.<\/p>\n<p>The proposals to reduce oil and gas methane emissions, the largest industrial source of methane in the U.S., were met with widespread public support, not only from environmental groups, but also <a href=\"https:\/\/www.lung.org\/media\/press-releases\/epa-proposes-limits-on-methane\">health<\/a> and <a href=\"https:\/\/www.krwg.org\/post\/child-advocates-support-epa-methane-rules-call-stronger-protection#:~:text=Child%20Advocates%20Support%20EPA%20Methane%20Rules%2C%20Call%20for%20Stronger%20Protection,-By%20new%20mexico&amp;text=%E2%80%9CWe%20need%20strong%20rules%20that,the%20air%20pollution%20it%20causes.\">child advocates<\/a>, <a href=\"https:\/\/www.westernleaders.org\/blog\/epa-rule-media-statement\">tribal officials<\/a> and <a href=\"https:\/\/www.iccr.org\/investors-welcome-new-epa-rules-designed-significantly-reduce-methane-emissions\">investors<\/a> concerned about climate risk.<\/p>\n<p>To comprehensively protect our communities and climate, EPA must further strengthen its proposal \u2014 as it has stated it plans to do in a supplemental proposal issued next spring \u2014 by requiring monitoring across smaller, leak-prone wells and eliminating the wasteful and polluting practice of routine flaring.<\/p>\n<p><!--more--><\/p>\n<p><strong>Four key aspects of the proposal<\/strong><\/p>\n<p>EPA has proposed a suite of standards that build from state approaches and leverage new technological developments.<\/p>\n<p>The standards will cover both new and older facilities, requiring frequent monitoring for leaks and use of zero-emitting technologies. This is a major step forward that EPA estimates will slash 41 million tons of methane pollution by 2035 \u2014 and the agency has recognized the need for further action on flaring and comprehensively covering high-polluting smaller wells.<\/p>\n<span class='bctt-click-to-tweet'><span class='bctt-ctt-text'><a href='https:\/\/x.com\/intent\/tweet?url=https%3A%2F%2Fblogs.edf.org%2Fenergyexchange%2F2021%2F11%2F09%2Fheres-what-you-need-to-know-about-epas-landmark-methane-proposal%2F&#038;text=Here%E2%80%99s%20what%20you%20need%20to%20know%20about%20EPA%E2%80%99s%20landmark%20methane%20proposal&#038;via=EDFEnergyEx&#038;related=EDFEnergyEx' target='_blank'rel=\"noopener noreferrer\">Here\u2019s what you need to know about EPA\u2019s landmark methane proposal <\/a><\/span><a href='https:\/\/x.com\/intent\/tweet?url=https%3A%2F%2Fblogs.edf.org%2Fenergyexchange%2F2021%2F11%2F09%2Fheres-what-you-need-to-know-about-epas-landmark-methane-proposal%2F&#038;text=Here%E2%80%99s%20what%20you%20need%20to%20know%20about%20EPA%E2%80%99s%20landmark%20methane%20proposal&#038;via=EDFEnergyEx&#038;related=EDFEnergyEx' target='_blank' class='bctt-ctt-btn'rel=\"noopener noreferrer\">Share on X<\/a><\/span>\n<p>Here\u2019s more on key features of the proposal:<\/p>\n<p>1. <em>Covering existing sources.<\/em><\/p>\n<p>The standards for the first time extend to the hundreds of thousands of older facilities nationwide that are responsible for the vast majority of methane emissions, allowing states to develop implementation plans to help drive down pollution.<\/p>\n<p>2. <em>Deploying zero-emitting pneumatic controllers.<\/em><\/p>\n<p>EPA\u2019s proposal incorporates protective standards for pneumatic controllers, building from leading approaches in <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2021\/03\/18\/colorados-landmark-methane-rules-raise-bar-for-federal-climate-action\/\">Colorado<\/a>, <a href=\"https:\/\/www.env.nm.gov\/air-quality\/wp-content\/uploads\/sites\/2\/2018\/08\/Proposed-Part-20.2.50-May-6-2021-Version.pdf\">New Mexico<\/a>, and <a href=\"https:\/\/casetext.com\/regulation\/california-code-of-regulations\/title-17-public-health\/division-3-air-resources\/chapter-1-air-resources-board\/subchapter-10-climate-change\/article-4-regulations-to-achieve-greenhouse-gas-emission-reductions\/subarticle-13-greenhouse-gas-emission-standards-for-crude-oil-and-natural-gas-facilities\">California<\/a>, and requiring that they emit zero pollution. Existing polluting valves can be easily replaced with zero-emitting technologies at a low cost with many compliance costs offset by the capture and sale of natural gas that would otherwise be wasted. <a href=\"https:\/\/nam11.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.post-gazette.com%2Fbusiness%2Fpowersource%2F2021%2F07%2F01%2FEQT-net-zero-emissions-2025-natural-gas-carbon-storage-hydrogen-wells-pipelines-CNX-Giant-Eagle%2Fstories%2F202106300120&amp;data=04%7C01%7Celamair%40edf.org%7C299d075b44b340ca8af308d9a0825554%7Cfe4574edbcfd4bf0bde843713c3f434f%7C0%7C0%7C637717303902481628%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&amp;sdata=p7SmO8j4QzLR9reQDhFCQ0fNfCdWtX7X5vxp4lgMxfk%3D&amp;reserved=0\">Leading operators<\/a> have already transitioned their controllers.<\/p>\n<p>All in all, EPA estimates that the transition to zero-emitting controllers as proposed will decrease methane emissions by <a href=\"https:\/\/www.epa.gov\/controlling-air-pollution-oil-and-natural-gas-industry\/epa-proposes-new-source-performance\">19 million tons<\/a> by 2035, the climate equivalent of taking over 300 million cars off of the road for a year.<\/p>\n<p>3. <em>Strengthening leak monitoring and repair and enabling advanced screening.<\/em><\/p>\n<p>Seizing on <a href=\"https:\/\/www.epa.gov\/controlling-air-pollution-oil-and-natural-gas-industry\/epa-methane-detection-technology-workshop\">technological developments<\/a>, like aerial screening for leaks, and the growth and job-creating potential of the <a href=\"https:\/\/www.edf.org\/how-reducing-methane-emissions-creates-jobs\">methane mitigation industry<\/a>, EPA is proposing to allow operators to survey sites using advanced methods already deployed by leaders in the industry.<\/p>\n<p>Operators would screen sites six times per year and conduct an annual on-the-ground inspection for smaller leaks. Advanced methods, which could reduce fugitive emissions by <a href=\"https:\/\/www.epa.gov\/controlling-air-pollution-oil-and-natural-gas-industry\/epa-methane-detection-technology-workshop\">80-90%<\/a>, are highly cost-effective and allow surveying across broad areas to quickly detect and stop the <a href=\"https:\/\/www.permianmap.org\/\">super-emitters<\/a>.<\/p>\n<p>Operators could also stick with ground-based monitoring using infrared cameras from a one-time inspection to bi-monthly depending on a facility\u2019s potential emissions. This framework, built from Colorado standards, recognizes the importance of monitoring at the largest sites, but the method of calculating potential emissions doesn\u2019t account for super-emitting sources, something the final rules should improve upon (more below).<\/p>\n<p>4. <em>Ensuring community participation in implementation processes.<\/em><\/p>\n<p>EPA plans to require that states identify underserved communities and seek their input during regulatory processes, underscoring the administration\u2019s commitment to environmental justice. By developing strategies that overcome linguistic and cultural barriers, sharing information with communities, and soliciting input early in the process, EPA and states can build trust and support from impacted communities.<\/p>\n<p><strong>Three key opportunities to address in EPA\u2019s supplemental proposal<\/strong><\/p>\n<p>EPA also outlined a clear path to final rules late next year that includes a supplemental proposal in early 2022 to address key additional sources of pollution. This important step is necessary to secure significant reductions and ensure that final standards are protective.<\/p>\n<p>Final rules must also include these crucial components:<\/p>\n<p>1. <em>Regular monitoring at all smaller, high-polluting and leak-prone wells.<\/em><\/p>\n<p>Hundreds of thousands of wells across the country generate just a trickle of usable product but are <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/documents\/MarginalWellFactsheet2021_0.pdf\">large and disproportionate emitters of methane<\/a>. In the Permian Basin, the nation\u2019s largest oil field, nearly half of observable production site methane emissions are from low-producing well sites. Nationwide, pollution from these wells destabilizes the climate and harms the health of the more than 7 million people that live nearby, including nearly half a million children and nearly 2 million people of color.<\/p>\n<p>Lack of federal oversight has enabled companies to keep these <a href=\"https:\/\/www.bloomberg.com\/features\/diversified-energy-natural-gas-wells-methane-leaks-2021\/\">decaying wells emitting pollution for years<\/a> beyond their useful lives, perpetuating a cycle of corporate behavior that contributes to the <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2021\/08\/05\/funding-to-plug-and-remediate-orphan-wells-moves-forward-in-the-senate\/\">orphan well problem<\/a>. But these companies are not small mom and pop operations \u2014 <a href=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2021\/11\/MarginalWellFactsheet2021v2.pdf\">EDF analysis<\/a> shows that more than three-quarters of marginal wells are owned by companies that operate more than 100 wells and generate hundreds of millions in gross revenue each year.<\/p>\n<p>EPA has recognized in the proposal that a \u201clow production\u201d exemption is not appropriate. However, under EPA\u2019s current proposal operators that calculate lower potential emissions (less than 3 tons per year of methane) could still escape regular leak monitoring.<\/p>\n<p>This is a big problem since operators wouldn\u2019t be required to factor in super-emitters or equipment failures. EPA has recognized these issues and is seeking comment on how to better incorporate these emissions, ensuring high-polluting sites are subject to regular monitoring.<\/p>\n<p>The agency is further considering how to reduce emissions from sites that have been abandoned by operators. Congress has authorized important investments to plug leaking and abandoned wells, and it is critical that safeguards are in place going forward to help prevent emission from these wells and ensure taxpayers are not left to pick up the tab.<\/p>\n<p>2. <em>Curtailing the practice of routine flaring.<\/em><\/p>\n<p>Flaring is another wasteful and avoidable practice that is rampant in the oil and gas production sector. When companies rush to extract oil, some forgo investments necessary to capture and sell gas and instead burn it as a waste product, emitting a host of climate and health-harming pollutants.<\/p>\n<p>Wasting this gas is an urgent problem, one made even more apparent as we enter a winter with higher natural gas prices and potential shortages. For instance, over the last decade, operators in Texas alone flared the same amount of gas that <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2021\/09\/15\/as-texas-fails-to-stop-flaring-epa-must-act\/\">14 million homes use in a year<\/a>. Flares also commonly malfunction and spew methane directly into the atmosphere. EDF surveys in the <a href=\"https:\/\/www.permianmap.org\/\">Permian Basin<\/a> have found as many as 30% of flares failing or unlit and more than half of flares malfunctioning repeatedly in the same week.<\/p>\n<p>Leading operators have virtually <a href=\"https:\/\/www.jonahenergy.com\/sustainability\/\">eliminated flaring<\/a> across all their operations and leading states like Colorado and New Mexico have already moved to eliminate flaring except in emergency situations. EPA should likewise move to end routine flaring.<\/p>\n<p>3. <em>Incorporating community-based monitoring.<\/em><\/p>\n<p>In a critical move for environmental justice, transparency and accountability, EPA is exploring ways to incorporate emission monitoring results generated by community groups and other third parties into its standards. This important step would allow the agency to accept monitoring results from third parties and prioritize fixing major leaks that are harming nearby communities more quickly.<\/p>\n<p><strong>How you can help<\/strong><\/p>\n<p>EPA\u2019s proposal will soon be available for public comment including via a virtual public hearing.
