\/><\/a><figcaption id=\"caption-attachment-2048\" class=\"wp-caption-text\">Source: WLF<\/figcaption><\/figure>\n<p>After weeks of intense wrangling between industry and environmental representatives, the <a href=\"http:\/\/cogcc.state.co.us\/\">Colorado Oil and Gas Conservation Commission<\/a> (COGCC) adopted a hydraulic fracturing fluid chemical disclosure rule that, in many ways, serves as a model for the nation.<\/p>\n<p>It\u2019s been a learning process these last couple of years \u2013 as EDF has worked to get disclosure policies adopted in the states.\u00a0 With their own disclosure rules, Wyoming, Arkansas, Texas and Montana have all made important contributions to the debate.\u00a0 And in Colorado, we\u2019re finally seeing things start to coalesce.<\/p>\n<p>Colorado\u2019s <a href=\"http:\/\/cogcc.state.co.us\/RR_HF2011\/FinalModifiedStaffProposal001.pdf\">Rule 205A<\/a> settles key questions about what kinds of information the public expects to see and how the information should be presented, including:<\/p>\n<p><strong>Requirements for Searchable Database<\/strong><\/p>\n<p>Picking up on a <a href=\"http:\/\/shalegas.energy.gov\/resources\/081811_90_day_report_final.pdf\">recommendation<\/a> from the shale gas subcommittee of the U.S. Secretary of Energy Advisory Board (a panel on which EDF President Fred Krupp served), the Colorado rule requires chemical information to be made available on a website that allows people to search and sort data by company, chemical ingredient, geographic area and other criteria.<\/p>\n<p>This is a big step that will allow land owners, neighbors, regulators and policymakers to focus and refine their questions and research about hydraulic fracturing.<\/p>\n<p>We\u2019re also fans of the fact that the rule requires operators to post their disclosures on <a href=\"http:\/\/fracfocus.org\/\">Frac Focus<\/a>, which must be made searchable by January 1, 2013.\u00a0 If Frac Focus doesn\u2019t have these upgrades in place by then (or isn\u2019t clearly on a path to do so), the rule requires the COGCC to build its own searchable database.<\/p>\n<p>The creators of Frac Focus \u2013 the Ground Water Protection Council (GWPC) and the Interstate Oil and Gas Compact Commission (IOGCC) \u2013 are already talking about searchability, and the Colorado rule provides a clear signal that the states want to see it happen and happen soon.<\/p>\n<p>(The Texas disclosure rule, which was also adopted <a href=\"http:\/\/blogs.star-telegram.com\/barnett_shale\/2011\/12\/texas-mandates-disclosure-of-frack-chemicals.html\">today<\/a>, uses Frac Focus as the disclosure platform, but doesn\u2019t require searchability.\u00a0 In adopting the rule, the Texas Railroad Commission agreed that Frac Focus <em>should<\/em> be made searchable and said it would work with GWPC and IOGCC to make those upgrades).<\/p>\n<p><strong>Full Disclosure of Chemical Ingredients<\/strong><\/p>\n<p>Colorado also set a national standard by requiring disclosure of the identities and concentrations of <em>all<\/em> chemical ingredients, not just those that have been determined to be \u201chazardous\u201d according to Occupational Safety and Health Administration (OSHA) regulations.\u00a0 Other states have taken the step of requiring disclosure of the <em>identities <\/em>of all chemicals, but Colorado is the first to require disclosure of both chemical identities <em>and<\/em> concentrations<em> <\/em>for all chemicals.<\/p>\n<p>As readers of our blog posts on fracturing fluid disclosure know, just because a chemical hasn\u2019t been identified as \u201chazardous\u201d under OSHA Hazard Communication rules, it doesn\u2019t necessarily mean the chemical isn\u2019t dangerous.\u00a0 OSHA regulations require that chemicals be identified as hazardous when studies show they could be dangerous in a workplace setting.\u00a0 These regulations don\u2019t look at the question of whether a chemical might be dangerous if exposure occurs through an environmental pathway.\u00a0 Moreover, a chemical might be dangerous in both a workplace setting and through environmental exposure \u2013 but if the studies haven\u2019t been done yet, OSHA regulations don\u2019t require you to list it as hazardous.<\/p>\n<p>According to industry, at least half of the chemicals used in hydraulic fracturing fluids don\u2019t fall under these OSHA Hazard Communication rules.\u00a0 And toxicological data on many, if not most, of these chemicals is very thin.\u00a0 So requiring full disclosure of hydraulic fracturing chemicals is a critical first step toward building up our understanding of the risks they may present.<\/p>\n<p>The Colorado disclosure rule isn\u2019t perfect, but it\u2019s darn good.\u00a0 And with the provisions for searchability and full chemical
