But what many folks may not realize is that with this increase in oil and gas, also comes an increase in waste \u2013 specifically wastewater. In fact, for every barrel of oil produced wells can generate 10 times as much chemical-laden wastewater. All told, the industry produces over 900 billion gallons of wastewater a year, and we know very little about the chemicals in it.<\/p>\n<p>Traditionally, companies have pumped this wastewater deep underground, but the growing volume is creating new challenges\u2013 leading many to wonder whether there may be different options for managing or reusing it. One of those options is treatment and discharge to rivers or streams.<\/p>\n<p><a href=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2019\/02\/Discharge-graphic.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-18857\" src=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2019\/02\/Discharge-graphic-1024x791.jpg\" alt=\"\" width=\"550\" height=\"425\" srcset=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2019\/02\/Discharge-graphic-1024x791.jpg 1024w, https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2019\/02\/Discharge-graphic-300x232.jpg 300w, https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2019\/02\/Discharge-graphic-768x593.jpg 768w, https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2019\/02\/Discharge-graphic.jpg 1429w\" sizes=\"auto, (max-width: 550px) 100vw, 550px\" \/><\/a><\/p>\n<p><!--more--><\/p>\n<p>Expanding discharge options <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2017\/10\/12\/getting-dangerously-creative-with-oil-and-gas-wastewater\/\">would be risky<\/a> though, given all we are <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2018\/03\/15\/could-wastewater-from-oil-and-gas-production-help-solve-our-water-crisis-not-without-better-science\/\">still learning<\/a> about the chemicals in wastewater, potential toxicity, treatability and potential health risks.<\/p>\n<p>The Environmental Protection Agency (EPA) will soon release <a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-signs-mou-new-mexico-explore-wastewater-reuse-options-oil-and-natural-gas-industry\">a study of discharge practices<\/a>, including the pros and cons of current regulations. States like <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2018\/09\/27\/why-new-mexico-shouldnt-rush-toward-repurposing-oilfield-wastewater\/\">New Mexico<\/a> and <a href=\"https:\/\/www.eenews.net\/stories\/1060110201\">Oklahoma<\/a> are also working with EPA to better define their own authorities and options.<\/p>\n<p>As states and EPA consider what a future for produced water discharge might look like\u2013 it\u2019s important to know what the standards are today.<\/p>\n<span class='bctt-click-to-tweet'><span class='bctt-ctt-text'><a href='https:\/\/x.com\/intent\/tweet?url=https%3A%2F%2Fblogs.edf.org%2Fenergyexchange%2F2019%2F02%2F26%2Ftrumps-epa-may-weaken-restrictions-on-disposal-of-oilfield-wastewater-heres-what-you-need-to-know%2F&#038;text=Trump%27s%20EPA%20may%20weaken%20restrictions%20on%20disposal%20of%20oilfield%20wastewater%20--%20here%27s%20what%20you%20need%20to%20know&#038;via=EDFEnergyEx&#038;related=EDFEnergyEx' target='_blank'rel=\"noopener noreferrer\">Trump&#039;s EPA may weaken restrictions on disposal of oilfield wastewater -- here&#039;s what you need to know <\/a><\/span><a href='https:\/\/x.com\/intent\/tweet?url=https%3A%2F%2Fblogs.edf.org%2Fenergyexchange%2F2019%2F02%2F26%2Ftrumps-epa-may-weaken-restrictions-on-disposal-of-oilfield-wastewater-heres-what-you-need-to-know%2F&#038;text=Trump%27s%20EPA%20may%20weaken%20restrictions%20on%20disposal%20of%20oilfield%20wastewater%20--%20here%27s%20what%20you%20need%20to%20know&#038;via=EDFEnergyEx&#038;related=EDFEnergyEx' target='_blank' class='bctt-ctt-btn'rel=\"noopener noreferrer\">Share on X<\/a><\/span>\n<p><strong>What do the current rules say?<\/strong><\/p>\n<p>The Clean Water Act requires a permit to discharge pollutants into waterways. The key permitting program &#8212; the <a href=\"https:\/\/www.epa.gov\/npdes\">National Pollutant Discharge Elimination System<\/a> (NPDES) &#8212; looks at both the capabilities of treatment technologies as well as water quality objectives in order to determine what kind of permit is appropriate.<\/p>\n<p><strong>Existing options for wastewater discharge<\/strong><\/p>\n<p>The technology aspect, also known as \u201ceffluent limitation guidelines\u201d (ELGs) can vary from industry to industry based on the ability of treatment technologies to remove constituents of concern to acceptable levels. EPA\u2019s study of the technologies and pollutants for an industry results in an ELG that sets the national baseline for discharge permits.<\/p>\n<p>The main ELG for oil and gas facilities sets a baseline of \u201cno discharge\u201d of pollutants into navigable waters of the United States. In 2016, the EPA went further, and prohibited companies who operate \u201cunconventional wells\u201d from disposing of their wastewater into municipal treatment systems, known as Publicly Owned Treatment Works (POTW), since these city-owned facilities are not designed to handle this type of industrial waste.<\/p>\n<p>However, there are some noteworthy exceptions to this rule:<\/p>\n<ul>\n<li>Any facility in the historically arid west (essentially anything west of Dallas, specifically the 98th meridian line) may discharge wastewater if oil and grease levels are reduced and it is of \u201cgood enough quality\u201d for agriculture or wildlife. (Of course, what \u201cgood enough quality\u201d really means is up for debate.)<\/li>\n<li>A well that produces less than 10 barrels of oil a day (also known as a stripper well) also doesn\u2019t have to follow these guidelines.<\/li>\n<\/ul>\n<p>Outside of this baseline rule for discharges directly from an oil and gas wellsite, there is a second optional route. Operators may also transport their wastewater to what EPA calls a Centralized Waste Treatment Facility (CWT). These facilities can accept and treat industrial wastes that include metals, oil, organics and blended waste streams. However, while the guidelines for these facilities may be more robust than municipal treatment plants, they still weren\u2019t created with the oil and gas industry\u2019s wastewater in mind, meaning that the baseline rules may not currently offer the protections needed to ensure pollutants of concern from oil and gas wastewater don\u2019t reach rivers and streams. (You can learn more about CWTs and the oil and gas industry from EPA\u2019s detailed <a href=\"https:\/\/www.epa.gov\/eg\/centralized-waste-treatment-effluent-guidelines-documents\">2018 study<\/a> of CWT\u2019s accepting this type of waste, including their own concerns.)<\/p>\n<p><strong>How to define \u201cclean\u201d<\/strong><\/p>\n<p>The ELG\u2019s are not the final word, though. As a complement to the technology standards, states also have the power to determine how clean they want their water to be by setting their own water quality based guidelines. This allows states to monitor and limit particular pollutants of concern to protect certain qualities or uses of their water bodies. When permit writers are developing a final NPDES permit, they will consider both the baseline technology standard and the water quality standard that applies to the receiving water body and develop requirements based on both standards.<\/p>\n<p>This is important to keep in mind. Even if EPA were to modify the technology standards, states have an opportunity to chime in to address any risks they may see for their water bodies with modifications to their water quality standards.<\/p>\n<p><strong>What might change?<\/strong><br \/>\nClean water protections are extremely complicated. And as we learn more about the chemicals used in hydraulic fracturing, as well as the pollutants that may naturally come up from underground, we are also learning our existing standards may be ill suited for the massive volume of chemical-laden wastewater generated in the oilfields.<\/p>\n<p>That\u2019s why it\u2019s so important to keep an eye on what EPA might do to either strengthen or weaken standards for industry\u2019s wastewater. It\u2019s hard to predict what EPA might do, they may:<\/p>\n<ul>\n<li>rollback the baseline prohibition on discharges from oil and gas well sites,<\/li>\n<li>allow municipal treatment facilities to handle oilfield wastewater<\/li>\n<li>extend the vague \u201cgood enough quality\u201d standard nationwide,<\/li>\n<li>or reconsider the standards for CWTs.<\/li>\n<\/ul>\n<p>What we do know is that there is a lot to be concerned about given limitations in our understanding of the complete range of pollutants that might be in this wastewater \u2013 a challenge <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2016\/02\/05\/what-epa-should-consider-on-their-final-fracking-assessment\/\">EPA\u2019s own experts have acknowledged<\/a>. Permits that allow for the discharge of this wastewater must \u2013 definitively \u2013 be written to ensure that human health, water resources and ecosystems are protected, and that is going to require work.
