Last year, Dynegy tried to ramrod customer-funded coal subsidies into the <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2016\/12\/07\/illinois-future-energy-jobs-bill-shows-states-are-taking-the-lead-to-build-the-clean-energy-economy\/\">Future Energy Jobs Act<\/a> at the last minute, but Environmental Defense Fund (EDF) and our allies successfully blocked that effort.<\/p>\n<p>But, like the Hydra of Greek mythology, when we cut off one head, more appeared. The legendary <a href=\"https:\/\/en.wikipedia.org\/wiki\/Dynegy\">Dynegy<\/a> hasn\u2019t given up on its quest for a coal bailout, and the company is tapping nearly every avenue of government along the way.<!--more--><\/p>\n<p><strong>Pollution limits<\/strong><\/p>\n<p>For almost a year, <a href=\"http:\/\/www.chicagotribune.com\/news\/local\/breaking\/ct-rauner-dynegy-coal-met-20170926-story.html\">Dynegy worked with the Illinois Environmental Protection Agency<\/a> (EPA) to re-write pollution standards so that the company can run its dirtier plants more often, earning bigger profits and keeping those coal plants afloat. The current rules, negotiated 10 years ago, placed limits on emissions from certain power plants.<\/p>\n<p>[Tweet &#8220;3 ways Dynegy is trying to make Illinoisans bail out its aging coal fleet&#8221;]<\/p>\n<p>The proposed rule change would aggregate emissions \u00a0\u2013 an important change that would allow Dynegy to calculate its emissions relative to its entire fleet and permit <em>double<\/em> the greenhouse gas pollution the corporation emitted last year.<\/p>\n<p>The reason for changing the pollution standards has nothing to do with limiting pollution or protecting public health. In fact, according to the <em>Chicago Tribune<\/em>, Illinois EPA director Alec Messina \u201csaid the goal is to keep the financially struggling coal plants open.\u201d<\/p>\n<p>The rule is now pending before the Illinois Pollution Control Board, which is accepting public comments and will hear expert testimony in early 2018.<\/p>\n<p><strong>Legislative route<\/strong><\/p>\n<p>Less than a month after the rule changes were proposed, a group of Illinois House representatives introduced a bill that would provide Dynegy with a <a href=\"http:\/\/www.chicagobusiness.com\/article\/20171013\/ISSUE01\/171019915\/more-power-bailout-talk-in-springfield\">customer-funded bailout<\/a>. <div class=\"simplePullQuote right\"><p>EDF estimates the legislation would raise rates on Central and Southern Illinois residents <a href=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2017\/11\/ANDREW-BARBEAU-TESTIMONY-Dynegy-Nov-2017.pdf\">by more than $400 million per year<\/a>.<\/p>\n<\/div><\/p>\n<p>Rather than have Dynegy retire its most polluting, least profitable power plants, the proposed law would force customers to pay to keep the plants open. EDF estimates the legislation would raise rates on Central and Southern Illinois residents <a href=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2017\/11\/ANDREW-BARBEAU-TESTIMONY-Dynegy-Nov-2017.pdf\">by more than $400 million per year<\/a>. That staggering request raises even more eyebrows given that, days after the legislation was filed, Vistra Energy, another Texas power giant, announced it was merging with Dynegy and creating <a href=\"https:\/\/investor.vistraenergy.com\/investor-relations\/news\/press-release-details\/2017\/Vistra-Energy-And-Dynegy-To-Combine-To-Create-Leading-Integrated-Power-Company\/default.aspx\">over $5 billion in excess capital<\/a>.<\/p>\n<p>Lawmakers heard testimony about the proposal last Tuesday. EDF and other environmental and consumer advocates, along with the Illinois Attorney General\u2019s Office, <a href=\"http:\/\/www.news-gazette.com\/news\/local\/2017-11-08\/illinois-house-senate-energy-panels-discuss-dynegy-bailout-request.html\">criticized the proposal<\/a> and pointed to evidence showing the harm it would cause to the state.<\/p>\n<p><strong>No reliability \u201cchallenges\u201d<\/strong><\/p>\n<p>As if these two efforts weren\u2019t enough, last month, the Illinois Governor surprised us with a concerning request to the Illinois Commerce Commission (ICC). Referencing <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2017\/06\/20\/rick-perry-just-got-scooped-new-report-shows-cleaner-grid-provides-reliable-power\/\">reliability<\/a> \u2013 a topic that is oft-cited by coal supporters as of late \u2013 Gov. Rauner requested a report on the \u201ccurrent challenges\u201d in Dynegy\u2019s territory. (Presumably, the \u201cchallenges\u201d referenced are one and the same as those about which <a href=\"http:\/\/www.stltoday.com\/business\/local\/to-make-coal-plants-in-southern-illinois-competitive-dynegy-seeks\/article_812f7085-fb8d-58e4-89b0-6e452ff3c817.html\">Dynegy has complained<\/a> to the Illinois legislature and the public in recent days.) <div class=\"simplePullQuote right\"><p>The ICC obliged the Governor with a report that finds there is a <a href=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2017\/11\/FOIA-Attach-1-MISO-Zone-4-whitepaper-11-1-17.pdf\">projected surplus of electricity<\/a> in Dynegy\u2019s region and grid reliability is sound.<\/p>\n<\/div><\/p>\n<p>Although ensuring reliability is the responsibility of the regional grid operator, and not the state\u2019s regulatory agency, the ICC obliged the Governor with a report that finds there is a <a href=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2017\/11\/FOIA-Attach-1-MISO-Zone-4-whitepaper-11-1-17.pdf\">projected surplus of electricity<\/a> in Dynegy\u2019s region and grid reliability is sound. In other words, it\u2019s unlikely that a world without Dynegy\u2019s coal plants would result in any loss of power because the grid is able to make more electricity than we\u2019ll likely need.<\/p>\n<p>At the same time, the report proposes a number of policy options the state could take in response to the Governor\u2019s concerns. Such options range from allowing the current competitive market to function as normal (a healthy option) to requiring long-term contracts for coal generation to guarantee profits for coal plants (aka bailouts).<\/p>\n<p>A stakeholder process to discuss whether there is a need to take action will likely begin this month.<\/p>\n<p><strong>Clean, efficient energy challenging coal<\/strong><\/p>\n<p>The pro-coal push is hardly unique to Illinois. Around the country, natural gas and renewable power sources are driving expensive coal out of the competitive market. Simultaneously, a number of factors \u2013 including increasingly more efficient lighting and appliances \u2013 have caused energy consumption to plateau and even decrease in some areas. Meanwhile, job growth in clean energy (wind, solar, and energy efficiency) <a href=\"https:\/\/www.edf.org\/climate\/clean-energy-jobs\">far outpaces<\/a> coal jobs \u2013 more than three-to-one. <div class=\"simplePullQuote right\"><p>Job growth in clean energy (wind, solar, and energy efficiency) <a href=\"https:\/\/www.edf.org\/climate\/clean-energy-jobs\">far outpaces<\/a> coal jobs \u2013 more than three-to-one.<\/p>\n<\/div><\/p>\n<p>Given all of this, it is no surprise that coal generators are seeking relief anywhere they can find it. Energy Secretary Rick Perry <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2017\/10\/17\/rick-perrys-coal-bailout-is-an-attack-on-competitive-energy-markets-with-customers-footing-the-bill\/\">is even proposing bailouts<\/a> at the federal level, which would prop up expensive, aging coal plants like Dynegy\u2019s.
