FirstEnergy doesn\u2019t seem to care.<\/p>\n<p>Almost two months ago, the Federal Energy Regulatory Commission (FERC) <a href=\"https:\/\/www.edf.org\/media\/federal-regulators-stand-customers-fair-electricity-market\">ruled against<\/a> the Ohio-based utility giant\u2019s request to bail out its uneconomic power plants. FirstEnergy then tweaked its proposal to obtain the same result but, <a href=\"https:\/\/www.firstenergycorp.com\/newsroom\/2016-annual-meeting-remarks.html\">according to its CEO<\/a>, \u201cwithout the need for\u2026FERC approval.\u201d<\/p>\n<p>To \u201cFERC-proof\u201d its bailout scheme, FirstEnergy now tries to mockingly call its subsidy a \u201csurcharge\u201d rather than a \u201cpower purchase agreement (PPA).\u201d Put another way, by simply changing the wording of the original bailout, the utility\u2019s sleight of hand aims to skirt federal oversight.<\/p>\n<p>Environmental Defense Fund (EDF) is joining the Electric Power Supply Association (EPSA) and others <a href=\"https:\/\/blogs.edf.org\/energyexchange\/wp-content\/blogs.dir\/38\/files\/2016\/06\/EPSA-FINAL-protest-to-FE-May-27-filings-.pdf\">in asking<\/a> FERC to overturn this end-run attempt \u2013 something we\u2019re calling FirstEnergy\u2019s \u201cVirtual PPA.\u201d It\u2019s virtually the same as the original rotten deal, and it\u2019s just as bad for customers, clean air, and markets.\u00a0<!--more--><\/p>\n<p><strong>FirstEnergy\u2019s \u201cnew\u201d deal has the same results<\/strong><\/p>\n<p>The utility does deserve credit for persistence and creativity, yet its new proposal doesn\u2019t even pass the laugh test. To avoid FERC jurisdiction, for instance, FirstEnergy now claims its subsidy will no longer guarantee the operation of its uneconomic power plants. Yet the utility\u2019s new surcharge is contingent on the continued operation of virtually the same number of megawatts of its nuclear and fossil generation. A virtual guarantee.<\/p>\n<p>FirstEnergy\u2019s original bailout was based on the explicit sale of power, which falls under FERC\u2019s jurisdiction in a regional market. FirstEnergy now claims its electricity-generating affiliate will no longer be selling \u201celectricity itself\u201d to its electricity-distributing affiliate, but instead will be selling \u201cthe ability to provide it when necessary.\u201d Unfortunately for the utility, that phrase is the very definition of providing \u201ccapacity,\u201d which FERC has the authority to regulate as well.<\/p>\n<p>[Tweet &#8220;Federal Regulators Should (Again) Block FirstEnergy\u2019s Sneaky Attempts to Evade Oversight&#8221;]<\/p>\n<p>FirstEnergy also conveniently forgets it\u2019s a large company with several affiliates \u2013 and there are clear rules prohibiting one affiliate from providing special treatment to another. A few months ago FERC ruled it illegal for FirstEnergy\u2019s generation affiliate to sell power at inflated rates to its distribution affiliate. Now FirstEnergy wants to have the surcharge go to the distribution affiliate, trying to hide the fact the extra revenue will flow back to the parent company, which will be used to keep the generation affiliate\u2019s uneconomic power plants operating. Different path, but virtually the same end point. FERC has a time-honored saying for that deception: \u201cOne may not presume the right to do indirectly what one may not do directly.\u201d<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> In other words, don\u2019t think you can get your way by simply pretending you\u2019re taking a new approach.<\/p>\n<p>The EDF\/EPSA protest is even more direct, stating: \u201cA bribe is still a bribe if it is paid to the politician\u2019s spouse, and a capacity payment is still a capacity payment if it is transferred up to the common parent through a dividend or other intra-corporate transfer.\u201d<\/p>\n<div class=\"simplePullQuote right\"><p>The subsidy also allows old and uneconomic power plants to continue spewing pollutants, well beyond when market forces would have forced their closure.<\/p>\n<\/div>\n<p>Creative wording and rerouting doesn\u2019t stop the money from ending up in the exact same place, performing the exact same role.<\/p>\n<p><strong>Regulators must once again stand up for competition<\/strong><\/p>\n<p>The utility\u2019s convoluted arguments reveal it\u2019s speaking out of both sides of its mouth. When addressing state regulators at the Public Utilities Commission of Ohio (PUCO), it claims the new proposal is little changed from its previous plea, hoping Buckeye State regulators again will quickly <a href=\"https:\/\/blogs.edf.org\/energyexchange\/2016\/05\/11\/rubber-stamp-regulators-ohio-gives-firstenergy-another-go-ahead\/\">rubber stamp<\/a> the subsidy. Yet when addressing FERC, it claims the new proposal is an entirely different animal over which federal regulators no longer have jurisdiction.<\/p>\n<p>Why is this regulatory dissing important? For one, FirstEnergy\u2019s greedy request will hurt customers, to the tune of $3.6-$5.15 billion, according to the Ohio Consumers\u2019 Counsel.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> That\u2019s a lot of money. As noted by the Northwest Ohio Aggregation Council and ten Northwest Ohio communities, \u201c(w)hen all the jargon is stripped away, the [FirstEnergy scheme] requires regular people to pay an extra month\u2019s electric bill each year for eight years.\u201d<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n<p>The subsidy also allows old and uneconomic power plants to continue spewing pollutants, well beyond when market forces would have forced their closure. Furthermore, FirstEnergy\u2019s requested bailout would disrupt electricity markets, making it harder for innovative and clean generators to compete.<\/p>\n<p>The utility\u2019s new bailout plea is nothing more than a blatant attempt to flout FERC\u2019s previous directives and make a mockery of affiliate-subsidy restrictions. A virtual PPA is still a PPA, no matter how creatively you word it.
