In a surprise procedural decision on Feb. 9, the U.S. Supreme Court put the Obama administration\u2019s\u00a0Clean Power Plan<\/a> on pause while a lower court reviews it.<\/p>\n

The Court did not weigh in on the merits of the Environmental Protection Agency\u2019s plan, and didn\u2019t explain its reasoning, so we don\u2019t know the legal basis for this unusual decision.<\/p>\n

But we do know that the court has repeatedly upheld the EPA\u2019s authority \u2013 in fact, its responsibility \u2013 to limit climate pollution under the Clean Air Act.<\/p>\n

So we remain confident that the Clean Power Plan rests on a solid legal foundation, as states, power companies, legal experts and air pollution control officials nationwide have already recognized.<\/p>\n

This is why states should stay on course and continue to invest in cleaner energy sources. The bigger trend toward clean energy is clear.<\/span><\/span><\/p>\n

Clinging to the past is bad policy<\/strong><\/p>\n

A lower court, the D.C. Court of Appeals, will continue its review of the Clean Power Plan, with a hearing scheduled for June 2.<\/p>\n

Because of the Supreme Court\u2019s action yesterday, the EPA can\u2019t require states to move forward with their planning until the issue is settled. But the reality is that many states<\/a> and power companies will continue to plan for the clean energy future they all know is coming.<\/p>\n

In fact, it would be irresponsible to delay the transition away from dirty fossil fuels with the expectation that the Supreme Court will reverse its consistent endorsement of the EPA\u2019s duty to limit emissions.\u00a0Meanwhile, the need for the EPA to exercise its recognized authority to protect our nation from dangerous climate change becomes ever more clear.<\/p>\n

Delay is not what citizens expect<\/a> from their leaders.\u00a0And companies that cling to 19th-century fuels and 20th-century business plans aren\u2019t doing their stockholders any good.<\/p>\n

Yesterday\u2019s ruling was a setback because this is the time we need to accelerate the transformation to clean energy, rather than create uncertainty.<\/p>\n

It\u2019s telling, therefore, that several states\u00a0\u2013\u00a0including Virginia, Colorado, Minnesota and California\u00a0\u2013\u00a0have already said they will stay the course.<\/p>\n

The Clean Power Plan, which helped inspire China\u2019s recent actions<\/a> on climate change and the 190-nation climate agreement in Paris, should move forward because it has the facts, law\u00a0and science on its side.<\/p>\n
