{"id":4050,"date":"2012-09-12T12:09:02","date_gmt":"2012-09-12T16:09:02","guid":{"rendered":"http:\/\/blogs.edf.org\/edfish\/?p=4050"},"modified":"2012-09-12T12:09:02","modified_gmt":"2012-09-12T16:09:02","slug":"court-upholds-west-coast-catch-share-program","status":"publish","type":"post","link":"https:\/\/blogs.edf.org\/edfish\/2012\/09\/12\/court-upholds-west-coast-catch-share-program\/","title":{"rendered":"Court Upholds West Coast Catch Share Program"},"content":{"rendered":"<p>The U.S. Court of Appeals for the ninth Circuit\u00a0this week\u00a0upheld a prior court&#8217;s ruling\u00a0that the West Coast Groundfish individual transferable quota system\u2014a form of catch share\u2014complies with the <a href=\"http:\/\/www.nmfs.noaa.gov\/sfa\/magact\/\">Magnuson-Stevens Fishery Conservation and Management Act<\/a> and the <a href=\"http:\/\/www.epa.gov\/region1\/nepa\/\">National Environmental Policy Act<\/a>. The court found that the <a href=\"http:\/\/www.nmfs.noaa.gov\/\">National Marine Fisheries Service<\/a> (NMFS) had adequately considered \u00a0the impacts of the program and taken \u00a0the proper steps to accomplish its goals, including environmental conservation, increasing economic benefits and holding fishermen accountable for staying within catch limits.<\/p>\n<p>In dismissing the plaintiff\u2019s arguments challenging inadequate consideration of environmental impacts, the court held that the program &#8220;may actually decrease trawling&#8217;s dominance by consolidating the trawling fleet, allowing trawlers to switch to fixed gear, and allocating more fish to non-trawlers than they have caught in recent years.&#8221; In fact, according to a <a href=\"http:\/\/www.pcouncil.org\/wp-content\/uploads\/H5b_NMFS_RPT_SEP2012BB.pdf\">mid-year update<\/a> from NMFS on the status of the fishery, the IFQ program continues to generate significant conservation benefits.
