{"id":9026,"date":"2014-10-07T14:58:23","date_gmt":"2014-10-07T19:58:23","guid":{"rendered":"http:\/\/blogs.edf.org\/climate411\/?p=9026"},"modified":"2014-10-20T13:10:58","modified_gmt":"2014-10-20T18:10:58","slug":"victory-for-healthy-air-court-rejects-nebraska-attorney-generals-attempt-to-short-circuit-the-law-in-challenge-to-carbon-pollution-standards","status":"publish","type":"post","link":"https:\/\/blogs.edf.org\/climate411\/2014\/10\/07\/victory-for-healthy-air-court-rejects-nebraska-attorney-generals-attempt-to-short-circuit-the-law-in-challenge-to-carbon-pollution-standards\/","title":{"rendered":"Victory for Healthy Air: Court Rejects Nebraska Attorney General&#8217;s Attempt to \u201cShort-Circuit\u201d the Law in Challenge to Carbon Pollution Standards"},"content":{"rendered":"<p>Nebraska Attorney General Jon Bruning\u2019s attempt to block the U.S. Environmental Protection Agency\u2019s (EPA) efforts to limit carbon pollution from power plants failed yesterday.<\/p>\n<p>The federal district court in Nebraska <a href=\"https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/2014\/10\/Nebraska-v.-EPA-No.-14-3006-D.-Neb.-Dismissed.pdf\">dismissed the Attorney General\u2019s lawsuit<\/a> challenging EPA\u2019s proposed Carbon Pollution Standards for new fossil fuel power plants.<\/p>\n<p>The court held that:<\/p>\n<blockquote><p>[the Attorney General\u2019s] attempt to short-circuit the administrative rulemaking process runs contrary to basic, well-understood administrative law. (<a href=\"https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/2014\/10\/Nebraska-v.-EPA-No.-14-3006-D.-Neb.-Dismissed.pdf\">Decision<\/a>, Page 1)<\/p><\/blockquote>\n<p>The Attorney General\u2019s challenge was flawed because it was filed only one week after EPA published <b>proposed<\/b> carbon emission standards for new power plants, in January 2014.<\/p>\n<p>But the law is this case is clear and anchored in common sense.<\/p>\n<p>As the court explained, legal challenges may only be brought against <b>final<\/b> standards:<\/p>\n<blockquote><p>Simply stated, the State cannot sue in federal court to challenge a rule that EPA has not yet actually made. (<a href=\"https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/2014\/10\/Nebraska-v.-EPA-No.-14-3006-D.-Neb.-Dismissed.pdf\">Decision<\/a>, Page 1)<\/p><\/blockquote>\n<p>EPA\u2019s proposed action is still in draft form and has been the subject of extensive public comment.<\/p>\n<p>In December 2012, the D.C. Circuit <a href=\"http:\/\/www.bna.com\/court-dismisses-power-n17179871420\/\">rejected<\/a> a similar challenge to EPA\u2019s original proposal for the very same reason \u2014 that the standards had yet to be finalized.<\/p>\n<p>This latest attempt at an end run around the Clean Air Act would have deprived the public of a chance to comment on a proposed rule and present its diverse viewpoints to the agency.\u00a0 Moreover, for a court to review standards that are still being developed would be a waste of judicial resources and Americans\u2019 tax dollars.<\/p>\n<p>The court also noted a defect in the Nebraska Attorney General\u2019s central legal claim.<\/p>\n<p>The Attorney General argued that EPA\u2019s reliance, in part, on data from facilities receiving federal assistance was unlawful.<\/p>\n<p>The court explained:<\/p>\n<blockquote><p>The merits of this claim are not before the Court.\u00a0But the Court notes that [Energy Policy Act section] 402(i)\u00a0only forbids the EPA from considering a given technology or level of emission reduction to be adequately demonstrated <i>solely<\/i> on the basis of federally-funded facilities.\u00a042 U.S.C. [section] 15962(i).\u00a0In other words, such technology might be adequately demonstrated if that determination is based at least in part on non-federally-funded facilities. (<a href=\"https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/2014\/10\/Nebraska-v.-EPA-No.-14-3006-D.-Neb.-Dismissed.pdf\">Decision<\/a>, Footnote 1, Page 5)<\/p><\/blockquote>\n<p>EDF previously examined the flaws with the Nebraska Attorney General\u2019s legal claim in a <a href=\"https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/2013\/12\/Response-to-House-Committee-Letter-on-EPAct.pdf\">detailed white paper<\/a>.\u00a0(You can read my <a href=\"https:\/\/blogs.edf.org\/climate411\/2013\/12\/06\/epas-proposed-carbon-pollution-standards-are-legally-and-technically-sound\/?_ga=1.115689989.2002362362.1392063711\">blog about the white paper here<\/a>)<\/p>\n<p>Unfortunately for the citizens of Nebraska, Attorney General Bruning is devoting precious taxpayer resources to misguided legal attacks.<\/p>\n<p>It\u2019s not the only way in which Nebraska\u2019s taxpayer dollars are being deployed to block vital clean air progress for our nation.<\/p>\n<p>The Guardian <a href=\"http:\/\/www.theguardian.com\/environment\/2014\/may\/02\/barack-obamas-emissions-plan-comes-under-new-line-of-attack\">reported<\/a> that Bruning, on a conference call organized by the American Legislative Exchange Council (ALEC), told other state attorneys general that Nebraska has challenged EPA authority more than 30 times and will keep on doing so.<\/p>\n<p>Yet the Carbon Pollution Standards for new power plants have won <a href=\"https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/2014\/05\/Broad-Support-for-Carbon-Pollution-Standards.pdf?_ga=1.126970829.1581090072.1383585920\">broad public support<\/a> from millions of Americans &#8212; including public health associations, Moms Clean Air Force, faith-based organizations, the League of United Latin American Citizens, and leading power companies.<\/p>\n<p>Nebraska\u2019s failed lawsuit is just one more\u00a0misguided attempt to prevent vital limitations on the carbon pollution emitted by power plants from moving forward.<\/p>\n<p>According to the Guardian, <a href=\"http:\/\/www.theguardian.com\/environment\/2014\/may\/02\/barack-obamas-emissions-plan-comes-under-new-line-of-attack\">Bruning claims<\/a> that:<\/p>\n<blockquote><p>EPA continues to try and \u2018fix things\u2019 that are not broken.<\/p><\/blockquote>\n<p>Tell that to the millions of Americans who are <a href=\"http:\/\/nca2014.globalchange.gov\/highlights\">experiencing the harmful impacts<\/a> of climate change.<\/p>\n<p>While EPA takes steps to address carbon pollution from the single largest source in the country, Attorney General Bruning is devoting Nebraska\u2019s tax dollars to flawed lawsuits.<\/p>\n<p>Fortunately, millions of Americans in red and blue states alike are working together to forge solutions for our families, our communities and our nation.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Nebraska Attorney General Jon Bruning\u2019s attempt to block the U.S. Environmental Protection Agency\u2019s (EPA) efforts to limit carbon pollution from power plants failed yesterday.
