{"id":4469,"date":"2014-01-06T14:05:05","date_gmt":"2014-01-06T19:05:05","guid":{"rendered":"http:\/\/blogs.edf.org\/climate411\/?p=4469"},"modified":"2014-01-06T14:05:05","modified_gmt":"2014-01-06T19:05:05","slug":"new-study-web-of-entities-invests-heavily-in-obstructing-climate-and-clean-energy-progress","status":"publish","type":"post","link":"https:\/\/blogs.edf.org\/climate411\/2014\/01\/06\/new-study-web-of-entities-invests-heavily-in-obstructing-climate-and-clean-energy-progress\/","title":{"rendered":"New Study &#8212; Web of Entities Invests Heavily in Obstructing Climate and Clean Energy Progress"},"content":{"rendered":"<p>A few days ago, the <a href=\"http:\/\/blogs.wsj.com\/five-things\/2013\/12\/30\/5-losers-the-worst-stocks-of-2013\/?KEYWORDS=Peabody+Coal+Company\">Wall Street Journal reported<\/a> that Peabody Coal Company is one of the top five <b>worst<\/b> performing stocks of 2013.<\/p>\n<p>In a year when the S&amp;P 500 was up 29 percent and the Dow rose by 26 percent, Peabody Coal\u2019s stock <b>plummeted <\/b>by 28 percent.<\/p>\n<p>While most investors recognize the serious environmental and financial risks associated with coal and its pollution, not all do.<\/p>\n<p><a href=\"http:\/\/www.drexel.edu\/culturecomm\/news\/archive\/not-just-the-koch-brothers-brulle\/\">Drexel University Professor Robert Brulle<\/a> reviewed IRS data from 2003 to 2010 and found a web of entities investing over $900 million annually in organizations dedicated to obstructing climate progress and fighting the deployment of safe, clean energy in America.<\/p>\n<p>If you take a closer look at those specific organizations identified in <a href=\"http:\/\/www.drexel.edu\/culturecomm\/news\/archive\/not-just-the-koch-brothers-brulle\/\">Brulle\u2019s study<\/a>, you\u2019ll find that several of them are involved<b> <\/b>\u2013 now \u2013<b> <\/b>in extensive efforts to obstruct climate and clean energy progress under the nation\u2019s clean air laws and leading state programs.<\/p>\n<p>Take a look at these examples:<\/p>\n<p><b>The Landmark Legal Foundation<\/b>, Competitive Enterprise Institute and FreedomWorks all just <a href=\"http:\/\/www.americanbar.org\/publications\/preview_home\/12-1146-12-1248-12-1254-12-1268-12-1269-12-1272.html\">filed briefs before the U.S. Supreme Court<\/a> challenging the Clean Air Act\u2019s requirement that, at the time of their design and construction, large industrial sources deploy cost-effective modern pollution control technologies to mitigate their climate pollution.<\/p>\n<p>In its challenge to clean air measures for climate pollution, the <a href=\"http:\/\/www.americanbar.org\/content\/dam\/aba\/publications\/supreme_court_preview\/briefs-v3\/12-1268_pet_slf.authcheckdam.pdf\">Competitive Enterprise Institute and FreedomWorks brief<\/a> (filed along with Southeastern Legal Foundation) relies extensively &#8212; and chillingly &#8212; on the tobacco industry case <i>FDA v.\u00a0Brown &amp; Williamson Tobacco Corp. <\/i>and the legal attacks on\u00a0our nation\u2019s efforts to eliminate the scourge of youth tobacco addiction:<\/p>\n<blockquote><p>The Court\u2019s approach to FDA\u2019s assertion of regulatory authority over tobacco products has direct relevance in the present case and should control the outcome here.<\/p><\/blockquote>\n<p>(That\u2019s from page 7 of <a href=\"http:\/\/www.americanbar.org\/content\/dam\/aba\/publications\/supreme_court_preview\/briefs-v3\/12-1268_pet_slf.authcheckdam.pdf\">their brief<\/a>. The Supreme Court has already considered &#8211; and rejected &#8211; this misguided legal attack in the context of EPA&#8217;s authority to regulate climate pollution.)<\/p>\n<p><b>Earlier this year<\/b>, the Landmark Legal Foundation <a href=\"http:\/\/www.edf.org\/sites\/default\/files\/Landmark%20Legal%20Amici_Southeastern%20Legal_No12_1268.pdf\">unsuccessfully asked the U.S. Supreme Court<\/a> to review EPA\u2019s science-based determination that six greenhouse gases endanger the health and welfare of current and future generations. They tried to challenge EPA\u2019s determination, anchored in extensive science reflecting decades of research, by\u00a0ridiculously questioning whether this finding is a \u201cscientific judgment.\u201d (see page 11 of <a href=\"http:\/\/www.edf.org\/sites\/default\/files\/Landmark%20Legal%20Amici_Southeastern%20Legal_No12_1268.pdf\">their brief<\/a>)<\/p>\n<p><b>The Competitive Enterprise Institute<\/b> also litigated to overturn New York Republican Governor George Pataki\u2019s leading efforts to cap and reduce the climate pollution from fossil fuel power plants in New York and to participate in a broader regional pollution control program, the Regional Greenhouse Gas Initiative.<\/p>\n<p>On December 5<sup>th<\/sup>, <a href=\"http:\/\/caselaw.findlaw.com\/ny-supreme-court\/1651616.html\">New York\u2019s appellate court<\/a> affirmed the decision of the state\u2019s trial court firmly rejecting these legal attacks.<\/p>\n<p>In <a href=\"http:\/\/www.drexel.edu\/culturecomm\/news\/archive\/not-just-the-koch-brothers-brulle\/\">his study<\/a>, Brulle also chronicles the \u201cevidence of a trend toward concealing the sources of [climate obstructionism] funding through the use of donor directed philanthropies\u201d such as the Donors Trust.<\/p>\n<p>A closer look at <a href=\"http:\/\/www.eri-nonprofit-salaries.com\/index.cfm?FuseAction=NPO.Form990&amp;EIN=522166327&amp;Year=2012\">funding by the Donors Trust<\/a> through its most recent IRS Form 990 (2011) indicates $1,189,730 in grant funding provided to an organization called the Committee for a Constructive Tomorrow (CFACT).\u00a0 <a href=\"http:\/\/www.cfact.org\/\">CFACT is a major outlet for climate denialism<\/a>.<\/p>\n<p><b>CFACT, too, just <\/b>filed a <a href=\"http:\/\/www.americanbar.org\/content\/dam\/aba\/publications\/supreme_court_preview\/briefs-v2\/12-1272_pet_amicus_commt_constructive_tomorrow.authcheckdam.pdf\">brief with the U.S. Supreme Court<\/a> in which it asserts that the overwhelming scientific consensus on human-induced climate change is \u201ctenuous, biased, inaccurate, incomplete, unsupported by actual observations, and lacking in scientific integrity.\u201d<\/p>\n<p>The recent scientific findings of the world\u2019s leading scientists set out in the <a href=\"http:\/\/www.climate2013.org\/images\/uploads\/WGI_AR5_SPM_brochure.pdf\">Fifth Assessment Report of the Intergovernmental Panel on Climate Change<\/a> found that\u00a0climate change\u00a0is unequivocal and\u00a0its impacts are unprecedented and profound.<\/p>\n<p><b>Another organization that has received support from the Donors Trust<\/b> according to the Trust\u2019s IRS Form 990 (2011) is the Judicial Education Project.<\/p>\n<p>They also just <a href=\"http:\/\/www.americanbar.org\/content\/dam\/aba\/publications\/supreme_court_preview\/briefs-v2\/12-1272_pet_amicus_admin_law_prof.authcheckdam.pdf\">filed a brief with the U.S. Supreme Court<\/a> challenging the federal government\u2019s authority to regulate greenhouse gas emissions from the nation\u2019s largest sources of such pollution. The brief alleges that the Environmental Protection Agency exceeded its authority under the U.S. Supreme Court\u2019s 2007 landmark case, <i>Massachusetts v. EPA<\/i>, in which the Court stated that the \u201charms associated with climate change are serious and well recognized.\u201d<\/p>\n<p><b>Earlier this year, the Mercatus Center<\/b> &#8212; another group identified by <a href=\"http:\/\/www.drexel.edu\/culturecomm\/news\/archive\/not-just-the-koch-brothers-brulle\/\">Brulle\u2019s research<\/a> &#8212; <a href=\"http:\/\/mercatus.org\/sites\/default\/files\/Mulholland_EPA_PIC_062813_0.pdf\">submitted adverse comments<\/a> on proposed clean air standards for cars and gasoline by calling into question the extensive body of peer reviewed science linking particulate pollution and mortality.<\/p>\n<p>It is well documented that these clean air standards for cars and gasoline will provide healthier, longer lives. They have also won the support of diverse interests, including the American Lung Association and the U.S. auto industry, because of the dual benefits of reducing health-harming pollutants and enabling more efficient clean car technologies.<\/p>\n<p><b>Recently, the Landmark Legal Foundation joined by the Cato Institute<\/b> &#8212; both groups identified in <a href=\"http:\/\/www.drexel.edu\/culturecomm\/news\/archive\/not-just-the-koch-brothers-brulle\/\">Brulle\u2019s research<\/a> &#8212; challenged the Department of Energy\u2019s adoption of improved appliance efficiency standards for microwaves.<\/p>\n<p>The microwave standards will lead to less energy use, consumer cost savings and pollution reductions. Landmark Legal Foundation and the Cato Institute objected to DOE\u2019s consideration of the societal benefits of mitigating carbon pollution. Patrick Michaels, a well-known climate denialist, co-authored the <a href=\"http:\/\/object.cato.org\/sites\/cato.org\/files\/pubs\/pdf\/michaels_knappenberger_cato_comments.pdf\">Cato comments<\/a>. <a href=\"http:\/\/www.landmarklegal.org\/uploads\/llf_reconsideration_petition.pdf\">Landmark asked<\/a> DOE to immediately halt implementation and rescind the Rule.<\/p>\n<p><a href=\"http:\/\/www.landmarklegal.org\/uploads\/llf_reconsideration_petition.pdf\">DOE has denied the request<\/a> to upend these common sense energy conservation standards for our nation.<\/p>\n<p><b>And it is not surprising that Peabody Coal Company<\/b>, too, has <a href=\"http:\/\/www.americanbar.org\/publications\/preview_home\/12-1146-12-1248-12-1254-12-1268-12-1269-12-1272.html\">just filed a brief<\/a> in the U.S. Supreme Court objecting to the Clean Air Act requirement that our nation\u2019s largest industrial emitters use modern pollution controls to mitigate climate pollution.<\/p>\n<p>Peabody\u2019s brief begins by asserting\u00a0that \u201c[w]hether and how to regulate GHGs [greenhouse gases] remains a highly debated, contentious issue in Congress, agencies and the courts.\u201d (Page 2 of <a href=\"http:\/\/www.americanbar.org\/publications\/preview_home\/12-1146-12-1248-12-1254-12-1268-12-1269-12-1272.html\">their brief<\/a>)<\/p>\n<p>But <a href=\"http:\/\/www.drexel.edu\/culturecomm\/news\/archive\/not-just-the-koch-brothers-brulle\/\">Brulle\u2019s research<\/a> elucidates how Peabody\u2019s assertion is a tautology. Through massive funding of groups dedicated to climate obstructionism, Brulle documents how climate change remains contentious because there is a vast climate change counter-movement dedicated to making it so:<\/p>\n<blockquote><p>[A] number of conservative think tanks, trade associations, and advocacy organizations are the key organizational components of a well-organized climate change counter-movement (CCCM) that has not only played a major role in confounding public understanding of climate science, but also successfully delayed meaningful government policy actions to address the issue.<\/p><\/blockquote>\n<p>Climate change is happening. The toll exacted from extreme weather &#8212; fueled in part by climate change &#8212;\u00a0on human life and our economy is profound, and reaches from the ravages wrought on New York and New Jersey by Hurricane Sandy to the tragic flooding in the Rockies.<\/p>\n<p>However, the solutions are at hand.<\/p>\n<p>In 2012, <a href=\"http:\/\/energy.gov\/articles\/energy-dept-reports-us-wind-energy-production-and-manufacturing-reaches-record-highs\">wind power<\/a> was \u201cthe number one source of new U.S. electric generation capacity for the first time\u2014representing 43 percent of all new electric additions and accounting for $25 billion in U.S. investment.\u201d<\/p>\n<p>And even more recently, in November 2013, 100 percent \u2013 <b>ALL<\/b> \u2013 of the new electrical power in America <a href=\"http:\/\/cleantechnica.com\/2013\/12\/21\/100-new-power-capacity-us-came-renewable-energy-november-2nd-month-year\/\">came from renewable energy<\/a>.<\/p>\n<p>While Peabody\u2019s stock falls and its rhetoric rises, and while the forces of obstructionism fight clean energy, the winds of change are blowing briskly.<\/p>\n<p><a href=\"http:\/\/www.drexel.edu\/culturecomm\/news\/archive\/not-just-the-koch-brothers-brulle\/\">Brulle\u2019s study<\/a> is a clarion call for moms, dads, grandparents, aunts, and uncles to resolve that in 2014 we will work together to fight for clean air and clean energy for our children &#8212; and for all children.<\/p>\n<p>In spite of a well-funded group of obstructionists, we can prevail.<\/p>\n<p>We can secure climate progress and clean energy for our nation, for our communities and for our future.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A few days ago, the Wall Street Journal reported that Peabody Coal Company is one of the top five worst performing stocks of 2013.
