{"id":25741,"date":"2026-03-06T10:14:35","date_gmt":"2026-03-06T15:14:35","guid":{"rendered":"https:\/\/blogs.edf.org\/climate411\/?p=25741"},"modified":"2026-03-06T12:17:48","modified_gmt":"2026-03-06T17:17:48","slug":"8-things-about-the-trump-administrations-rollback-of-mercury-pollution-protections","status":"publish","type":"post","link":"https:\/\/blogs.edf.org\/climate411\/2026\/03\/06\/8-things-about-the-trump-administrations-rollback-of-mercury-pollution-protections\/","title":{"rendered":"8 things about\u00a0the\u00a0Trump administration\u2019s rollback of mercury pollution protections"},"content":{"rendered":"\n<p>(<em>This post was co-authored by EDF technical analyst&nbsp;<\/em><a href=\"https:\/\/www.edf.org\/people\/grace-hauser\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Grace Hauser<\/em><\/a>)\u202f&nbsp;<\/p>\n\n\n\n<p>The Trump administration&nbsp;just <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2026-02-24\/pdf\/2026-03638.pdf\">finalized&nbsp;its&nbsp;repeal<\/a>&nbsp;of&nbsp;the 2024 Mercury and\u202fAir Toxics Standards\u202f\u2013 a suite of lifesaving protections against highly dangerous air pollution from coal-fired power plants.&nbsp;<\/p>\n\n\n\n<p>That action cancels stronger safeguards against pollution from lignite-fired coal plants, which are among&nbsp;the&nbsp;highest emitters of mercury pollution in the U.S.<\/p>\n\n\n\n<p>It also rolls back protections against other toxic pollutants like arsenic and lead from all coal plants, and reverses a requirement that coal plants&nbsp;use modern monitoring technologies to&nbsp;continuously monitor&nbsp;their&nbsp;toxic pollution.&nbsp;<\/p>\n\n\n\n<p>EDF will go to court to defend the 2024 Mercury and Air Toxics Standards. That\u2019s pollution that <a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2026-02\/ria-mats-final-repeal-of-amendments-2026-02.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">EPA&nbsp;admits<\/a>&nbsp;will increase deposits of&nbsp;mercury&nbsp;in our ecosystems and lead to the accumulation of methylmercury in fish.<\/p>\n\n\n\n<p><a href=\"https:\/\/blogs.edf.org\/climate411\/2026\/03\/06\/new-analysis-shows-a-clear-need-for-stronger-protections-from-coal-plant-mercury-pollution\/\">(Read more findings from our updated map and analysis here)<\/a><\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>The Trump EPA ignores the&nbsp;significant&nbsp;public health&nbsp;costs of repealing the&nbsp;2024 Mercury and Air Toxics Standards&nbsp;<\/strong>&nbsp;<\/li>\n<\/ol>\n\n\n\n<p>The Mercury and Air Toxics Standards guard against mercury, arsenic,\u202fnickel\u202fand other pollutants that can cause brain damage\u202fin\u202fbabies, cancer, and serious heart and lung diseases.&nbsp;&nbsp;<\/p>\n\n\n\n<p>In its rollback, the <a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2026-02\/ria-mats-final-repeal-of-amendments-2026-02.pdf\">Trump EPA claims<\/a> it&nbsp;<em>cannot<\/em>&nbsp;put a dollar value any of the rule&#8217;s health harms.&nbsp;<\/p>\n\n\n\n<p>That\u2019s a stark departure from EPA\u2019s decades-long practice of estimating the health impacts of its rules. And it\u2019s a sudden reversal from the Trump EPA\u2019s own proposal for the rollback \u2014 which <a href=\"https:\/\/nam11.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.regulations.gov%2Fdocument%2FEPA-HQ-OAR-2018-0794-6996&amp;data=05%7C02%7Csstein%40edf.org%7Cf7cf3030bfd742e02ff808de7a3f613e%7Cfe4574edbcfd4bf0bde843713c3f434f%7C0%7C0%7C639082609812612209%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=ld2ysA1NpgDDwtaOeE04dDteAy8sHfJeMSIIXsxDPRU%3D&amp;reserved=0\">monetized<\/a>&nbsp;the lost benefits of&nbsp;reducing just some of the pollutants affected by the rule&nbsp;at <strong>$340 million<\/strong>.<\/p>\n\n\n\n<p>The Trump EPA&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2026-02-24\/pdf\/2026-03638.pdf\">announced in its final rule<\/a> that it will no longer calculate the monetary value of the lives saved and illnesses avoided from reducing fine particulate matter and ozone. The agency <a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2026-02\/ria-mats-final-repeal-of-amendments-2026-02.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">conducted<\/a>&nbsp;the air quality modeling and health impact analysis, but then chose not to present it or rely on its resulting dollar values, citing newly-claimed \u201cuncertainties\u201d &nbsp;that did not prevent them from monetizing these same impacts just months earlier. The Trump EPA also failed to consider the cost of health harms from mercury pollution itself.<\/p>\n\n\n\n<p>By continuing to quantify compliance costs for industry while refusing to quantify health costs the Trump EPA has skewed the cost-benefit analysis in favor of eliminating safeguards for our health.<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>Independent researchers estimate at least $200 million per year in health harms from increases in mercury pollution<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Unlike the Trump EPA, independent researchers <em>have<\/em> estimated the cost of health harms from mercury pollution.<\/p>\n\n\n\n<p>A\u202f<a href=\"https:\/\/www.regulations.gov\/comment\/EPA-HQ-OAR-2018-0794-7353\" target=\"_blank\" rel=\"noreferrer noopener\">2025 analysis<\/a>\u202fby Harvard University estimated\u202fthe health costs of&nbsp;repealing the&nbsp;2024 mercury standard would be\u202f<strong>$200 million per year <\/strong>\u2013 <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2026-02-24\/pdf\/2026-03638.pdf\">more than two-and-a-half times<\/a> the Trump EPA\u2019s own estimated savings from the&nbsp;entirerepeal.&nbsp;<\/p>\n\n\n\n<p>The costs are\u202fdue to reductions in children\u2019s IQ levels and to premature deaths from heart and lung disease, both of which are caused by an increase in mercury pollution.&nbsp;These harms fall most heavily on&nbsp;subsistence&nbsp;fishers and their children, whom <a href=\"https:\/\/downloads.regulations.gov\/EPA-HQ-OAR-2018-0794-6966\/content.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">EPA previously&nbsp;found<\/a>&nbsp;are more likely to be&nbsp;racial minorities and&nbsp;low-income&nbsp;families who would most benefit from reducing mercury in fish.<\/p>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li><strong>EPA\u2019s repeal&nbsp;reopens&nbsp;the&nbsp;dangerous&nbsp;lignite coal loophole<\/strong>&nbsp;<\/li>\n<\/ol>\n\n\n\n<p>Lignite coal is one of the dirtiest types of coal to burn. It&nbsp;contains&nbsp;higher levels of mercury and other&nbsp;toxics than other types of coal,&nbsp;and more lignite coal must be burned to generate power compared to other types of coal, which then produces even more emissions.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Before the 2024 Mercury and Air Toxics Standards, lignite coal plants were allowed to release more than<strong>&nbsp;<em>three times<\/em><\/strong>&nbsp;as much mercury as other coal plants.&nbsp;Some coal plants took advantage of this loophole, burning a small amount of lignite coal and claiming to be subject entirely to the lax standards.<\/p>\n\n\n\n<p>The 2024 Mercury and Air Toxics Standards closed this loophole, and required lignite plants to meet the same mercury pollution standard that all other coal plants have been subject to since 2012.&nbsp;<\/p>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li><strong>EPA\u2019s repeal weakens pollution monitoring<\/strong><\/li>\n<\/ol>\n\n\n\n<p>The 2024 Mercury and Air Toxics Standards required continuous emissions monitoring systems for coal plants \u2014 modern technology that provides real-time data about emissions \u2014 to\u202fensure\u202fcompliance with limits for toxic pollutants.<\/p>\n\n\n\n<p>Under the Trump EPA\u2019s repeal, coal plants will be&nbsp;allowed&nbsp;to&nbsp;conduct short&nbsp;monitoring tests&nbsp;much more infrequently \u2013 four times a year, for some, or as infrequently as <em>once every three years<\/em>.&nbsp;<\/p>\n\n\n\n<p>In other words, the Trump EPA is charting the way for&nbsp;these&nbsp;large emitters of&nbsp;arsenic,&nbsp;lead&nbsp;and similar toxic metals&nbsp;to obscure their pollution levels&nbsp;almost every&nbsp;day of the year instead of&nbsp;requiring transparent continuous&nbsp;monitoring of their toxic pollution&nbsp;based on accessible, widely available technologies.&nbsp;<\/p>\n\n\n\n<ol start=\"6\" class=\"wp-block-list\">\n<li><strong>The&nbsp;2024 Mercury and Air Toxics Standards&nbsp;are achievable and&nbsp;reasonable in cost&nbsp;using\u202fproven,\u202fwidely-used&nbsp;pollution control technologies<\/strong><\/li>\n<\/ol>\n\n\n\n<p>In 2024, <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2024-05-07\/pdf\/2024-09148.pdf\">EPA found<\/a> that power plants that burn lignite coal could lower\u202ftheir mercury emissions to the levels allowed for all other coal plants\u202fjust by using more of the same chemical additives they&nbsp;<em>already&nbsp;<\/em>use\u202fto control\u202fmercury pollution.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2024-05-07\/pdf\/2024-09148.pdf\">The agency also found<\/a> that coal plants can readily meet stronger limits for nickel, arsenic, lead and other toxic pollution by using widely-available&nbsp;controls that many coal plant owners have already installed. In fact, they found that 93% of the U.S. coal fleet is already meeting the more protective 2024 Mercury and Air Toxics Standards, and most of the other 7% can meet the standards through relatively simple upgrades.<\/p>\n\n\n\n<p>EPA also found that the continuous monitoring systems needed to meet the 2024 Mercury and Air Toxics Standards are in widespread use and are only marginally more costly than the previous antiquated requirements.&nbsp;One-third of the U.S. coal fleet\u202fis&nbsp;<em>already<\/em>&nbsp;using continuous emissions monitoring systems.\u202f&nbsp;<\/p>\n\n\n\n<ol start=\"7\" class=\"wp-block-list\">\n<li><strong>EPA\u2019s weakening&nbsp;of&nbsp;coal plant standards&nbsp;is occurring&nbsp;alongside&nbsp;a rise in coal generation<\/strong>&nbsp;<\/li>\n<\/ol>\n\n\n\n<p><a href=\"https:\/\/rhg.com\/research\/us-greenhouse-gas-emissions-2025\/?_gl=1*a9vkcp*_up*MQ..*_ga*MTE5NTQ0NzY2MC4xNzY5MDY1MzU4*_ga_F07XZRB69B*czE3NjkwNjUzNTgkbzEkZzAkdDE3NjkwNjUzNTgkajYwJGwwJGgw\" target=\"_blank\" rel=\"noreferrer noopener\">Recent&nbsp;analysis<\/a>&nbsp;of 2025 energy sector trends shows that, for the first time in years,&nbsp;U.S.&nbsp;coal generation&nbsp;is&nbsp;increasing<strong>.&nbsp;<\/strong>This&nbsp;trend&nbsp;isoccurring simultaneously with&nbsp;increased&nbsp;<a href=\"https:\/\/www.iea.org\/reports\/energy-and-ai\/executive-summary\">data center power demand<\/a>&nbsp;(and&nbsp;concern that&nbsp;<a href=\"https:\/\/www.law.georgetown.edu\/environmental-law-review\/blog\/consumers-end-up-paying-for-the-energy-demands-of-data-centers-how-can-regulators-fight-back\/\">consumers will&nbsp;end up paying the tab<\/a>&nbsp;for it).<\/p>\n\n\n\n<p>Pollution standards based on modern control technologies are more important than ever considering this reality.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Notably, the <a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2026-02\/ria-mats-final-repeal-of-amendments-2026-02.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Trump EPA&#8217;s own&nbsp;modeling<\/a>&nbsp;for its final repeal of the 2024 Mercury and Air Toxics Standards shows that the repeal has <em>zero impact<\/em> on coal plant retirements, total capacity, electricity generation&nbsp;mix,&nbsp;and&nbsp;retail&nbsp;electricity prices \u2014 undermining <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2026-02-24\/pdf\/2026-03638.pdf\">the administration&#8217;s claim<\/a>&nbsp;that the repeal is needed for grid reliability and energy security.&nbsp;In fact, EPA&nbsp;<a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2026-02\/ria-mats-final-repeal-of-amendments-2026-02.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">projects<\/a>&nbsp;36 gigawatts of coal plant retirements by 2035 <em>regardless<\/em> of whether the 2024 Mercury and Air Toxics Standards are in place.<\/p>\n\n\n\n<ol start=\"8\" class=\"wp-block-list\">\n<li><strong>Repealing the&nbsp;2024 Mercury and Air Toxics Standards&nbsp;follows many other steps the Trump administration has taken to prop up the coal industry<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Repealing the standards&nbsp;is another&nbsp;in&nbsp;a long&nbsp;line&nbsp;of&nbsp;Trump administration giveaways for the coal industry.<\/p>\n\n\n\n<p>They include newly-announced&nbsp;<a href=\"https:\/\/nam11.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.energy.gov%2Farticles%2Fenergy-department-announces-175-million-modernize-coal-plants-keeping-affordable-reliable&amp;data=05%7C02%7Cghauser%40edf.org%7Cdc3772758414481fb9f508de700e2371%7Cfe4574edbcfd4bf0bde843713c3f434f%7C0%7C0%7C639071403199230744%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=vbT0Z%2FX05%2BaNTpCWosTsGrOylMaRhwObnfb2wth09SA%3D&amp;reserved=0\"
