administration\u00a0to be in violation of its climate law\u00a0for\u00a0failing to put\u00a0in place regulations that would achieve the state\u2019s emissions limits.\u00a0Just days after\u00a0the court\u2019s ruling,\u00a0Governor Kathy\u00a0Hochul\u00a0<\/span><a href=\"https:\/\/www.mychamplainvalley.com\/video\/hochul-talks-clcpa\/11206495\/\"><span data-contrast=\"none\">signaled\u00a0her intent to appeal<\/span><\/a><span data-contrast=\"auto\">,\u00a0citing\u00a0affordability\u00a0concerns as the primary\u00a0impediment\u00a0to advancing\u00a0the state\u2019s climate goals.<\/span><\/p>\n<p><span data-contrast=\"auto\">But\u00a0robust evidence\u00a0in New York\u00a0and experience\u00a0from\u00a0other states shows that\u00a0the choice\u00a0between climate action and affordability is a false\u00a0one.\u00a0By moving\u00a0forward with\u00a0cap-and-invest\u00a0\u2014\u00a0a\u00a0powerful\u00a0and flexible\u00a0policy\u00a0tool\u00a0\u2014\u00a0Governor Hochul\u00a0can\u00a0deliver on\u00a0both.<\/span><\/p>\n<p><!--more--><\/p>\n<h3><b><span data-contrast=\"auto\">Court\u00a0directs\u00a0Hochul\u00a0administration\u00a0to\u00a0implement\u00a0the\u00a0Climate Act<\/span><\/b><\/h3>\n<p><span data-contrast=\"auto\">On October 24, 2025, the Albany County Supreme Court found that New York\u2019s Department of Environmental Conservation (DEC) violated the\u00a0state\u2019s Climate Leadership and Community Protection Act (CLCPA\u202for \u201cClimate\u202fAct\u201d)\u00a0by\u00a0failing to issue\u00a0regulations\u00a0to ensure compliance\u00a0with the law\u2019s\u00a0climate\u00a0targets.\u00a0The case was decided following a\u00a0<\/span><a Justice.<\/span><\/p>\n<p><span data-contrast=\"auto\">Environmental Defense Fund,\u202fwith Riverkeeper and Save the Sound,\u202f<\/span><a data-contrast=\"none\">submitted an amicus<\/span><\/a><span data-contrast=\"auto\">\u202fbrief,\u00a0outlining\u00a0that existing regulations were insufficient to\u202fmeet\u202fthe Climate Act\u2019s emission\u00a0reduction\u00a0requirements\u00a0and\u00a0that\u202fDEC\u00a0had failed\u202fto prioritize\u00a0reducing greenhouse gas and local air pollution\u00a0in\u202fdisadvantaged\u202fcommunities,\u00a0as the law mandates.<\/span><\/p>\n<p><span data-contrast=\"auto\">Governor\u00a0Hochul\u00a0has\u00a0indicated\u00a0that her administration\u00a0is\u00a0preparing to\u00a0challenge\u00a0the court\u2019s ruling,\u00a0which underscores the\u00a0unambiguous\u00a0nature of the Climate Act\u2019s\u00a0requirements.\u00a0The\u00a0<\/span><a href=\"https:\/\/iapps.courts.state.ny.us\/nyscef\/ViewDocument?docIndex=FEzm4YEJZtD8smn0\/gel2A==\"><span data-contrast=\"none\">order<\/span><\/a><span data-contrast=\"auto\"> states, \u201calthough more than 18 months have elapsed since [the] statutory deadline passed, it is undisputed that DEC has not issued regulations that comply with the [&#8230;] terms of the Climate Act.\u201d The order further notes that given DEC\u2019s clear mandate to put in place regulations, \u201cDEC does not have the discretion to say no or to decide that it has the authority to choose not to follow the express legislative directive at issue.\u201d<\/span><\/p>\n<p><span data-contrast=\"auto\">There\u2019s no disagreement that New Yorkers\u00a0need relief from\u00a0increasing\u00a0energy costs,\u00a0and this is\u00a0precisely why\u00a0Governor Hochul\u00a0needs\u00a0to\u00a0lean in rather than step back,\u00a0implementing\u00a0policies that\u00a0can lower energy burdens for households\u00a0and\u00a0push back\u00a0against\u00a0the\u00a0Trump administration\u2019s\u00a0attempts to\u00a0lock communities into\u00a0outdated, expensive, and polluting fossil fuels.\u00a0<\/span><b><span data-contrast=\"auto\">Now is the moment for leadership: it\u2019s time to put state government resources back to work on solutions instead of further efforts to delay.<\/span><\/b><\/p>\n<h3><b><span data-contrast=\"auto\">New\u00a0Yorkers\u00a0cannot\u00a0afford\u00a0further\u00a0delay\u00a0on\u00a0the Clean Air Initiative<\/span><\/b><\/h3>\n<p><span data-contrast=\"auto\">If well designed,\u00a0the\u00a0<\/span><a href=\"https:\/\/capandinvest.ny.gov\/\"><span data-contrast=\"none\">Clean Air Initiative<\/span><\/a><span data-contrast=\"auto\"> \u2014\u00a0New York\u2019s proposed cap-and-invest program\u00a0\u2014\u00a0can\u00a0cut\u00a0climate and air\u00a0pollution\u00a0at a\u00a0pace and scale that meets the requirements of state law\u00a0while\u00a0putting money back in\u00a0working families\u2019\u00a0pockets\u00a0and\u00a0investing in affordable clean energy and\u00a0healthy,\u00a0resilient communities.<\/span><\/p>\n<p><span data-contrast=\"auto\">At its core,\u00a0<\/span><b><span data-contrast=\"auto\">Cap-and-Invest is built to\u00a0benefit\u00a0communities:<\/span><\/b><span data-contrast=\"auto\">\u00a0It makes polluters pay for their harmful emissions and directs those dollars to households.<\/span><\/p>\n<p><span data-contrast=\"auto\">As a result of the Hochul administration&#8217;s\u00a0<\/span><a href=\"https:\/\/nam11.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.edf.org%2Fmedia%2Fgovernor-hochul-delays-cap-and-invest-program-withholding-billions-benefits-climate-targets&amp;data=05%7C02%7Cngoodman%40edf.org%7C3bc1e25d31fe4932cfdf08de176c7933%7Cfe4574edbcfd4bf0bde843713c3f434f%7C0%7C0%7C638973951879568228%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=cYS%2FrxcJvLHQlWomWUyOYWWyQG3ZbA3nGTl3JjD%2BPb0%3D&amp;reserved=0\"><span data-contrast=\"none\">decision to delay<\/span><\/a><span data-contrast=\"auto\">\u00a0the Clean Air Initiative, the state has\u00a0<\/span><i><span data-contrast=\"auto\">already<\/span><\/i><span data-contrast=\"auto\">\u00a0missed out on an estimated\u00a0<\/span><b><span data-contrast=\"auto\">$3 billion\u00a0or more in investments<\/span><\/b><span data-contrast=\"auto\">\u00a0that could be helping communities and households\u00a0right now\u00a0access cleaner, cheaper energy today, including over\u00a0$1 billion\u00a0that could have\u00a0already\u00a0been directly returned to New Yorkers to lower energy bills\u00a0under the\u00a0<\/span><a href=\"https:\/\/capandinvest.ny.gov\/-\/media\/Project\/CapInvest\/Files\/2024-01-26-NYCI-Preproposal-Analysis-Webinar.pdf\"><span data-contrast=\"none\">Administration\u2019s original plan<\/span><\/a><span data-contrast=\"auto\">.<\/span><\/p>\n<p><span data-contrast=\"auto\">Analysis\u00a0of the Clean Air Initiative\u00a0shows<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-contrast=\"auto\">that,\u00a0with\u00a0smart policy design,\u00a0most\u00a0New York\u00a0households\u00a0see\u00a0cost\u00a0savings\u00a0under the program.\u00a0A study\u00a0from\u00a0<\/span><a href=\"https:\/\/www.rff.org\/publications\/reports\/analyzing-affordability-supporting-households-under-new-yorks-cap-trade-and-invest-policy\/\"><span data-contrast=\"none\">Resources for the Future and the NYC Environmental Justice Alliance<\/span><\/a><span data-contrast=\"auto\">\u00a0shows that\u00a0by\u00a0allocating\u00a0money raised from polluters via dividends,\u00a0<\/span><b><span data-contrast=\"auto\">nearly\u00a0all\u00a0households earning up to $200,000 per year\u00a0\u2014\u00a0which accounts for\u00a0about<\/span><\/b><span data-contrast=\"auto\">\u00a0<\/span><b><span data-contrast=\"auto\">85% of New York\u2019s households\u00a0\u2014\u00a0would see net savings under the program<\/span><\/b><span data-contrast=\"auto\">.<\/span><\/p>\n<p><span data-contrast=\"auto\">These savings grow as\u00a0families\u00a0electrify\u00a0their homes\u00a0and vehicles\u00a0or adopt energy efficiency\u00a0upgrades,\u00a0actions\u00a0which are\u00a0made\u00a0cheaper and easier\u00a0by the\u00a0policy.\u00a0For\u00a0example,\u00a0a\u00a0study\u00a0by Switchbox commissioned by EDF and partners\u00a0finds that\u00a0cap-and-invest could help 46% of New York households\u00a0transition\u00a0to clean, efficient heat\u00a0pumps by 2035,\u00a0<\/span><a href=\"https:\/\/switchbox-data.github.io\/reports\/nyci\/\"><span data-contrast=\"none\">saving the average household up to $1,022\u00a0annually<\/span><\/a><span data-contrast=\"auto\">. And the study found that more ambitious versions of the program, which increased allowance prices paid by polluters, actually would result in more households experiencing these savings.<\/span><\/p>\n<p><span data-contrast=\"auto\">As the Trump administration obstructs clean energy projects and doubles-down on expensive fossil fuel infrastructure, New York has a critical opportunity to secure cheaper, cleaner energy for its residents with the Clean Air Initiative.<\/span><\/p>\n<h3><b><span data-contrast=\"auto\">Leading\u00a0states\u00a0are\u00a0demonstrating\u00a0that\u00a0cutting\u00a0costs\u00a0and\u00a0cutting pollution\u00a0go\u00a0hand-in-hand\u00a0<\/span><\/b><span data-ccp-props=\"{}\">\u00a0<\/span><\/h3>\n<p><span data-contrast=\"auto\">Across the country,\u00a0regional and state-level\u00a0cap-and-invest programs are\u00a0further\u00a0illustrating\u00a0that affordability and ambitious climate action\u00a0go\u00a0hand-in-hand.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"none\">California\u2019s\u00a0cap-and-invest\u00a0program<\/span><\/b><span data-contrast=\"none\">\u00a0alone has generated over\u00a0<\/span><a href=\"https:\/\/www.gov.ca.gov\/2025\/05\/07\/state-invests-nearly-33-billion-in-cap-and-trade-dollars-to-make-communities-cleaner-and-healthier\/\"><span data-contrast=\"none\">$30 billion\u00a0in climate and community investments<\/span><\/a><span data-contrast=\"none\">\u00a0since 2013 and directed\u00a0<\/span><a href=\"https:\/\/www.cpuc.ca.gov\/industries-and-topics\/natural-gas\/greenhouse-gas-cap-and-trade-program\"><span data-contrast=\"none\">$16 billion\u00a0to reduce household energy costs<\/span><\/a><span data-contrast=\"none\">\u00a0through utility bill credits. As a result, the\u00a0<\/span><a href=\"https:\/\/www.gov.ca.gov\/2025\/09\/12\/what-theyre-saying-overwhelming-support-for-historic-climate-and-energy-affordability-legislation\/\"><span data-contrast=\"none\">legislature voted<\/span><\/a><span data-contrast=\"none\">\u00a0to extend\u00a0the program in September 2025, with Governor Newsom highlighting Cap &amp; Invest as a\u00a0<\/span><a href=\"https:\/\/www.gov.ca.gov\/2025\/07\/17\/icymi-287000-jobs-and-55-billion-in-economic-growth-on-the-line-with-key-climate-programs-extension\/\"><span data-contrast=\"none\">tool to address affordability<\/span><\/a><span data-contrast=\"none\">.<\/span><\/p>\n<p><a href=\"https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/\/IMG_2212-scaled-1.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-25204\" src=\"https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/\/IMG_2212-scaled-1.jpeg\" alt=\"Governor Newsom signing cap-and-invest extension\" width=\"2560\" height=\"1707\" srcset=\"https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/IMG_2212-scaled-1.jpeg 2560w, https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/IMG_2212-scaled-1-300x200.jpeg 300w, https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/IMG_2212-scaled-1-1024x683.jpeg 1024w, https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/IMG_2212-scaled-1-768x512.jpeg 768w, https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/IMG_2212-scaled-1-1536x1024.jpeg 1536w, https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/IMG_2212-scaled-1-2048x1366.jpeg 2048w\" sizes=\"auto, (max-width: 2560px) 100vw, 2560px\" \/><\/a><\/p>\n<p><span data-contrast=\"none\">In\u00a0<\/span><a href=\"https:\/\/www.gov.ca.gov\/2025\/09\/19\/governor-newsom-signs-historic-package-of-bipartisan-legislation-saving-billions-on-electric-bills-stabilizing-gas-market-and-cutting-pollution\/\"><span data-contrast=\"none\">signing<\/span><\/a><span data-contrast=\"none\">\u00a0the bill, Governor Newsom said:<\/span><\/p>\n<p><i><span data-contrast=\"none\">\u201cI just signed into law the biggest electricity bill refunds in a decade \u2014 up to\u00a0$60 billion\u00a0to help bring down costs for California families [\u2026] we\u2019re doubling down on our best tool to combat\u00a0Trump\u2019s assaults on clean air\u00a0\u2014\u00a0Cap-and-Invest\u00a0\u2014\u00a0by making polluters pay for projects that support our most impacted communities.\u201d<\/span><\/i><\/p>\n<p><span data-contrast=\"auto\">The\u00a0reauthorized\u00a0program is\u00a0projected to\u00a0save California\u2019s most economically vulnerable families\u00a0<\/span><a href=\"https:\/\/www.greenlineinsights.com\/investments-for-californias-future\"><span data-contrast=\"none\">$3.9 billion\u00a0between 2031 and 2045<\/span><\/a><span data-contrast=\"auto\">. It is also projected to create 287,000 new jobs and generate $55 billion in statewide economic growth.<\/span><\/p>\n<p><b><span data-contrast=\"auto\">The\u00a0Northeast\u2019s\u00a0Regional Greenhouse Gas Initiative (RGGI)\u00a0<\/span><\/b><span data-contrast=\"auto\">\u2014\u00a0a cap-and-invest\u00a0program\u00a0for power\u00a0plants\u00a0operating\u00a0across\u00a0ten states\u00a0\u2014\u00a0has\u00a0for over a decade delivered\u00a0consumer savings\u00a0while cutting emissions from power\u00a0plants\u00a0nearly in\u00a0half. Since the program\u2019s\u00a0inception, over\u00a0$9 billion\u00a0in investments\u00a0in\u00a0<\/span><span data-contrast=\"none\">energy bill\u00a0assistance\u00a0programs, energy efficiency and clean energy<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"none\">are projected to\u00a0<\/span><a href=\"https:\/\/www.rggi.org\/sites\/default\/files\/Uploads\/Press-Releases\/Press_Release_Program_Review_Announcement.pdf\"><span data-contrast=\"none\">save families and businesses an estimated\u00a0$20 billion<\/span><span data-contrast=\"none\">.<\/span><\/a><\/p>\n<h3><b><span data-contrast=\"auto\">Voters\u00a0support\u00a0cap-and-invest\u00a0policies\u00a0that\u00a0are\u00a0delivering\u00a0cleaner,\u00a0cheaper\u00a0energy<\/span><\/b><\/h3>\n<p><span data-contrast=\"auto\">Earlier this month, voters in Virginia and New Jersey\u00a0elected Governors\u00a0by wide margins\u00a0who committed to\u00a0keeping their states part of\u00a0RGGI, defeating\u00a0candidates actively campaigning against\u00a0the program.<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Virginia\u00a0Governor-elect\u00a0Abigail Spanberger\u00a0supported the state rejoining\u00a0RGGI as part of her platform to\u00a0<\/span><\/b><a href=\"https:\/\/abigailspanberger.com\/wp-content\/uploads\/2025\/06\/Spanberger_EnergyAffordabilityPlan_L4.pdf?utm_source=Spanberger+for+Governor+Press+List&amp;utm_campaign=10313b826c-EMAIL_CAMPAIGN_2025_06_09_07_05&amp;utm_medium=email&amp;utm_term=0_-10313b826c-506626301\"><b><span data-contrast=\"none\">make energy bills more affordable<\/span><\/b><\/a><span data-contrast=\"auto\">,\u00a0emphasizing the value of investments from the program in driving cost-saving energy efficiency programs.\u00a0\u201cIt\u2019s\u00a0not only important to the goal of reducing our state\u2019s emissions and meeting some clean-energy goals\u00a0(\u2026)\u00a0but\u00a0it\u2019s\u00a0also unbelievably valuable for our ability to use this revenue to make investments in our community,\u201d<\/span><span data-contrast=\"none\">\u00a0<\/span><a href=\"https:\/\/www.offthepress.com\/the-carbon-tax-taking-center-stage-in-virginias-2025-gubernatorial-race\/\"><span data-contrast=\"none\">Spanberger said<\/span><\/a><span data-contrast=\"none\">.\u00a0<\/span><span data-contrast=\"auto\">Spanberger\u00a0defeated\u00a0her opponent, a vocal opponent of RGGI, by\u00a0roughly\u00a015\u00a0points\u00a0\u2014\u00a09 points\u00a0more than\u00a0Kamala\u00a0Harris\u2019s\u00a0margin of victory in the state in\u00a02024.<\/span><\/p>\n<p><span data-contrast=\"auto\">In New Jersey, clean and affordable energy likewise played a critical role in the recent gubernatorial race. Governor-elect Mikie Sherrill defeated her opponent \u2014 who pledged to pull New Jersey out of RGGI \u201con day one\u201d \u2014 by more than 14 points.<\/span><\/p>\n<p><b><span data-contrast=\"none\">In\u00a0Washington,\u00a0voters successfully\u00a0<\/span><\/b><a href=\"https:\/\/washingtonstatestandard.com\/2024\/11\/05\/voters-rejecting-measure-to-repeal-landmark-washington-climate-law\/\"><b><span data-contrast=\"none\">defended their\u00a0cap-and-invest\u00a0program<\/span><\/b><\/a><b><span data-contrast=\"none\">\u00a0on the ballot in 2024,<\/span><\/b><span data-contrast=\"none\">\u00a0<\/span><b><span data-contrast=\"none\">beating a repeal attempt by a 24-point margin<\/span><\/b><span data-contrast=\"auto\">. An\u00a0<\/span><a href=\"https:\/\/waconservationaction.org\/wca-and-coalition-defeat-2117\/\"><span data-contrast=\"none\">unprecedented\u00a0coalition of over 500<\/span><\/a><span data-contrast=\"auto\">\u00a0organizations\u00a0including labor unions,\u00a0major\u00a0businesses, Tribes,\u00a0community\u00a0groups\u00a0and\u00a0environmental groups successfully defended one of the nation\u2019s most ambitious climate policies as they felt and saw the program\u2019s benefits. In the next decade, the program is expected to<\/span><a href=\"https:\/\/www.greenlineinsights.com\/climate-commitment-act\"><span data-contrast=\"none\">\u202fcreate 40,000 new jobs and unleash\u00a0$9 billion in economic growth.<\/span><\/a><\/p>\n<p><span data-contrast=\"auto\">Existing programs are demonstrating proven results \u2014 delivering energy cost savings and cutting health-harming pollution.
