EPA<\/em>, a Supreme Court legal challenge brought by coal companies and their allies in an effort to undermine EPA\u2019s authority to safeguard human health and the environment from the climate pollution emitted by power plants.<\/p>\n<p><em>Amicus<\/em> briefs are common in Supreme Court cases and can provide the Justices with important information or arguments from entities that are not themselves party to the legal challenge. But the <em>amici <\/em>supporting EPA here are especially notable for their breadth and expertise. They represent a far-reaching set of interests and entities, including a large coalition of the nation\u2019s power companies, former power company leaders, major American businesses and manufacturers, power sector experts, climate scientists, legal scholars, medical and public health experts, almost 200 members of Congress, and the Edison Electric Institute \u2013 which represents numerous companies that would themselves be regulated under any <a href=\"https:\/\/nam11.safelinks.protection.outlook.com\/?url=http%3A%2F%2Fblogs.edf.org%2Fclimate411%2F2022%2F01%2F24%2Fan-attack-on-hypothetical-climate-pollution-safeguards-lands-at-the-supreme-court-edf-will-fight-to-protect-climate-action%2F&amp;data=04%7C01%7Cvpatton%40edf.org%7Ce954b94965b14e5d151b08d9e134e8ec%7Cfe4574edbcfd4bf0bde843713c3f434f%7C0%7C0%7C637788439637762540%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C3000&amp;sdata=BdrnUSGzakV%2FgvK3MGhSuYO2BSWStKzM9%2B7yfM0OUgY%3D&amp;reserved=0\">hypothetical EPA rule<\/a> filed in support of EPA\u2019s authority here.<\/p>\n<p>Such a substantial showing of <em>amici<\/em> underscores the significance of maintaining EPA\u2019s authority to regulate climate pollution and protect human health and the environment in the face of aggressive attacks from the coal petitioners and their allies.<\/p>\n<p><strong>Here\u2019s more about the<em> amicus<\/em> briefs:<\/strong><\/p>\n<p><!--more--><\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/AppleEtAlAmicus.pdf\">Major American Companies and Manufacturers<\/a> \u2013 The coalition of more than a dozen major American companies Apple, Amazon, Cummins, and Levi Strauss among them, filed to express a shared \u201cconcern that the climate change crisis presents an urgent threat to our planet and economy.\u201d The brief makes clear that \u201cEPA\u2019s authority to regulate greenhouse gas emissions is critical to combatting climate change\u201d and that, as the Congressionally designated expert agency, EPA is \u201cbest suited to serve as primary regulator of greenhouse gas emissions.\u201d<\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/012522-amicus-192-MembersCongress.pdf\">192 Members of Congress<\/a> \u2013The Members\u2019 brief demonstrates that the portions of EPA\u2019s authority relevant to this case (Clean Air Act Section 111(d), to be precise) squarely applies to power plants\u2019 carbon pollution, highlighted by Congress\u2019s repeated rejection of proposals to repeal or weaken the authority. To the contrary, Congress enacted legislation in 2021 that expressly reaffirmed the central role of the authority in question in addressing greenhouse gas pollution.<\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/WVvEPAAmicus-MembersofCongress.pdf\">Senators Whitehouse, Blumenthal, Sanders and Warren<\/a> \u2013 The Senators\u2019 brief highlights the lack of any actual, live dispute. Put simply, \u201cpetitioners are challenging a regulation that does not exist,\u201d and thus the challenges should be dismissed under \u201clongstanding justiciability principles.\u201d The brief also urges the Court to reject the petitioners\u2019 effort to eviscerate EPA\u2019s ability to protect public health and the environment.<\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/20220125112241992_CleanPowerPlan20-1530AmicusBriefofFormerFERCCommissioners.pdf\">Former FERC Commissioners<\/a> \u2013 The Federal Energy Regulatory Commission (FERC) oversees the smooth functioning of our nation\u2019s interstate power grid. Here, a bipartisan group of former Commissioners appointed by Republican and Democratic Presidents jointly expressed, in no uncertain terms, that EPA has clear authority to address climate pollution from power plants and protect public health and welfare \u2013 authority that is complementary and does not conflict with FERC\u2019s own authority to oversee the electric sector.<\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/012522-amicus-NatLeagueCities-ConfMayors.pdf\">National League of Cities and U.S. Conference of Mayors<\/a> \u2013 The brief, filed by Mayors and municipal government organizations, addresses the context of current climate impacts, highlighting the myriad ways that cities are actively grappling with the devastating consequences of climate change. The brief stresses how \u201clocal efforts to address climate change are highly sensitive to national policies,\u201d and limitations on EPA\u2019s authority to regulate greenhouse gas pollution would frustrate local efforts to address and adapt to climate change.<\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/012522-PowerGridExpertAmicusBrief.pdf\">Power Grid Engineers<\/a> \u2013 The brief filed by a group of leading power grid engineers made clear that addressing climate change and operating a well-functioning electric grid are compatible goals. The filing states that \u201cregulating CO2 pollution from the power sector reduces harms to human health without significantly affecting grid operations or risking reliability.\u201d<\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/EdisonElectricInstituteNACWAACEAmicus.pdf\">Edison Electric Institute and the National Association of Clean Water Agencies<\/a> \u2013 Edison Electric Institute (EEI), as the national association of the vast majority of the U.S.\u2019s electric power providers, represents numerous companies that would be most directly affected by any hypothetical EPA power sector rule centered on climate pollution. EEI\u2019s brief urges the Court to affirm \u201cEPA\u2019s authority to regulate GHG emissions under the [Clean Air] Act, consistent with the Act\u2019s text and congressional intent.\u201d Doing so, they explain, would \u201cminimize impacts on consumers and avoid harm to the U.S. industry and the economy.\u201d<\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/FormerPowerIndustryExecutivesAmicus.pdf\">Former Power Industry Leaders<\/a> \u2013 A group of more than a dozen former executives who held positions across the electric power industry, from power generation to grid operation, submitted a brief emphasizing that EPA\u2019s authority to establish regulation relevant to the power sector isn\u2019t only well-established, it\u2019s commonplace: \u201cenvironmental compliance is a routine planning and operational consideration.\u201d<\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/012522-amicus-PublicHealth.pdf\">Medical and Public Health Experts including the American Medical Association<\/a> \u2013 Physician-member medical organizations and public health experts filed a brief emphasizing the tremendous danger climate change poses to human health and welfare \u201cacross every segment of American society and in every state.\u201d The brief underscored that \u201cregulation and reduction of greenhouse gas emissions are necessary to mitigate the scale of and intensifying public health harms associated with climate change\u201d and demonstrates that \u201c[a]ny ruling that reduces the ability of EPA to discharge its public health mission under the Clean Air Act would harm the public welfare.\u201d<\/p>\n<p><strong>\u00a0<\/strong><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/ClimateScientistsAmicus01252022.pdf\">Climate Scientists<\/a> \u2013 A group of leading climate scientists filed a brief making explicit that the effects of climate change are already present, today, and causing harm to Americans, expressed through impacts that range from wildfires and heatwaves to flooding and more frequent and more intense storms. Without \u201csignificant coordination at the federal level,\u201d these impacts are only expected to worsen. The brief stresses that reducing the human and economic costs of climate change is still possible \u201cif greenhouse gas emissions from existing power plants and other sources can be reduced\u201d and that the EPA is \u201cthe entity with the scientific, economic, and technological resources necessary to cope with issues of this order.\u201d<\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/012522-amicus-NPCA.pdf\">National Parks Conservation Association<\/a> \u2013 The Association\u2019s brief explains that EPA authority to regulate greenhouse gas pollution from power plants is \u201ccritical to protecting the vitality of the National Park system, which the text of the [Clean Air] Act identifies as one of its key objectives.\u201d The preservation of these iconic parklands is \u201cconsiderably dependent on the EPA\u2019s exercise of delegated authority to regulate GHG emissions from power plants.\u201d<\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/JorlingAmicus01252022.pdf\">Republican Legislative Staff for the 1970 Clean Air Act Thomas C. Jorling<\/a> \u2013 Mr. Jorling, Counsel for the Republican Minority in the Senate Committee on Public Works when the 1970 Clean Air Act was enacted, filed a brief stating that law establishes a \u201ccomprehensive framework to serve a broad public health and welfare mandate.\u201d His brief explains that Section 111(d) is an \u201cintegral component\u201d of that framework, \u201cspecifically designed to empower EPA to address emissions\u201d like those at issue.<\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/RichardReveszAmicusBrief.pdf\">NYU Law Professor and Dean Emeritus Richard Revesz<\/a> \u2013 A brief from legal scholar and NYU Law Dean Emeritus Richard Revesz identifies how petitioners\u2019 arguments for limiting EPA\u2019s Clean Air Act authority through an expanded \u201cmajor questions\u201d doctrine are unwarranted and unworkable, and would turn on illogical criteria such as the amount of legislative or public attention a relevant topic has received. The brief also explains that the Clean Air Act provisions at issue were intended to achieve significant changes in order to safeguard public health and the environment, and EPA\u2019s rules implementing the Clean Air Act should not be struck down on the basis that they have significant effects.<\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/JulianMortenson-NondelegationDoctrineAmicus.pdf\">University of Michigan Law Professor Julian Mortenson<\/a> \u2013 Legal scholar Julian Mortenson\u2019s brief explaining that core aspects of petitioners\u2019 arguments to confine EPA authority (particularly those premised upon novel theories of \u201cnondelegation\u201d) are unsupported by the Constitution and by the historical understanding of the powers of Congress during the founding era and the early American republic.<\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/012522-amicus-PublicCitizen.pdf\">Public Citizen<\/a> \u2013 This brief rebuts petitioners\u2019 arguments that an agency\u2019s action should be of heightened concern merely because the subject matter of that action is highly important.<\/p>\n<p>These rigorous <em>amicus<\/em> briefs follow merit briefs filed last week, including EDF\u2019s, which we submitted jointly with other leading environmental groups and trade associations.
