The administration\u2019s justification for weakening these safeguards is based on a deeply flawed and <a href=\"https:\/\/blogs.edf.org\/climate411\/2018\/08\/07\/administration-cooks-the-books-to-justify-rollback-of-the-clean-car-standards\/#more-18739\">biased analysis<\/a> that contradicts the technical progress the auto industry is making to reduce pollution. An <a href=\"https:\/\/protect-us.mimecast.com\/s\/c9z2Czpnz8cR8Mwqug2iTK?domain=nytimes.com\">earlier expose<\/a> highlighted the roll of the oil industry in pushing and benefiting from the administration\u2019s rollback.<\/p>\n<p><strong>State leadership under attack<\/strong><\/p>\n<p><a href=\"https:\/\/www.whitehouse.gov\/briefings-statements\/joint-statement-white-house-department-transportation-environmental-protection-agency-safe-vehicles-rule\/\">The administration says<\/a> it is pressing ahead with its attacks on <a href=\"https:\/\/www.nytimes.com\/2018\/07\/27\/climate\/andrew-wheeler-epa.html\">long-standing state authority<\/a>\u00a0to enforce tougher standards than those implemented at the federal level.\u00a0<!--more--><\/p>\n<p>Over the last half century, state leadership has played a key role in spurring the development and deployment of clean car solutions like smog-fighting catalytic converters.<\/p>\n<p>Under long-standing provisions in the Clean Air Act, California has authority to set its own vehicle pollution standards, and other states are authorized to adopt these standards. Today more than a third of U.S. new car sales are covered by the coalition of states that have committed to protective clean car standards: California, Colorado, Connecticut, Delaware, Maine, Maryland, Massachusetts, New Jersey, New York, Oregon, Pennsylvania, Rhode Island, Washington, and Vermont.<\/p>\n<p><a href=\"https:\/\/medium.com\/cityoftomorrow\/a-measure-of-progress-bc34ad2b0ed\">Automaker\u00a0public comments<\/a>\u00a0recognize this history and have committed to working with California to build a path forward.<\/p>\n<p>The administration\u2019s proposal to roll back the Clean Car Standards would stifle these successful state-led programs, while needlessly creating uncertainty for all parties.<\/p>\n<p><strong>The administration\u2019s rollback will cost Americans at the gas pump <\/strong><\/p>\n<p>With strong clean car standards, Americans save hard-earned money at the gas pump.<\/p>\n<p>An\u00a0<a href=\"https:\/\/www.edf.org\/sites\/default\/files\/MJ_Bradley_Clean_Cars_rollback_report.pdf\">analysis by M.J. Bradley &amp; Associates<\/a>\u00a0found that with the current Clean Car Standards in place, owners of model year 2025 cars would see net savings of\u00a0<strong>up to $5,000<\/strong>\u00a0over the lifetime of their cars compared to model year 2020 vehicles, and trucks owners could save\u00a0<strong>up to $8,000<\/strong>.<\/p>\n<p>The vast majority of families who finance their car purchase will start saving money as soon as they drive a car off the lot. For all families, their savings continue as long as they own their vehicle.<\/p>\n<p>In contrast, the M.J Bradley report finds that the Trump administration\u2019s proposed rollback would cost Americans in every state. With the anticipated rollback, an average family will spend\u00a0<strong>$200 more every year<\/strong>, and could spend as much as\u00a0<strong>$500 more every year <\/strong>if gas prices rise \u2014 with low-income and long-commuting Americans particularly hard hit.<\/p>\n<p><strong>The administration\u2019s <\/strong><em><strong>own analysis<\/strong><\/em><strong> shows a clean cars rollback will cost jobs<\/strong><\/p>\n<p>The Trump administration\u2019s own analysis finds that its effort to weaken clean car standards is a job\u00a0<em>loser<\/em>. That\u2019s right \u2013 the administration\u2019s own assessment of its proposed rollback found that it would\u00a0<strong>cost 60,000 jobs<\/strong>\u00a0(<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2018-08-24\/pdf\/2018-16820.pdf\">Table VII-5; page 784 and 785<\/a>).<\/p>\n<p>Losing 60,000 jobs under President Trump\u2019s plan stands in stark contrast to the progress made since the adoption of the Clean Car Standards. This program has coincided with\u00a0<a href=\"https:\/\/www.washingtonpost.com\/business\/economy\/us-car-sales-hit-record-high-in-2015\/2016\/01\/05\/363aaf30-af14-11e5-b820-eea4d64be2a1_story.html?utm_term=.da15f5027e09&amp;noredirect=on\">record years of vehicle sales<\/a>\u00a0and the addition of\u00a0<a href=\"https:\/\/www.bluegreenalliance.org\/resources\/sound-vehicle-standards-policies-drive-strong-job-growth\/\">700,000 auto industry jobs<\/a>.<\/p>\n<p>The\u00a0<a href=\"https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/2017\/03\/UAW-proposed-determination.pdf\">United Automobile Workers<\/a>\u00a0has noted that their members \u201cknow firsthand\u201d that these standards \u201chave spurred investments in new products that employ tens of thousands of our members.\u201d The group\u2019s president,\u00a0<a href=\"https:\/\/uaw.org\/final-media-roundtable-uaw-president-dennis-williams\/\">Dennis Williams<\/a>, stated that he did not support the administration\u2019s efforts to rollback these standards:<\/p>\n<p style=\"padding-left: 30px\">\u201cWe had an agreement \u2026 I don\u2019t think that we ought to be rolling back the standards. I think we ought to use some common sense here.\u201d<\/p>\n<p>The 60,000 job loss figure is likely low because it fails to account for the cost of ceding innovation and technology leadership to other countries. China is now the dominant market for global vehicles sales, and its long-term commitment to zero-emission vehicles remains strong.<\/p>\n<p>The next generation of American automotive jobs will be at companies that lead the global transition to zero-emission vehicles. For example, Synapse Energy Economics recently found that embracing vehicle electrification by itself stands to create \u2013 for Ohio alone \u2013 more than\u00a0<a href=\"http:\/\/www.poweringohio.org\/files\/2018\/05\/Powering-Ohio_FINAL-WEB.pdf\">9,000 jobs and $900 million in annual Gross Domestic Product<\/a>.<\/p>\n<p><strong>A broad coalition supports the existing Clean Car Standards<\/strong><\/p>\n<p>Two weeks ago, a strong coalition <a href=\"https:\/\/www.edf.org\/media\/advocates-condemn-unlawful-foundation-trump-administrations-effort-attack-americas-clean-car\">filed in court<\/a> to defend the existing clean cars program. These parties are challenging ex-EPA Administrator Scott Pruitt\u2019s April 2018 Final Determination concluding that the Clean Car Standards should be rolled back \u2014 a decision which obligated EPA to weaken these protections.<\/p>\n<p>Parties that filed in court include:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/State%20Petitioners%20Initial%20Brief%20--%20Feb.%207%2C%202019.pdf\"><strong>18 states and the District of Columbia<\/strong><\/a><strong>:<\/strong> California, Connecticut, Delaware, Illinois, Iowa, Maine, Maryland, Massachusetts, Minnesota, New Jersey, New York, Oregon, Pennsylvania, Rhode Island, Washington, Vermont, Virginia, and Washington, DC. <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/2019-02-14_Colorado_Amicus_Brief.pdf\">Colorado filed<\/a> separately as an amicus or \u201cfriend of the court.\u201d<\/li>\n<li><strong>A coalition of cities and counties<\/strong>, including: the National League of Cities; the U.S. Conference of Mayors; New York; Los Angeles; Chicago; San Francisco; Ann Arbor, Michigan; Boulder County, Colorado; and West Palm Beach, Florida. In its brief, <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/2019-02-14_Cities_Amicus_Brief.pdf\">the local government coalition argues<\/a> why Pruitt\u2019s Determination to weaken existing standards is particularly harmful to cities across America: \u201cCities and local governments are at the frontlines of managing climate change and are uniquely affected by the impacts of climate change on human health, infrastructure, natural resources, and local economies.\u201d<\/li>\n<li><strong>Consumer Federation of America,<\/strong> an association of more than 250 nonprofit consumer groups. In <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/2019-02-14_CFA_Amicus_Brief.pdf\">its brief to the court<\/a>, CFA explains that the Pruitt Determination \u201cwould rob consumers of billions of dollars in net benefits by freezing GHG emission standards at [2020] levels, with the lost savings reaching $1,650 per vehicle.\u201d<\/li>\n<li><strong>Lyft, <\/strong>a ridesharing platform available to 95 percent of people in the United States. <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/2019-02-14_Lyft_Amicus_Brief.pdf\">Lyft explains why<\/a> EPA\u2019s determination causes harm to its company, drivers, and customers: \u201cLyft depends on automakers to make fuel-efficient vehicles available and affordable. EPA\u2019s determination that the existing 2022\u2013 2025 greenhouse gas standards are \u2018inappropriate\u2019 harms Lyft, its drivers, and its riders because it will make efficient vehicles less readily available and more expensive than they otherwise would have been.\u201d<\/li>\n<li><strong>The South Coast Air Quality Management District <\/strong>in California is responsible for comprehensive air pollution control in the Los Angeles metropolitan area and parts of surrounding counties. <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/2019-02-14_SCAQMD_Amicus_Brief.pdf\">Its brief explains<\/a> how EPA\u2019s attack on the Clean Car Standards makes it harder for California to achieve cleaner air.<\/li>\n<li><strong>Advanced Energy Economy<\/strong> represents more than 100 companies and organizations that are focused on the advanced energy sector, including the transition to clean cars. AEE explains <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/2019-02-14_AEE_Amicus_Brief.pdf\">in its brief<\/a> that: \u201cEPA\u2019s actions undermine technology firms\u2019 ability to plan around predictable markets, and destabilize the investor confidence engendered by the benefits of long-term, evidence-based emissions performance standards.\u201d<\/li>\n<li>A coalition of <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/NCAT%20Petrs%20Initial%20Opening%20%20Brief%20--%20Feb.%207%2C%202019.pdf\">private sector advanced transportation interests<\/a> including the <strong>National Coalition for Advanced Transportation<\/strong>, <strong>ConEd<\/strong>, <strong>National Grid<\/strong>, <strong>New York Power Authority<\/strong>, and <strong>Seattle City Light<\/strong>.<\/li>\n<li>A coalition of <strong>consumer, science, and environmental organizations<\/strong>, including <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/2019-02-07%20NGO%20Merits%20Brief.pdf\">Environmental Defense Fund<\/a>. Others include: the Center for Biological Diversity, Conservation Law Foundation, Natural Resources Defense Fund, Public Citizen, Sierra Club, and Union of Concerned Scientists.<\/li>\n<\/ul>\n<p><strong>Extensive safety analysis supports strong Clean Car Standards<\/strong><\/p>\n<p>Multiple federal agencies \u2013 including the National Highway Traffic Safety Administration (NHTSA), the lead federal agency charged with vehicle safety \u2013 as well as the <a href=\"https:\/\/www.nap.edu\/catalog\/21744\/cost-effectiveness-and-deployment-of-fuel-economy-technologies-for-light-duty-vehicles\">National Academy of Sciences<\/a> and the California Air Resources Board have done extensive, sophisticated technical safety assessments. The findings of those assessments support the existing Clean Car Standards.<\/p>\n<p>The studies, analyses and crash-worthiness simulations conducted during these assessments have resulted in thousands of pages of data showing that the Clean Car Standards are fully compatible with safer vehicles and fewer fatalities \u2014 and roundly rejecting the administration\u2019s false contention that the standards harm vehicle safety.<\/p>\n<p>The administration\u2019s analytic justification for rolling back the standards has been widely criticized. A <a href=\"http:\/\/science.sciencemag.org\/content\/362\/6419\/1119?rss%253D1=\">Science article<\/a> concluded that the agencies\u2019 analysis \u201chas fundamental flaws and inconsistences [and] is at odds with basic economic theory and empirical studies.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>EDF attorney Erin Murphy co-authored this post\u00a0 The Trump administration announced today that it will end negotiations with California and press ahead with its attempts to roll back America\u2019s successful Clean Car Standards.
