{"id":18221,"date":"2017-10-27T11:19:44","date_gmt":"2017-10-27T16:19:44","guid":{"rendered":"http:\/\/blogs.edf.org\/climate411\/?p=18221"},"modified":"2017-10-27T11:19:44","modified_gmt":"2017-10-27T16:19:44","slug":"the-fight-for-transparency-and-accountability-at-epa","status":"publish","type":"post","link":"https:\/\/blogs.edf.org\/climate411\/2017\/10\/27\/the-fight-for-transparency-and-accountability-at-epa\/","title":{"rendered":"The fight for transparency and accountability at EPA"},"content":{"rendered":"<p><a href=\"https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/2016\/09\/scales_of_justice-300x280-300x280-1.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-14711 size-medium\" src=\"https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/2016\/09\/scales_of_justice-300x280-300x280-1-300x280.png\" alt=\"\" width=\"300\" height=\"280\" \/><\/a><em>This blog was co-authored by Surbhi Sarang, EDF\u00a0Legal Fellow.<\/em><\/p>\n<p>Since taking the helm at the Environmental Protection Agency (EPA), Scott Pruitt has attempted to <a href=\"https:\/\/www.nytimes.com\/2017\/08\/11\/us\/politics\/scott-pruitt-epa.html\">hide his activities<\/a> from scrutiny by limiting the public\u2019s access to information.<\/p>\n<p>He has ended the decades-long, bipartisan practice of releasing the <a href=\"https:\/\/blogs.edf.org\/climate411\/2017\/06\/20\/scott-pruitt-keeps-americans-in-the-dark-on-his-activities\/\">daily schedules<\/a> of top agency leadership, <a href=\"https:\/\/www.edf.org\/media\/environmental-defense-fund-obtains-information-over-1900-climate-related-items-removed-or\">removed EPA webpages<\/a>, and announced harmful policies close in time with <a href=\"https:\/\/www.nytimes.com\/2017\/10\/03\/us\/politics\/epa-scott-pruitt-calendar-industries-coal-oil-environmentalists.html\">private meetings<\/a> with lobbyists from affected industries.<\/p>\n<p>EDF has been at the forefront of efforts to <a href=\"https:\/\/www.edf.org\/climate\/promoting-government-transparency\">promote transparency and accountability<\/a> at EPA. That\u2019s why we just <a href=\"https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/2017\/10\/2017.10.26-EDF-v-EPA-FOIA-Complaint-Dkt.-1.pdf\">filed a lawsuit<\/a> to compel EPA to comply with its legal duty to release public records under the Freedom of Information Act (FOIA).<\/p>\n<p><strong>Scott Pruitt\u2019s record of secrecy and ethical conflicts<\/strong><\/p>\n<p>Scott Pruitt\u2019s opaqueness and secrecy have sharply contrasted with basic principles of good government.<\/p>\n<p>Under the Ethics in Government Act of 1978, the Office of Government Ethics <a href=\"https:\/\/www.law.cornell.edu\/cfr\/text\/5\/2635.101\">issued regulations<\/a> for executive branch employees:<\/p>\n<blockquote><p>To ensure that every citizen can have complete confidence in the integrity of the Federal Government.<\/p><\/blockquote>\n<p>Among other requirements:<\/p>\n<blockquote><p>Employees shall act impartially and not give preferential treatment to any private organization or individual\u201d and \u201cshall endeavor to avoid any actions creating the appearance that they are violating the law or . . . ethical standards.<\/p><\/blockquote>\n<p>The Office of Government Ethics titled this regulation the \u201cbasic obligation of public service.\u201d<\/p>\n<p>Pruitt and his senior leadership have raised serious questions as to whether they are abiding by these principles.<\/p>\n<p>In just one example, earlier this summer thirteen state Attorneys General <a href=\"https:\/\/ag.ny.gov\/sites\/default\/files\/2017_0830_letter_to_epa_re_cpp_stay.pdf\">formally objected<\/a> to a guidance letter in which Pruitt expressed his flawed, misleading opinion about a crucial issue in litigation over the Clean Power Plan \u2014 America\u2019s only nationwide limits on carbon pollution from existing power plants.<\/p>\n<p>The Attorneys General wrote that Pruitt\u2019s conduct was \u201cinconsistent with his agreement not to participate in the litigation,\u201d given that he repeatedly sued EPA over the Clean Power Plan when he served as Attorney General of Oklahoma.<\/p>\n<p>Pruitt also discontinued the practice of <a href=\"https:\/\/blogs.edf.org\/climate411\/2017\/06\/20\/scott-pruitt-keeps-americans-in-the-dark-on-his-activities\/\">releasing his schedule<\/a>, along with the schedules of senior leadership.<\/p>\n<p>The bipartisan practice of releasing schedules <a href=\"https:\/\/www.regulationwriters.com\/downloads\/EPA-Fishbowl-Memo-05-19-1983-Ruckelshaus.pdf\">stretches back decades<\/a> and was initiated expressly:<\/p>\n<blockquote><p>In order to make the public fully aware of [the Administrator\u2019s] contacts with interested persons.<\/p><\/blockquote>\n<p>Following months of public pressure and more than 60 FOIA requests, Pruitt finally released a <a href=\"https:\/\/www.epa.gov\/senior-leaders-calendars\/calendar-scott-pruitt-administrator\">partial public account<\/a> of his schedule. But that account provides only a minimal level of detail of how and with whom Pruitt spends his time.<\/p>\n<p>Pruitt later released a more detailed <a href=\"https:\/\/protect-us.mimecast.com\/s\/xNGlBAc4K4eu6?domain=documentcloud.org\">appointments calendar<\/a>, but it covered a limited date range and included many redactions worthy of additional scrutiny. And neither of those releases provides any transparency for other EPA senior officials.<\/p>\n<p>To obtain any more information about how EPA leadership spends its time, EDF\u2019s only recourse has been to demand the release of these public records under FOIA.<\/p>\n<p><strong>EDF\u2019s efforts to promote transparency and accountability<\/strong><\/p>\n<p>EDF is taking action to protect important standards of transparency and accountability at EPA \u2014 and to keep the public informed about policymaking that directly impacts the health and environment of all Americans.<\/p>\n<p>Our lawsuit concerns three FOIA requests that directly address the integrity of EPA\u2019s operations. For each request, EPA\u2019s legally mandated deadline for providing a response is several months overdue, despite EDF\u2019s extensive outreach to EPA over many months in an effort to elicit the requested records.<\/p>\n<p>The<a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/2017.01.24_edf_ethics_foia_request_pdf.pdf\"> first request<\/a> seeks records related to the ethics agreement that Pruitt signed shortly after his nomination to lead EPA, in which he outlined:<\/p>\n<blockquote><p>[S]teps that [he] will take to avoid any actual or apparent conflict of interest.<\/p><\/blockquote>\n<p>We submitted this FOIA request in January 2017 \u2013 more than nine months ago.<\/p>\n<p>Pruitt\u2019s ethics agreement <a href=\"https:\/\/s3.amazonaws.com\/storage.citizensforethics.org\/wp-content\/uploads\/2017\/01\/17183250\/Letter-to-EPA-ethics-counsel-re-Pruitt-FINAL.pdf\">diverged from the standard language<\/a> used by the Office of Government Ethics \u2013 even though Pruitt\u2019s longstanding and <a href=\"http:\/\/www.edfaction.org\/scott-pruitts-web-fundraising-and-lawsuits\">very public opposition<\/a> to a litany of EPA\u2019s public health and environmental safeguards calls into question his ability to be impartial, particularly on matters in which he represented Oklahoma and long ago <a href=\"https:\/\/www.ok.gov\/triton\/modules\/newsroom\/newsroom_article.php?id=258&amp;article_id=14259\">took fixed positions<\/a>. Since taking the oath of office as Administrator, Pruitt has actively tried to undermine public health and environmental protections \u2014 like the Clean Power Plan \u2014 and has proposed to repeal protections that he had long attacked while Attorney General of Oklahoma.<\/p>\n<p>Our FOIA request seeks records pertaining to the evaluation of Pruitt\u2019s actual or potential conflicts of interest, including any analysis that informed his ethics agreement.<\/p>\n<p>The <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/schedule_and_clarification.pdf\">second request<\/a> is for records related to Pruitt\u2019s and his senior managers\u2019 schedules.<\/p>\n<p>The most complete information we\u2019ve received so far on Pruitt\u2019s activities is only a <a href=\"https:\/\/www.documentcloud.org\/documents\/4064980-Pruitt-Sked-and-McCarthy-Sked.html\">select snapshot<\/a> released through a FOIA request. That snapshot contains more than 100 redacted calendar appointments, and only runs through mid-May.<\/p>\n<p>Even this limited information reveals the <a href=\"http:\/\/www.cnn.com\/2017\/10\/06\/politics\/pruitt-industry\/index.html\">special access granted to polluter lobbyists<\/a> \u2014 many of whom come from industries that have <a href=\"https:\/\/www.nytimes.com\/2017\/01\/14\/us\/scott-pruitt-trump-epa-pick.html\">supported Pruitt\u2019s political career<\/a> for years. A more comprehensive release, including the calendars of senior EPA managers, would provide a fuller picture of the constituency that Pruitt and his political staff are serving.<\/p>\n<p>The <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/2017.03.20_epa_scientific_integrity_foia.pdf\">third request<\/a> is for public documents related to threats to scientific integrity at EPA.<\/p>\n<p>EDF requested these records in light of the Trump Transition Team\u2019s <a href=\"https:\/\/www.regulationwriters.com\/downloads\/EPA-Fishbowl-Memo-05-19-1983-Ruckelshaus.pdf\">efforts to single out<\/a> civil servants at the Department of Energy who worked on climate science and policy. Since we submitted this FOIA request more than seven months ago, subsequent events \u2014 including the <a href=\"https:\/\/www.washingtonpost.com\/news\/energy-environment\/wp\/2017\/04\/28\/epa-website-removes-climate-science-site-from-public-view-after-two-decades\">removal of EPA\u2019s Climate Science website<\/a>, <a href=\"https:\/\/blogs.edf.org\/climate411\/2017\/10\/09\/underhanded-maneuvers-to-repeal-the-clean-power-plan-put-americans-lives-and-health-at-risk\/\">scientific distortions<\/a> that accompanied the proposal to repeal the Clean Power Plan, <a href=\"http:\/\/www.cnn.com\/2017\/10\/17\/politics\/pruitt-epa-science-adviser-cuts\/index.html\">threatened efforts<\/a> that would compromise the integrity of EPA advisory boards, and the <a href=\"https:\/\/www.nytimes.com\/2017\/10\/22\/climate\/epa-scientists.html\">muzzling of EPA scientists<\/a> who were scheduled to deliver public presentations on climate change \u2014 have only increased the urgency of providing public access to records about the treatment of scientific integrity at EPA.<\/p>\n<p>EDF will continue working to protect transparency and accountability at EPA by supporting Americans\u2019 ability to access information about health and environmental policies, and by shining a light on the Trump Administration\u2019s attacks on vital safeguards for families and communities across America.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This blog was co-authored by Surbhi Sarang, EDF\u00a0Legal Fellow.
