Circuit Court of Appeals <\/span><a href=\"https:\/\/www.edf.org\/media\/dc-circuit-refuses-epa-administrator-scott-pruitts-attempt-delay-clean-air-safeguards\">rejected an effort<\/a><span style=\"color: #000000\"> by EPA Administrator Scott Pruitt to suspend vital limits on oil and gas pollution.\u00a0 <\/span><\/span><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">There\u2019s an important detail to this story that you might have missed. Turns out the public got no opportunity to provide any feedback on Pruitt\u2019s decision, even though it put their health at risk. Instead, Pruitt <\/span><a href=\"https:\/\/www.epa.gov\/sites\/production\/files\/2017-04\/documents\/oil_and_gas_fugitive_emissions_monitoring_reconsideration_4_18_2017.pdf\">abruptly declared<\/a><span style=\"color: #000000\"> he was granting this suspension through a letter to industry, with no formal notice given to the public until well afterwards \u2014 and no opportunity provided for public input.\u00a0 <\/span><\/span><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">\u00a0<\/span><\/span><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">Unfortunately, this is just one example of a consistent pattern of conduct. Again and again, Pruitt has shut the public out of key decisions while giving a direct line to industry laggards and their allies. <\/span><\/span><\/p>\n<p><b><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">Public safeguards undermined without public input<\/span><\/span><\/b><b><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">\u00a0<\/span><\/span><\/b><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">Early in his tenure, one o<\/span>f<span style=\"color: #000000\"> Pruitt\u2019s very first actions was to <\/span><a href=\"http:\/\/blogs.edf.org\/energyexchange\/2017\/03\/07\/in-early-action-epa-administrator-pruitt-moves-to-block-communities-right-to-know-about-oil-and-gas-pollution\/\">withdraw a request<\/a><span style=\"color: #000000\"> for information on pollution levels from oil and gas facilities \u2014 acting unilaterally, with no advanced notice and no opportunity for public input. <\/span><\/span><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">Most of what we know about Pruitt\u2019s decision comes from Attorney General Ken Paxton of Texas, who has battled pollution safeguards while <\/span><a href=\"https:\/\/www.nytimes.com\/2014\/12\/07\/us\/politics\/energy-firms-in-secretive-alliance-with-attorneys-general.html\">fundraising from fossil fuel interests<\/a><span style=\"color: #000000\">, mirroring Pruitt\u2019s approach as Oklahoma Attorney General. <\/span><\/span><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">Paxton <\/span><a href=\"https:\/\/www.nytimes.com\/2017\/07\/01\/us\/politics\/trump-epa-chief-pruitt-regulations-climate-change.html\">openly bragged<\/a><span style=\"color: #000000\"> about his role in driving Pruitt to eliminate this information request<\/span><u><span style=\"color: #0563c1\">:<\/span><\/u><\/span><\/p>\n<blockquote><p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">I personally handed him the letter, and the next day the rule was personally withdrawn.<\/span><\/span><\/p><\/blockquote>\n<p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">While Paxton got an opportunity for input, the public never had a chance to weigh in on this decision. Not surprisingly, Pruitt\u2019s <\/span><a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-withdraws-information-request-oil-and-gas-industry\">announcement hailed<\/a><span style=\"color: #000000\"> the withdrawal\u2019s benefits for the oil and gas industry while ignoring Americans\u2019 right to know about harmful pollution from oil and gas facilities.<\/span><\/span><\/p>\n<p><b><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">A pattern of shutting out everyday Americans<\/span><\/span><\/b><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">This practice has been repeated across different sectors and different safeguards. <\/span><\/span><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">Pruitt <\/span><a href=\"http:\/\/thehill.com\/policy\/energy-environment\/341728-greens-sue-epa-over-smog-rule-delay\">delayed the implementation<\/a><span style=\"color: #000000\"> of health-based limits on ground-level ozone, commonly called smog, without any opportunity for public input. The standards would prevent 230,000 <\/span><a href=\"https:\/\/www.epa.gov\/sites\/production\/files\/2015-10\/documents\/overview_of_2015_rule.pdf\">childhood asthma attacks<\/a><span style=\"color: #000000\"> every year.<\/span><\/span><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">Pruitt delayed <\/span><a href=\"https:\/\/www.washingtonpost.com\/news\/energy-environment\/wp\/2017\/04\/13\/trump-administration-halts-obama-era-rule-aimed-at-curbing-toxic-wastewater-from-coal-plants\/?utm_term=.88a95c050467\">toxic wastewater standards<\/a><span style=\"color: #000000\"> for power plants without public input. Same for a program to <\/span><a href=\"http:\/\/www.naturalgasintel.com\/articles\/109758-at-industrys-request-epa-stays-risk-management-program-rule-for-three-months\">manage risks<\/a><span style=\"color: #000000\"> of accidents at petroleum refineries and other major chemical plants. <\/span><\/span><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">A recent rollback request from the landfills industry called for a delay to important improvements to pollution standards that had not been substantially updated in 20 years. The <\/span><a href=\"https:\/\/www.epa.gov\/sites\/production\/files\/2017-05\/documents\/signed_-_letter_-_municipal_solid_waste_landfills.pdf\">request was granted<\/a> <span style=\"color: #000000\">via a letter from Pruitt to industry representatives with no opportunity for public comment \u2014 and formal public notice wasn\u2019t provided until <\/span><a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/FR-2017-05-31\/pdf\/2017-10752.pdf\">more than two weeks<\/a><span style=\"color: #000000\"> after the delay was granted.\u00a0\u00a0 <\/span><\/span><\/p>\n<p><b><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">Who is guiding Pruitt\u2019s decisions? The public is in the dark<\/span><\/span><\/b><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">Pruitt has made the unusual and troubling decision to <\/span><a href=\"https:\/\/blogs.edf.org\/climate411\/2017\/06\/20\/scott-pruitt-keeps-americans-in-the-dark-on-his-activities\/\">end public access<\/a><span style=\"color: #000000\"> to his calendar and the calendar of senior EPA managers in spite of a bipartisan EPA history of making those calendars public. Without access to the calendars, it\u2019s impossible to know who is meeting with the Administrator or his senior staff \u2014 and who is informing their decision-making.<\/span><\/span><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">What little information we\u2019ve learned about his calendar is that it\u2019s been \u201c<\/span><a href=\"https:\/\/www.eenews.net\/greenwire\/stories\/1060056130\/\">filled<\/a><span style=\"color: #000000\">\u201d with meetings with industry interests. Many of these meetings are with the same individuals or companies benefiting from his rollbacks. In just one example, Pruitt gathered with the American Petroleum Institute board of directors behind closed doors early in his tenure, soon before rolling back oil and gas protections.<\/span><\/span><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">Pruitt\u2019s <\/span><a href=\"http:\/\/www.edfaction.org\/scott-pruitts-web-fundraising-and-lawsuits\">intertwined relationship<\/a><span style=\"color: #000000\"> with major industry interests goes back to before he became EPA Administrator to his time as the Attorney General of Oklahoma. In a 2014 <\/span><a href=\"https:\/\/www.nytimes.com\/2014\/12\/07\/us\/politics\/energy-firms-in-secretive-alliance-with-attorneys-general.html\">expos\u00e9<\/a><span style=\"color: #000000\">, he was documented copying and pasting industry requests and sending them to EPA, nearly word for word, on Oklahoma Attorney General letterhead. Pruitt has <\/span><a href=\"http:\/\/newsok.com\/article\/5374189\">defended<\/a><span style=\"color: #000000\"> this conduct as \u201crepresentative government in my view,\u201d begging the question of who Pruitt thinks he\u2019s supposed to represent. <\/span><\/span><\/p>\n<p><b><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">Industry representatives in senior leadershi<\/span><\/span><\/b><b><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">p<\/span><\/span><\/b><\/p>\n<p><span style=\"background: white;font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">Pruitt isn\u2019t only hearing from industry voices outside the agency. Within EPA, his leadership team is <\/span><a href=\"https:\/\/www.nytimes.com\/2017\/07\/11\/business\/the-deep-industry-ties-of-trumps-deregulation-teams.html?_r=0\">filled with former industry representatives<\/a><span style=\"color: #000000\">. <\/span><\/span><\/p>\n<p><span style=\"background: white;font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">In just one recent example, the agency\u2019s new senior deputy general counsel, Erik Baptist, was previously a top lawyer at the <\/span><\/span><span style=\"font-family: 'Arial',sans-serif\"><a href=\"https:\/\/www.eenews.net\/eenewspm\/2017\/06\/27\/stories\/1060056677\">American Petroleum Institute<\/a><u> <\/u><span style=\"color: #000000\">\u2014 which has been lobbying, among other things, to repeal EPA safeguards that reduce harmful methane pollution from oil and gas operations. Baptist is just the latest example of the pervasive <\/span><a href=\"https:\/\/www.edf.org\/blog\/2017\/05\/10\/conflicts-interest-taint-trumps-environmental-picks-top-7-examples\">conflicts of interest<\/a> <span style=\"color: #000000\">among Pruitt\u2019s senior staff.<\/span> <\/span><\/p>\n<p><b><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">Accountable to the law<\/span><\/span><\/b><b><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">\u00a0<\/span><\/span><\/b><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif\"><span style=\"color: #000000\">Fortunately, Pruitt\u2019s practice of leaving the public in the dark is getting pushback. The recent D.C. Circuit decision in the oil and gas methane case is an important step in holding him accountable to the law. Pruitt must listen to all voices \u2014 including those of members of the public \u2014 as he makes decisions with serious implications for public health and welfare.\u00a0 <\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>My EDF colleagues and fellow attorneys won an important victory for public health this month when the D.C.
