On <strong>September 27<\/strong>, attorneys will present their arguments in front of the full U.S. Court of Appeals for the D.C. Circuit.<\/p>\n<p>EPA and the many supporters of the Clean Power Plan have already filed their written arguments \u2013 and so has the coalition of coal companies and their allies that are challenging the rule. (You can read all their submissions <a href=\"https:\/\/www.edf.org\/climate\/clean-power-plan-case-resources\">here<\/a>.) And just yesterday, the D.C. Circuit released the final <a href=\"https:\/\/blogs.edf.org\/climate411\/wp-content\/blogs.dir\/7\/files\/2016\/08\/Document-Scheduling-Order.pdf?_ga=1.89301714.852916913.1458489268\">order<\/a> on the argument\u2019s format and duration.<\/p>\n<p>The <a href=\"https:\/\/www.edf.org\/climate\/a-new-federal-clean-power-plan\">Clean Power Plan<\/a> is America\u2019s first-ever nationwide program to reduce carbon pollution from power plants. It sets eminently achievable carbon emission targets that phase in gradually, in line with current power sector trends, while giving states and power companies tremendous flexibility to determine how best to meet these goals.<\/p>\n<p>As we approach September 27, here are <strong>five key facts<\/strong> to keep in mind:<\/p>\n<ol>\n<li><strong>The Clean Power Plan has supporters across the country.<\/strong><\/li>\n<\/ol>\n<p>Power companies and state and local officials in <a href=\"https:\/\/blogs.edf.org\/climate411\/2016\/04\/14\/american-cities-are-defending-the-clean-power-plan-in-court-even-against-their-own-state-politicians\/?_ga=1.76279516.852916913.1458489268\">forty-one states<\/a> are supporting the Clean Power Plan in court \u2013 either through their state attorney general, a local power company, or a municipality. And there are a lot more supporters as well.<\/p>\n<p>The final submitted briefs reflect a wide array of important perspectives in our society. <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/list_of_supporters_of_the_clean_power_plan_in_court.pdf\">Supporters<\/a> of the Clean Power Plan in court include:<\/p>\n<ul>\n<li><strong>L<\/strong><strong>eading businesses.<\/strong> Power companies that produce about 10 percent of our nation\u2019s electricity as well as prominent, iconic businesses including Adobe, Amazon, Apple, Google, IKEA, Mars, and Microsoft<\/li>\n<li><strong>States and municipalities. <\/strong>18 states and 60 cities, including <a href=\"https:\/\/blogs.edf.org\/climate411\/2016\/04\/14\/american-cities-are-defending-the-clean-power-plan-in-court-even-against-their-own-state-politicians\/?_ga=1.76279516.852916913.1458489268\">major cities in states that are litigating against these protections<\/a> &#8211; like Houston, Grand Rapids, and Miami<\/li>\n<li><strong>Co<\/strong><strong>nsumers Union<\/strong> and other organizations addressing the economic benefits for consumers and low income ratepayers from expansive, low cost clean energy solutions<\/li>\n<li><strong>4<\/strong><strong>1 faith communities<\/strong> including the National Council of Churches and the Catholic Climate Covenant<\/li>\n<li><strong>Numerous renewable energy companies <\/strong>that are members of the Advanced Energy Economy, American Wind Energy Association, and Solar Energy Industries Association, which together represent more than 3,000 companies in the advanced energy sector, a $200 billion industry in the United States<\/li>\n<li><strong>25 business associations<\/strong> including American Sustainable Business Council, U.S. Black Chambers, Inc., as well as state associations from West Virginia, Kentucky and Ohio, among others<\/li>\n<li><strong>Current <\/strong><strong>a<\/strong><strong>n<\/strong><strong>d former members of Congress<\/strong>, including 36 sitting Senators and 157 sitting members of the House<\/li>\n<li><strong>Leading public health associations<\/strong> such as the American Medical Association and the American Academy of Pediatrics<\/li>\n<li><strong>Na<\/strong><strong>t<\/strong><strong>i<\/strong><strong>onal security experts<\/strong> including former Secretary of State Madeleine Albright and former Secretary of Defense Leon Panetta<\/li>\n<\/ul>\n<ol start=\"2\">\n<li><strong>The legal and technical foundation of the Clean Power Plan is rock solid.<\/strong><\/li>\n<\/ol>\n<p>The Supreme Court has affirmed EPA\u2019s authority to regulate greenhouse gases under the Clean Air Act three times since 2007. In\u00a0<em>American Electric Power v. Connecticut<\/em><em>\u00a0<\/em>(2011), the Supreme Court specifically held that section 111(d) of the Clean Air Act \u2013 the provision that underlies the Clean Power Plan \u2013 \u201cspeaks directly\u201d to the regulation of carbon pollution from existing power plants.<\/p>\n<p>EPA exhaustively analyzed the Clean Power Plan to ensure that it was based on the best available technical information and would not compromise the affordability or reliability of our electricity supply. EPA also reviewed millions of comments, received on every aspect of the proposed version.<\/p>\n<p>A <a href=\"https:\/\/blogs.edf.org\/climate411\/2016\/04\/25\/experts-agree-the-clean-power-plan-has-a-rock-solid-legal-and-technical-foundation\/?_ga=1.248162254.852916913.1458489268\">range of renowned experts<\/a> have affirmed the robust legal and technical bases for the Clean Power Plan in amicus brief <a href=\"https:\/\/www.edf.org\/climate\/clean-power-plan-case-resources\">submissions<\/a> to the D.C. Circuit, including:<\/p>\n<ul>\n<li>The Institute for Policy Integrity &#8212; represented by New York University Law Dean Emeritus Richard Revesz<\/li>\n<li>Former EPA Administrators William Ruckelshaus and William Reilly, who served under Presidents Nixon, Reagan and George H.W. Bush &#8212; represented by Harvard Law School\u2019s Jody Freeman and Richard Lazarus<\/li>\n<li>Leon Billings and Tom Jorling &#8212; the principal drafters of the 1970 Clean Air Act<\/li>\n<li>Former state energy and environmental officials &#8212; including Larry Soward, Commissioner at the Texas Commission of Environmental Quality under Texas Governor Rick Perry<\/li>\n<li>Premier electric grid experts, who affirmed that EPA\u2019s approach is fully in line with on-going power sector trends<\/li>\n<li>Top climate scientists, who articulated the latest research on observed and projected impacts from our changing climate<\/li>\n<\/ul>\n<ol start=\"3\">\n<li><strong>The tremendous pace of clean energy development further reinforces the Clean Power Plan\u2019s reasonableness.<\/strong><\/li>\n<\/ol>\n<p>The cost of renewable energy is falling at an extraordinary rate, spurring dramatic expansion in its use. The <a href=\"https:\/\/www.lazard.com\/perspective\/levelized-cost-of-energy-analysis-90\/\">cost<\/a> of new wind power has dropped 60 percent \u2014 and the cost of new solar by 80 percent \u2014 since just 2009.<\/p>\n<p>Renewable energy is anticipated to make up approximately 63 percent of new capacity additions in <a href=\"http:\/\/www.eia.gov\/todayinenergy\/detail.cfm?id=25172\">2016<\/a>. In fact, the amount of new renewable energy capacity developed in the first three months of 2016 <a href=\"http:\/\/www.renewableenergyworld.com\/articles\/2016\/04\/renewables-swamp-natural-gas-in-first-quarter-2016.html\">exceeded<\/a> new natural gas by a factor of more than seventy to one. Almost 100 gigawatts of additional new renewable energy resources are now <a href=\"http:\/\/about.bnef.com\/content\/uploads\/sites\/4\/2015\/12\/2015-12-16-BNEF-US-solar-and-wind-tax-credit-impact-analysis.pdf\">projected<\/a> in the United States by 2020, and annual investment in energy efficiency has <a href=\"http:\/\/www.bcse.org\/wp-content\/uploads\/BCSE-2016-Factbook-Launch_DC-Event_resized.pdf\">quadrupled<\/a> in the last decade.<\/p>\n<p>America\u2019s powerful clean energy trends further buttress the feasibility of the Clean Power Plan\u2019s targets. But you don\u2019t have to take our word for it \u2014 because power companies have said so themselves.<\/p>\n<p>In their Clean Power Plan <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/power_companies.pdf\">filing<\/a>, major power producers emphasized their strong support for the Clean Power Plan, highlighting that it \u201charnesses existing trends within the electricity sector\u201d and was set \u201cwith ample margin and attention to what is practically attainable.\u201d<\/p>\n<p>As the companies noted, both they and the power sector in general have \u201chave successfully reduced emissions within their generation portfolios without compromising reliability and will continue to do so\u201d under the Clean Power Plan.<\/p>\n<p>Dominion Resources, an owner of several large coal-fired power plants in the Mid-Atlantic, affirmed the feasibility of compliance in a lengthy amicus brief <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/2016.04.01_dominion_amicus_brief_for_epa.pdf\">submitted<\/a> in support of the Clean Power Plan.<\/p>\n<ol start=\"4\">\n<li><strong>States and power companies are charging ahead.<\/strong><\/li>\n<\/ol>\n<p>On February 9, 2016, the <a href=\"https:\/\/www.edf.org\/media\/supreme-court-puts-clean-power-plan-pause\">Supreme Court stayed<\/a> enforcement of the Clean Power Plan in an unprecedented order. Nonetheless, states and power companies are voluntarily moving ahead, in recognition of the tremendous value in following the Clean Power Plan\u2019s flexible, sensible approach to achieving emissions reductions.<\/p>\n<p><a href=\"http:\/\/www.eenews.net\/interactive\/clean_power_plan#planning_status_chart\">More than half of states<\/a> are continuing to assess planning options under the Clean Power Plan. <a href=\"http:\/\/www.georgetownclimate.org\/articles\/states-ask-epa-to-provide-model-rule-other-information-on-clean-power-plan.html\">14 states<\/a> across the country have explicitly requested that EPA continue providing information and guidance to help them make informed decisions about potential Clean Power Plan obligations as they continue moving forward. <a href=\"https:\/\/www.edf.org\/media\/california-moves-forward-clean-power-plan-blueprint-grow-its-economy-protect-climate\">California<\/a> developed its <a href=\"http:\/\/www.arb.ca.gov\/cc\/powerplants\/powerplants.htm\">proposed Clean Power Plan state plan<\/a> in a year and released it for public comment earlier this month. State officials across the country have voiced support for sensible continued planning \u2014 as one Wyoming state legislator put it, \u201cWyoming should be prepared.\u201d (See a full compilation of state statements on the Clean Power Plan <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/state_cpp_momentum_-_20160929.pdf\">here<\/a>.)<\/p>\n<p><a href=\"https:\/\/www.edf.org\/sites\/default\/files\/content\/power_sector_momentum_20160926_final.pdf\">Power companies<\/a>\u00a0across the country have expressed similar sentiments. A representative from Mid-American Energy <a href=\"http:\/\/www.c2es.org\/blog\/bhanm\/business-can-help-road-agreement-action-climate\">highlighted<\/a> that they \u201cwish\u201d the stay hadn\u2019t happened, because of the resulting uncertainty. <a href=\"https:\/\/www.washingtonpost.com\/national\/health-science\/utilities-shrug-off-court-decision-say-carbon-cutting-plans-are-on-track\/2016\/02\/11\/d9e7dcb8-d10e-11e5-88cd-753e80cd29ad_story.html?postshare=1621455259591413&amp;tid=ss_mail\">American Electric Power<\/a>, a major producer of coal-fired electricity, said that the Supreme Court stay \u201cdoesn\u2019t change our focus on the diversification of our generation fleet,\u201d and those diversification plans include more gas and renewables. Power companies are already investing in clean energy in response to the market and their customers \u2014 for these companies, any delay in planning creates needless risk and uncertainty.<\/p>\n<ol start=\"5\">\n<li><strong>This record-breaking summer highlights just how urgently we need sensible climate protections.<\/strong><\/li>\n<\/ol>\n<p>It\u2019s challenging to encapsulate all the extreme weather we\u2019ve witnessed in 2016. Just in the U.S., we\u2019ve experienced a series of <a href=\"https:\/\/blogs.edf.org\/climate411\/2016\/07\/22\/four-things-you-may-not-know-about-the-heat-wave\/?_ga=1.88827858.852916913.1458489268\">dangerous heat waves<\/a>, deadly <a href=\"https:\/\/weather.com\/storms\/severe\/news\/flood-deaths-united-states-near-200\">floods<\/a>, and extreme <a href=\"http:\/\/www.ncdc.noaa.gov\/billions\/events\">storms<\/a>. This week\u2019s <a href=\"http:\/\/www.nytimes.com\/2016\/08\/17\/us\/climate-change-louisiana.html\">flooding in Louisiana<\/a> is just the latest heart-rending example \u2014 with lives tragically lost and upended across the state. Yesterday, NASA announced that <a href=\"http:\/\/climate.nasa.gov\/news\/2479\/nasa-analysis-finds-july-2016-is-warmest-on-record\/\">July 2016 was the warmest month ever<\/a> in 136 years of modern record-keeping. According to the <a href=\"http:\/\/public.wmo.int\/en\/media\/press-release\/global-climate-breaks-new-records-january-june-2016\">World Meteorological Organization<\/a>, 2016 is firmly on track to be the warmest year yet. The Weather Channel noted all of these wild weather events from the first six months of 2016 together <a href=\"https:\/\/weather.com\/news\/weather\/news\/weirdest-weather-2016-so-far\">here<\/a>, in a website on 2016\u2019s \u201cWeirdest Weather.\u201d All these events are fully in line with the hotter, more extreme weather that\u2019s predicted under a changing climate.<\/p>\n<p>Meanwhile, new <a href=\"http:\/\/nca2014.globalchange.gov\/report\/sectors\/human-health\">research<\/a> only underscores the human health costs of climate change. Mitigating the human health impacts of climate change will add to the Clean Power Plan\u2019s <a href=\"https:\/\/www.epa.gov\/cleanpowerplan\/fact-sheet-clean-power-plan-benefits-cleaner-more-efficient-power-sector\">substantial health benefits<\/a> from reducing soot and smog pollutants. EPA estimates that once the Clean Power Plan is fully implemented, these reductions will \u2014 every year \u2014 avoid 3,600 premature deaths, 1,700 heart attacks, 90,000 asthma attacks, and 300,000 missed workdays and schooldays.<\/p>\n<p>These climate risks and essential health benefits highlight the importance of having a mandatory framework to ensure emissions reductions. Clean energy trends are already charging ahead, but investors need the certainty that the Clean Power Plan provides \u2014 and all Americans\u2019 health and well-being are depending on it.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Clean Power Plan oral argument is coming up soon.
